To Whom it may concern,
We are aware that Mr *** signed up for our Platinum Pass *** has decided not to come to any future events this yearIn an effort to make it up to him, we have offered to extend the offer to come to unlimited
events in both and The pass *** he purchased is called the Platinum Pass *** the packet that explains this is attachedWe are producing over event dates this year and he has the option to be a vendor at any of those shows that he wishes toWe have events in very prominent locations, including the 16tth Street Mall in Denver, Skyline Park in Denver, Central Park in Boulder, The Pearl Street Mall in Boulder, Old Town Square in Fort Collins, as well as events in Manitou Springs, Estes Park, Grand Lake, and Crested Butte on Elk AvenueAll of these locations have proven to be very successful for all the other vendors we work with this yearWe have over vendors that have purchased the Platinum Pass *** they have all given me positive feedback except for Mr *** who never really even gave it a tryWe also have over people that have signed up for events this year and Mr*** is our first complaint so I can't help to fee that it is just him, that is not satisfied with his purchase
It appears that the real reason that he has chosen to back out is because maybe he has changed his mind about selling photography at special eventsThe opportunity to sell his work is there and it is his decision to no participateThe Platinum Pass ** an excellent value and we do not understand his decision to not participateIf he has not made his sales objective with the events he did attend then possibly the public was not responsive to his product or pricingWe do not guarantee sales at our events and we do not feel that any of the reasons that he has stated in his narrative are grounds for cancelling his commitment to usWe feel that we have made him a generous offer to allow him to do unlimited events in both and and hope he takes us up on that offer
I am trying to figure out why he has chosen to not attend any of the future eventsThe reasons he states in his narrative are not grounds for a refundWhat he states is:
"I did not attend most of the events the fee was intended to cover." - Which was completely his own decision
"additional vendors were arriving late" is not grounds for him to cancel his whole season with us
"partially blocking the pedestrians' view of my booth" - He had a very visible corner at the market on this date and we do not guarantee that his booth will be in full view from all angles
"Some of my merchandise got wet during the rainstorm" - We are not responsible for inclement weather at our eventsThis is clearly stated in our vendor agreement
"poor visibility of the event's location" - This annual event is in a wonderful location right off of Linclon Ave, the main downtown location in Steamboat Springs and is more visible than the location that the other art fair uses that is further from the Downtown and is less visible from the road
"Customer traffic at the location was light (at the Boulder Market) - We do not agree with this generalized statement and we have had a lot of positive feedback from the other vendors that participate in the Boulder Market on a regular basisI do not know what his anticipated pedestrian traffic would be, but we have been happy with the foot traffic at the marketWe have attached a few photos to show the crowds that the market attracts
"I was not likely to recover the value of my "Platinum Pass" by attending any further eventsNor was I likely to recover the costs of traveling to the events he organizes outside the greater Denver area." - I don't know where he is backing these statementsThe 16th Street Mall and Pearl Street Mall are of the busiest pedestrian areas in the State, and he is just making unjustified statements to try to rationalize his decision to back out
The fact is that as per our vendor agreement on the vendor application which he signed and agreed to "Please note that we do not give refunds, if an exhibitor cancels a show days prior to the event, then we will issue a company credit." I attempted to offer him credit but he has rejected that offer and has chosen to try to make us look bad to the Revdex.comWe do not feel that his lack of commitment or change of plans is justification for a refundWe view the Platinum Pass ** be the same as buying season tickets to the Rockies Game, or similar to buying a concert ticket, or similar to a gym membership, or similar to every other craft show in the industryIf someone signs up or buys one of these items and choses to not attend, there is not refund due to the fact that the consumer did not go to the event, or the baseball game, or the gym, or any other similar circumstanceHis reasons for wanting a refund are not valid excuses and we do not feel that we owe him anything aside from the opportunity for him to attend future events, if he changes his mind
If you decide to do more events with his pass *** year or next year, he can let us know and we will honor his pass *** not have any hard feelings about this dispute

The response Colorado Events provided is unsatisfactory, for the following reasons:
I am not seeking to "back out" of any "commitment"My registration fee was the only thing committedI have honored the written vendor guidelines provided for the three events I attended this season
I only laid out the facts in my complaintI did not provide a conjecture as to Mr***' motives, because everyone has their own point of view about any given fact, and I cannot know ***' motivesBut it seems that Mr*** is willing to offer his opinion of my "real" reason for not doing business with him, and has questioned the value / pricing of my productI do not consider such opinions factual nor professional
Instead of acknowledging the problems I listed with the "Steamboat Solstice Soiree" event, Mr*** maintains that the larger West Lincoln Park would have been a poorer venue for the event
I was able to exhibit at the Steamboat Arts Council's "Art in the Park" event at that very location, a few weeks laterIt has excellent visibility from the highwayIt was very well organized, with entertainment provided both days of the eventIt had roughly six times more vendors exhibiting than the "Soiree" did, and a proportionately higher number of visitorsMy experience at that event was much better, businesswiseThere were other fine art photographers exhibitingsome of which were repeat vendors, which confirms that event DOES provide buyers of fine art
Regarding the "sidewalk" markets located in the downtown area in Denver:
Mr*** has still not explained exactly why spaces for booths were designated at the beginning of an event, but later in the day other booths were set up outside the designated areaI have not observed other event organizers allowing such a practice
I did not blame Mr*** for the rain in Denver, nor for my merchandise getting wetThat was a typical "act of God"I have no issues with the pedestrian traffic in DenverIt is probably true that Colorado Events has many satisfied vendorsHowever, Mr*** still has not disclosed which of his events have repeat vendors of fine art paintings, photos, or sculptureThat speaks directly to his statement about "grounds for canceling" and "grounds for a refund", and to my own judgement that I was not likely to recover the cost of my "Platinum Pass"
Colorado Events' response stated that I "never really even gave it a try"I would respond that, given these circumstances, attending three events is an adequate tryI don't consider attending future Colorado Events to be wise for my business, and I stand by my request for Mr*** to offer me a partial refund
