In reference to the above dispute: It is true that there have been numerous alerts and system shut downs on this installationThe customer's dispute fails to mention some pertinent facts as follows
From the very start of this project this customer hired and fired multiple General Contractors and Subcontractors, with all the changes in personnel there was never any notification to Colorado Comfort Systems regarding changes that the General Contractors and Homeowner were making to design of the home and the layout and changes in wall locations and timing of scheduled subcontractors
This is important because in the HVAC Trade the locations of supplies and return ductwork can be critical to overall system performanceA wall was moved that had a large return air in that was located near the floor at the bottom of the wall and we were not informed of this change of location until after it was completedThis is a problem because heat rises and cold air sinks and the customer was complaining that it was cold in that specific roomWe tried to get access to the attic to try to make a correct that would have helped to solve the problem creating by moving the wall, but were denied access to the attic because they had already had the insulators blow in the insulation and the
customer did not want anyone in the attic
We then in an attempt to help fix this problem, added more heat runs at no additional cost to the customer, knowing that this was a minor fix and would not entirely solve the problem as the return air needs to be reworked which requires attic access
At no point was it discussed or agreed that credit would be given for the customer to recycle her own equipment
The original agreement was to remove and dispose of the old equipment at no charge to the customer as is in this trade
Due to the ongoing length of this project, proper systems maintenance was not performed by the customer resulting in system damaging and performance robbing, plugged condenser coil, evaporator coils and furnace recuperative coils resulting in degraded air flow, numerous system error alerts and the inability for the system to perform as it shouldThis has possibly and probably contributed to system component wear and tear beyond what would be construed warranty failure
The evaporator and recuperative coils were plugged solid as a result of insufficient filter changes and huge amounts of construction debris and drywall dustConstruction debris got past the filter and lodged in the blower wheel,
knocking it out of balance and damaging the motorThese pieces and parts were fixed, cleaned or replaced at no cost to the customer even though it was beyond our ability to control the conditions of the job site and resulted in the degraded system performance
We did take our factory representative out to the job site and the factory rep determined that the amount of supply air registers was sufficient, but the system does need more return air, which we had already offered as a solution, but the customer did not want any more openings and declined to let us complete this step
The hole that was put in the front of the furnace return plenum was put there by the factory rep to prove to Colorado Comfort Systems that the furnace needed more return airThe hole that was left was not large enough to remedy the situation, it was only to prove a point
Until the house gets more return air, the system will continue to have problems and will continue to have systems
failures, This has all been explained to the customer in detail that the system needed that return air fully and correctly installed where we wanted to do it at no cost and this would significantly reduce the noise coming from the outdoor unit as a result of high pressures which is a result of lack of air flow
It is true that freon levels were adjusted up and down during the cleaning of the components that became clogged and damaged as a result of all the construction debris
Late spring, early summer we wanted to come out and make the return air modifications that our factory rep wanted us to make and were told not to bother as she was going to have an independent company come out and do an evaluationThis was the last we had heard from the customer?
The complaint st*** that the evaluation said that the ductwork and the number of heat to cold air returns are not
proper which is what we have been telling her for the last yearStated also that the thermostat is not located in the right area, yet its location is centralized to the house and right above a side wall return air grill which is common installation practiceThe factory rep did not determine that the system configuration is not proper for the house
Once we realized that she was not going to allow us to fix the errors mentioned above, we did not collect the
payment in full that was due on the project which gave her a monetary compensation of $We cannot do more as the customer is unwilling to let us make the necessary corrections that were advised to be taken by the factory repWe cannot refund any additional as the scope of work included tearing out the existing duct system throughout multiple crawl spaces, installing a completely custom fabricated air distribution system designed and installed to work as was originally plannedWe already have provided additional services at no charge to the customer, and have continuously provided service as requested until we were notified not to
At this point there is nothing further we can doWe deeply regret this the homeowner will not let us make the necessary corrections which would allow the system to perform as designed

This letter is in response to *** ***’ letter of August 4, 2014. We will respond to his statements in the same order they are presented in his letter
A copy of the system shut downs/alerts created for the factory rep has yet to be submitted as requested multiple times
The statement that I have hired and fired multiple General contractors or Subcontractors is incorrect. We fired the original contractor and became an owner build
He refers to the design of the home and the layout and changes in wall locations being done. The one and only wall relocated was the wall in the master bedroom that the original builder installed in the wrong location, leaving a jog in the wall by the bay window, which was very unpleasing. The wall was relocated 14” east, to the original location per the original stamped plan. According to the foreman onsite, the cold air return in the ceiling was not a problem and it would help cool the room in the summertime
Regarding the equipment recycle, recycling of the heat pump, compressor, and ductwork was discussed with the foreman onsite and he stated we would get credit for the equipment recycle
In regard to the ongoing length of the project, the project was completed in months. From the beginning there were multiple system problems. The system was loud, which was reported to CCS. The system Freon was adjusted, filter changed and adjustments made to the system. We were very diligent in changing filters and maintaining the system. A dated log was kept on the face of the furnace, as proof after multiple requests to change more frequently. CCS owner stated he should have been more specific in how often to change the filters in the beginning, but believes we are on the right track now
When the system was being installed, CCS left open ducts in the crawl space. CCS also did not connect the condensation line to the plumbing as required We finally hired and paid for a plumber to connect it to the waste line in order to get rid of the bucket that needed to be dumped every few days
The system had shutdowns and alerts from the beginning, and the system was bled and recharged numerous times, prior to and after the system was repaired. CCS stated an employee overcharged the system, he didn’t know what he was doing and he no longer works for the company. The factory rep came to check the system and said the Freon was not correct and he bled and recharged the unit. He said he did it with the correct outdoor temperature and to the proper level. The system shut down a few hours later
The factory rep said we need to put in another cold air return. An attempt to add another cold air return was absolutely unprofessional. This was demonstrated by cutting a hole in the front of the furnace and turning the metal upward. The hole was left with a filter over the top of the hole and bent piece of metal. The system still went into a failed state
At the time the factory rep was here he said, “I thought they knew how to install the system properly, however, they have learned a lot and we will get it right”
Colorado Comfort System is required to get a permit from Weld County Building Inspections for a project of this size A copy of the permit needs to be presented prior to any other work being performed
Also, an Equipment Airflow Commissioning Test needs to be performed to determine real issue at hand. We are requesting both CCS and an independent contractor of our choice shall perform the test
Regarding the payment, as soon as the system is up and running 100% capacity according to factory ***s, for days payment will be made.
To recap, a building permit needs to be acquired and an Equipment Airflow Commissioning Test needs to be performed with Colorado Comfort Air and an HVAC inspector of our choice. A copy of both the permit and airflow test needs to be on file at the residence.
If the entire system cannot perform without system alerts/faults/shutdowns and at a tolerable noise level a full refund is expected. If the system is repaired and/or replaced to perform correctly, payment of the remaining balance due will be made

Ref # [redacted]There has never been a copy of shut downs and alerts generated by anyone at anytime and is not available.  Regarding the return air in the ceiling in the master bedroom, the Foreman who allegedly said that the ceiling return would not be a problem, is incorrect.  He brought it to my attention that it had been done after the fact, and we were not allowed to correct the problem.  It is not acceptable the way it is, the customer has been told what we need to do to enhance the air flow in that part of the house, but will not allow us to do it.  The Formentioned Foreman is no longer employeed by Coloroado Comfort Systems, and did not have the authority to speak on behalf of the company.  Regarding recycling of equipment and materials, it has never been our policy to credit the owners for disposal of their equipment, our proposal stated removal and disposal of equipment which is a Free service offered to all of our customers, this foreman is no longer with us, so we have no way to verify this with him, and again he did not have the authority to speak on behalf of the company.  Regarding the length of the project and system problems.  It is untrue that they were diligent from the beginning in changing filters and maintaining the system.  Had filters been changed weekly during a construction project has needed, Colorado Comfort Systems would not have had to replace a blower wheel and motor at our cost, pull and clean a completely plugged evaporator coil, as well as clean the plugged secondary recuperative heat exchanger coil.  Both of these repairs created undue stress on the new equipment.  It is untrue that Colorado Comfort Systems left any duct work open in the crawl space when the system was in operation.  The condensate line was tied to the original location but the plumber on site at that time repiped the drain system and did not hook up the condensate lines.  Its my recollection that we installed a drain but that is open to debate.  Again the technician that was on site is no longer with the company.Regarding systems shut down and alerts from the beginning of operation:  We did state that our technician had the system overcharged, but never stated that he did not know what he was doing, he had attended factory authorized training on this piece of equipment.  The system was started in less than ideal conditions to accurately charge the system, the customer was informed that a following and system balancing would be needed when weather permitted.Cold Air Return:  There was never an attempt to add another cold air return, the hole cut in the return plenum was to prove that the system needed more return air, the hole was to be patched and sealed professionally after we installed the recommended additional return air.  To date the customer has not allowed us to do what the Factory Reps recommended.  Regarding Building Permit:  Building Permits are generally bought and paid for by the General Contractor on the job, in our proposal signed by the customer, permit and inspections are clearly excluded.Regarding air flow testing:  It is unreasonable to do any kind of air flow testing until we are allowed to make the corrections that the Factory Reps deemed necessary.

This letter is in response to [redacted]’ letter of September 2, 2014.  I will respond to his statements in the same order they are presented in his letter.
I believe there is/was a log since when the rep hadn’t come for several weeks I was told the factory rep wanted a copy of all the system shutdowns/alerts created for him to have an idea what the problem may be.  CCS was trying to get this log together for him.  Therefore, I trusted there was a copy available.
According to the foreman onsite, the cold air return in the ceiling would help cool the room in the summertime.
In regard to the ongoing length of the project, the project was completed in 12 months.  From the beginning there were multiple system problems.  The system was loud, which was reported to CCS.  The system Freon was adjusted, filter changed and adjustments made to the system.  We were very diligent in changing filters and maintaining the system.  It is said if we changed the filter weekly these problems would not have existed.  A dated log was kept on the face of the furnace, as proof of changing the filter every 3-5 days.  Therefore, I believe we were acting according to his recommendation and we did not compromise the system by not being diligent in what we were asked to do.

Regarding the permit, CCS was recommended by the original contractor.  It is my recollection that CCS was to talk to the original contractor to be sure they were covered on the building permit which they were not.  I assumed the permit contained this aspect and learned later it had not.  Therefore, they should have acquired one.
Also, an Equipment Airflow Commissioning Test needs to be performed to determine real issue at hand.  I am requesting both CCS and an independent contractor of my choice shall perform the test.
Regarding the payment, as soon as my system is up and running 100% capacity according to factory [redacted]s, payment will be made.  
To recap, an Equipment Airflow Commissioning Test needs to be performed with Colorado Comfort Air and an independent consultant of my choice.  A copy of the airflow test needs to be explained to us and what is recommended by the two parties.  The results and airflow test will be part of the remodel file.
I expect the system to work properly, creating the pleasant environment one would want in all rooms.  If the entire system cannot perform without system alerts/faults/shutdowns and at a tolerable noise level and at the comfort level one would expect a full refund is expected.   If the system is repaired and/or replaced and performing to the expected service level and comfort level, payment of the remaining balance due will be made.

We were told by Colorado comfort that there would be a $675.rebate if we purchased a Lennox furnace from them. We purchased it and never received the rebate. We would have purchased a less expensive furnace if we had known that we would not receive the rebate. They are blaming Lennox. They got paid, Lennox got paid, but we didn't! We were misinformed.
