Complainants responses in bold: Complaint: [redacted] and [redacted] had first begun their relationship with CMH in May At this point they began the design processand the steps to build their homeOn July 16, they paid a design fee that starts only the design part of the projectWhile they had pre-approval from their bank, during the end of their design process the bank was unable to officially underwrite the loan due to their home not being able to appraise for the amount neededWhen this happened the ordering of their home was removed from our future schedule and put on hold [redacted] continued to try and help cus***ers find alternative financing and almost months later in December was successfulAt this time we explained to [redacted] and [redacted] that during that delay, while they were obtaining new financing we had new cus***ers obtain their financing and order their homes We told them that these project were now before theirs and that out schedule was getting very full for the next building season and their home would take longer than they first expected They agreed and understood at the time and decided to move forward with their projectWe were advised that our project would be finished by the end of Summer It is now going into September and we are not yet even close to being finished RMHB began working on their project in the summer of I am rejecting this response because:Knowing that it was very difficult to find funding and that their budget was very tight we took every step to keep their costs downWe self-performed the excavation for their home so we could keep costs within budgetAfter receiving several higher bids we finally found a concrete sub-contractor that allowed us to complete their foundation for the Allowance amount We have also worked to control costs on the extensive driveway that needs to be built proposing a cheaper alternative culvert layout to lower cost We are absolutely trying to help them wherever we can Actually, RMHB/CMH began our project late January / early February but kept being told they were "waiting for bids and responses" - we paid the deposit in JanuaryI would hope that RMHB/CMH would attempt to save all their clients money and find the most econmical and within budget bids when possibleAs far as the driveway, to this date 8/28/we have not received any bid information as to the cost of the drivewayHowever with that being said, [redacted] the Sales Manager stated that the driveway cost would be within budgetI am guessing that is because the driveway and walkway budget has been depleted without completion of the drivewayWe were advised that RMHB/CMH has only one excavator to do excavation work Garage Foundation:As in all construction projects certain issues arise that were not originally forecastedIn this case it was where they wanted their home placed on their 3+ acre lotTheir requested placement was in the end too close to the property line set-back and the county required it to me moved (about ft) during the permit review process We were able maintain the same angle of the house but in order to keep the foundation on undisturbed soil (as the engineer required) the home needed to be brought down in elevation as it moved down the hill away from the setback Due to the relative height difference, the lowering of the house made it too close to the height of the detached garage ft away When this issue was communicated to us we immediately brought out the site engineer and had a meeting with him, [redacted] , ***, [redacted] (via phone), [redacted] and [redacted] After evaluating the issue, it was determined that we could effectively lower the garage down 18” by cutting the entrances downThis allowed us to get us back to the desired elevation change relative to the house All parties agreed upon the solution and a no cost change order was signed by the cus***er CMH paid for all cost associated with lowering the garage entrances This solution was then completed on August 10, When the house placement was moved about 2.5ft, the garage placement was not considered needing adjusted as well and not addressed at that time, meaning the garage placement also needed to be adjusted due to the house being moved forwardWe are not sure, how or why RMHB/CMH would not catch that and address it at that time, prior to the garage footers being pouredThe concrete garage footers were cut and some of the garage grading as been completed, however this was not completed until August 19thNot on August 10th as noted aboveAlso the house angle is not correct according to the engineered site planBut we the clients agreed to the change order for the garageJust wanted it noted that the house was not placed at the correct angleThis we believe happened due to lack of CMH/RMHB involvement and checking theirs crews work House Foundation:The concrete sub-contractor that was hired by RMHB unfortunately poured one of the dimensions on the house foundation wrong by 6” When the house was set it resulted in a small portion of the house (13ft) over hanging the foundation by 6”Again, we immediately contacted a foundation engineer, [redacted] , and had him meet us on site with ***, ***, [redacted] (Concrete Contractor) and RMHB staff [redacted] designed a fix (see attached letter) that would pour two new 6”walls next to the existing ones that would secure the home to the foundationAll parties agreed and a no cost change order was signedFix completed on August 1, On July 23rd ( [redacted] and ***) requested a site meeting with all parties, to include the engineer, prior to any fix on the concrete footersOur concern and question for the house foundation being incorrect, is why did RMHB/CMH not visit the site prior to taking delivery of the house to inspect and measure the foundation/footers to ensure the concrete sub-contractor made no mistakesIs it not CMH/RMHB's responsibility to oversee their hired crews work? Also there is now an approximate inch gap between the house and foundation on the back right side of the houseNot sure how this is going to be addressed or what the fix isSeptic System:RMHB sent out RFP documents back in June 28, and we only received one backWe intended to use this installer and as the time approached the installer then declined because of the distance they would have to travel and the other work they already had scheduledWe explained this to [redacted] and [redacted] that the market is very busy right now and sub-contractors can pick and choose the jobs they work onWe then continued our search to find a new installer and found one that was in the cus***er’s budget and we booked them for Sept16thCus***ers were notified immediatelyWhy was the septic not already in process (finding bids) when the house deposit was made on 1/28/knowing that the market is very busyWe ( [redacted] and ***) researched and found a septic company, we made contact with them and then provided the septic company information to RMHB/CMH who then scheduled the installIt's interesting that we had no problem locating a septic company that was available and within budgetWe were notified about the scheduled date, however we had to ask RMHB/CMH to send us the bid estimate.Water Well:The well company has not been scheduled The historical well permit needed to be located for the existing well (with a windmill over it) in order to receive approval for the building permit Once located the old testing info for the well was provided by [redacted] prior to contacting a well pump company The well pump company would also be the company to install and water quality filters if the owner decided it was necessary We are currently in the process of finalizing the well pump bids Not sure why this is taking the time that is has, the well permit was issued on 3/29/To date 8/28/no well water bids have been communicate to usNot sure if searching and finding a water well company is our ( [redacted] and ***) responsibility Electricity:Mountain View Electric Association is the provider for their electricity [redacted] was contacted, contracted and paid to run their power to the location they had designed for the property [redacted] designed the service to be trenched to the house from a nearby pole The cus***er expressed their worry about ***’s design so RMHB met again with [redacted] to discuss other options [redacted] and [redacted] were e-mailed this options on July 26, along with an estimate provided by [redacted] for each of them, and the options were discussed on site with themWe have had no decision made by the cus***ers to date This is currently delaying the install of electricity to the home.RMHB/CMH told us ( [redacted] and ***) on 8/19/that [redacted] would be contacting us to discuss our chosen option for the electrical installationThis is now being taken care of by us ( [redacted] and ***) even though RMHB/CMH is suppose to be a turn key operation Gas:Costumers were told by RMHB as well as their General contractor that Gas would be scheduled after the septic system and electrical line are installedIt is good building practice to have the gas line run to the house last to avoid hitting it with any other utility service lines that require excavation The septic and electrical locations/excavation are not even near or close to where the gas line would runIs this something we should ( [redacted] and ***) take care of as well, contacting the gas company to get the installation scheduled? Perimeter Drain (referred as French drain by cus***er’s): There has been absolutely no additional drainage issue created due to house placement The house is set into the same hill the same amount as is was originally designed (just a few feet further from the setback) There is also no requirement for a perimeter drain from the county or in the building codes Because it is not required it was not included in their allowance schedule during home design The foundation design, however, included a detail for a perimeter drain After researching the soils report, and verifying with the county, it was determined that it was indeed not required At this point we had identified a conflict in the construction documents We had a foundation print that shows a perimeter drain, a county that does not require one, and an Allowance schedule that does not contain funds to install one When this happens we need to clarify with the cus***er what they want to do and what we feel is most appropriate To accomplish this, we spoke to them and sent a change order ( [redacted] CO #1.pdf) in an email dated 6/28/ This change order also included an additional amount needed for the final building permit fee total This change order was also sent to the bank and cus***er with a bank draw request The cus***er approved the submittal to the bank for payment After approval, the draw (which included the additional amount needed for permit fees on the change order) was paid by the bank We took their approval of the draw package as their approval of the change order that was contained in the draw package because we never heard any different from the cus***er Now that they have raised the concern for a perimeter drain we have presented them with two change orders to give them an opportunity to clarify what they would like us to do The first is the original changed order they sent into the bank in the draw package and the second would add a perimeter drain to their allowance schedule so we can install one We asked them to approve either one The cus***er as of 8/has not approved either By the cus***er refusing to respond to either change order excavation back fill work has officially stopped until their approval is given to the two options they have The first change order for the perimeter drain was sent on 6/28/2016, however this was prior to the house being set at the incorrect angle, thus causing the drainage concernIt is correct that we have not yet signed the change order that was again sent to us on 8/8/ Because of the error of the house angle placement, we request that RMHB/CMH install a perimeter drain by a licensed plumber at their expenseWe at RMHB have worked very hard to keep this project on or under budget for the cus***erThis includes offering to move trees around their lot even though it is not included in the budget or our contractAfter reviewing their complaint, we can only conclude that this is an attempt to have us pay for major parts of their home that we are unwilling to payAs with every home we sell we always correct and address any issues that come up during a project and in this case have taken all of the appropriate steps in an expedited manner to clarify and keep the project movingIt was verbally agreed with RMHB/CMH of the site clearing to include the moving of all downed trees to one location on the propertyUnfortunately this is just another example of verbal agreements not being met by RMHB/CMH, the site clearing was in the budget and has already been paid forWe understand it is our responsibility as clients to inspect all work prior to authorizing paymentIt is with much regret that we trusted RMHB/CMH that they would do the right thing and act on their agreed statementsI'm not sure what is meant by RMHB/CMH indicating all the appropriate steps have been taken in an expedited mannerWe still do not have Water well bids or installation date, no gas installation date, no driveway finish date, the dirt piles and downed trees are in the way of the septic company accessing the septic sight location, (pic attached)The house was built and final payment made on 5/4/and was sitting at the factory from that point until delivery on July 21st (which we didn't know it had been deliver and sitting on our property,) and set on July 22nd [redacted] mentioned that the factory had been contacting him almost daily, asking when he was going to be ready to take delivery and get it off their lotIt is with dispute that the house was completed but not delivered within the days as stated in the contract RMHB has meet all of the terms of our contract including keeping all promised delivery and construction time tables This is despite the slow responses and approvals from the cus***er Our agreement with them says that they will provide their feedback and approval of change orders within XX days As is currently the case they are taking weeks if not months to approval them In many cases this keeps us from completing the same work that they have complained to the Revdex.com is not complete We have been waiting for their signature approval of the perimeter drain change order for over months and have halted work in that area until it is signed Additional the electrical design is awaiting their approval which is delaying [redacted] from completing its work The only outstanding item for us to respond to is the change order for the perimeter drainWe have made every payment request on time and well within the agreed timelineOur finical intuition can confirm all payments made and attests all were paid within the agreed timeline if not soonerThe perimeter change order is not delaying any other site work to be performed except for the backfill on the houseWe were advised that they only have one excavator and it is not always availableWe can understand that, however when the excavator was on site, why was the driveway not gradedThere are still piles of dirt around the base of some of our trees, which is probably damaging the treesThe electrical design is as we now understand our responsibility, so this would in no way prevent RMHB/CMH to move forward with all the other outstanding items that have not been completed We would like to work with the Revdex.com to resolve this complaint in a timely mannerAttached are the contracts, change orders, and other supporting documentsIf it would be helpful we would be willing to meet with the Revdex.com as well as the complainants in order to prove that we have acted with integrity, ethics and with the best intentions for our clients We are requesting our contract be terminated with RMHB/CMH and all remaining projects be turned over to our finishing contractor, and, reimbursed for all projects that have been paid for but have not been completed to date It is good building practice to have the gas line run to the house last to avoid hitting it with any other utility service lines that require excavation.    Perimeter Drain (referred as French drain by cus[redacted]er’s):   There has been absolutely no additional drainage issue created due to house placement.  The house is set into the same hill the same amount as is was originally designed (just a few feet further from the setback).  There is also no requirement for a perimeter drain from the county or in the building codes.  Because it is not required it was not included in their allowance schedule during home design.  The foundation design, however, included a detail for a perimeter drain.  After researching the soils report, and verifying with the county, it was determined that it was indeed not required.  At this point we had identified a conflict in the construction documents.  We had a foundation print that shows a perimeter drain, a county that does not require one, and an Allowance schedule that does not contain funds to install one.  When this happens we need to clarify with the cus[redacted]er what they want to do and what we feel is most appropriate.  To accomplish this, we spoke to them and sent a change order ([redacted] CO #1.pdf) in an email dated 6/28/2016.  This change order also included an additional amount needed for the final building permit fee total.  This change order was also sent to the bank and cus[redacted]er with a bank draw request.  The cus[redacted]er approved the submittal to the bank for payment.  After approval, the draw (which included the additional amount needed for permit fees on the change order) was paid by the bank.  We took their approval of the draw package as their approval of the change order that was contained in the draw package because we never heard any different from the cus[redacted]er.  Now that they have raised the concern for a perimeter drain we have presented them with two change orders to give them an opportunity to clarify what they would like us to do.  The first is the original changed order they sent into the bank in the draw package and the second would add a perimeter drain to their allowance schedule so we can install one.  We asked them to approve either one.  The cus[redacted]er as of 8/22 has not approved either.  By the cus[redacted]er refusing to respond to either change order excavation back fill work has officially stopped until their approval is given to the two options they have.         We at RMHB have worked very hard to keep this project on or under budget for the cus[redacted]er. This includes offering to move trees around their lot even though it is not included in the budget or our contract. After reviewing their complaint, we can only conclude that this is an attempt to have us pay for major parts of their home that we are unwilling to pay. As with every home we sell we always correct and address any issues that come up during a project and in this case have taken all of the appropriate steps in an expedited manner to clarify and keep the project moving.   RMHB has meet all of the terms of our contract including keeping all promised delivery and construction time tables.  This is despite the slow responses and approvals from the cus[redacted]er.    Our agreement with them says that they will provide their feedback and approval of change orders within XX days.  As is currently the case they are taking weeks if not months to approval them.  In many cases this keeps us from completing the same work that they have complained to the Revdex.com is not complete.  We have been waiting for their signature approval of the perimeter drain change order for over 2 months and have halted work in that area until it is signed.  Additional the electrical design is awaiting their approval which is delaying [redacted] from completing its work.       We would like to work with the Revdex.com to resolve this complaint in a timely manner. Attached are the contracts, change orders, and other supporting documents. Complainants responses in bold:
Complaint: [redacted] and [redacted] had first begun their relationship with CMH in May 2015. At this point they began the design process. and the steps to build their home. On July 16, 2015 they paid a design fee that starts only the design part of the project. While they had pre-approval from their bank, during the end of their design process the bank was unable to officially underwrite the loan due to their home not being able to appraise for the amount needed. When this happened the ordering of their home was removed from our future schedule and put on hold. [redacted] continued to try and help cus[redacted]ers find alternative financing and almost 6 months later in December 2015 was successful. At this time we explained to [redacted] and [redacted] that during that delay, while they were obtaining new financing we had 5 new cus[redacted]ers obtain their financing and order their homes.  We told them that these project were now before theirs and that out schedule was getting very full for the next building season and their home would take longer than they first expected.  They agreed and understood at the time and decided to move forward with their project. We were advised that our project would be finished by the end of Summer 2016. It is now going into September and we are not yet even close to being finished.  RMHB began working on their project in the summer of I am rejecting this response because:. Knowing that it was very difficult to find funding and that their budget was very tight we took every step to keep their costs down. We self-performed the excavation for their home so we could keep costs within budget. After receiving several higher bids we finally found a concrete sub-contractor that allowed us to complete their foundation for the Allowance amount.  We have also worked to control costs on the extensive driveway that needs to be built proposing a cheaper alternative culvert layout to lower cost.  We are absolutely trying to help them wherever we can.  Actually, RMHB/CMH began our project late January / early February but kept being told they were "waiting for bids and responses" - we paid the deposit in January. I would hope that RMHB/CMH would attempt to save all their clients money and find the most econmical and within budget  bids when possible. As far as the driveway, to this date 8/28/2016 we have not received any bid information as to the cost of the driveway. However with that being said, [redacted] the Sales Manager stated that the driveway cost would be within budget. I am guessing that is because the driveway and walkway budget has been depleted without completion of the driveway. We were advised that RMHB/CMH has only one excavator to do excavation work.  Garage Foundation:As in all construction projects certain issues arise that were not originally forecasted. In this case it was where they wanted their home placed on their 3+ acre lot. Their requested placement was in the end too close to the property line set-back and the county required it to me moved (about 2.5 ft) during the permit review process.  We were able maintain the same angle of the house but in order to keep the foundation on undisturbed soil (as the engineer required) the home needed to be brought down in elevation as it moved down the hill away from the setback.  Due to the relative height difference, the lowering of the house made it too close to the height of the detached garage 20 ft away.  When this issue was communicated to us we immediately brought out the site engineer and had a meeting with him, [redacted] (via phone), [redacted] and [redacted]. After evaluating the issue, it was determined that we could effectively lower the garage down 18” by cutting the entrances down. This allowed us to get us back to the desired elevation change relative to the house.  All parties agreed upon the solution and a no cost change order was signed by the cus[redacted]er.  CMH paid for all cost associated with lowering the garage entrances.  This solution was then completed on August 10, 2016 When the house placement was moved about 2.5ft, the garage placement was not considered needing adjusted as well and not addressed at that time, meaning the garage placement also needed to be adjusted due to the house being moved forward. We are not sure, how or why RMHB/CMH would not catch that and address it at that time, prior to the garage footers being poured. The concrete garage footers were cut and some of the garage grading as been completed, however this was not completed until August 19th. Not on August 10th as noted above. Also the house angle is not correct according to the engineered site plan. But we the clients agreed to the change order for the garage. Just wanted it noted that the house was not placed at the correct angle. This we believe happened due to lack of CMH/RMHB involvement and checking theirs crews work.   House Foundation:The concrete sub-contractor that was hired by RMHB unfortunately poured one of the dimensions on the house foundation wrong by 6”.  When the house was set it resulted in a small portion of the house (13ft) over hanging the foundation by 6”. Again, we immediately contacted a foundation engineer, [redacted], and had him meet us on site with [redacted] (Concrete Contractor) and RMHB staff. [redacted] designed a fix (see attached letter) that would pour two new 6”walls next to the existing ones that would secure the home to the foundation. All parties agreed and a no cost change order was signed. Fix completed on August 1, 2016.  On  July 23rd ([redacted] and [redacted]) requested a site meeting with all parties, to include the engineer, prior to any fix on the concrete footers. Our concern and question for the house foundation being incorrect, is why did RMHB/CMH not visit the site prior to taking delivery of the house to inspect and measure the foundation/footers to ensure the concrete sub-contractor made no mistakes. Is it not CMH/RMHB's responsibility to oversee their hired crews work?  Also there is now an approximate 5 inch gap between the house and foundation on the back right side of the house. Not sure how this is going to be addressed or what the fix is. Septic System:RMHB sent out RFP documents back in June 28, 2016 and we only received one back. We intended to use this installer and as the time approached the installer then declined because of the distance they would have to travel and the other work they already had scheduled. We explained this to [redacted] and [redacted] that the market is very busy right now and sub-contractors can pick and choose the jobs they work on. We then continued our search to find a new installer and found one that was in the cus[redacted]er’s budget and we booked them for Sept. 16th. Cus[redacted]ers were notified immediately. Why was the septic not already in process (finding bids) when the house deposit was made on 1/28/2016 knowing that  the market is very busy. We ([redacted] and [redacted]) researched and found a septic company, we made contact with them and then provided the septic company information to RMHB/CMH who then scheduled the install. It's interesting that we had no problem locating a septic company that was available and within budget. We were notified about the scheduled date, however we had to ask RMHB/CMH to send us the bid estimate.Water Well:The well company has not been scheduled.  The historical well permit needed to be located for the existing well (with a windmill over it) in order to receive approval for the building permit.  Once located the old testing info for the well was provided by [redacted] prior to contacting a well pump company.  The well pump company would also be the company to install and water quality filters if the owner decided it was necessary.  We are currently in the process of finalizing the well pump bids.  Not sure why this is taking the time that is has, the well permit was issued on 3/29/2016. To date 8/28/2016 no well water bids have been communicate to us. Not sure if searching and finding a water well company is our ([redacted] and [redacted]) responsibility.  Electricity:Mountain View Electric Association is the provider for their electricity. [redacted] was contacted, contracted and paid to run their power to the location they had designed for the property.  [redacted] designed the service to be trenched to the house from a nearby pole.  The cus[redacted]er expressed their worry about [redacted]’s design so RMHB met again with [redacted] to discuss other options. [redacted] and [redacted] were e-mailed this options on July 26, 2016 along with an estimate provided by [redacted] for each of them, and the options were discussed on site with them. We have had no decision made by the cus[redacted]ers to date.  This is currently delaying the install of electricity to the home.RMHB/CMH told us ([redacted] and [redacted]) on 8/19/2016 that [redacted] would be contacting us to discuss our chosen option for the electrical installation. This is now being taken care of by us ([redacted] and [redacted]) even though RMHB/CMH is suppose to be a turn key operation.  Gas:Costumers were told by RMHB as well as their General contractor that Gas would be scheduled after the septic system and electrical line are installed. It is correct that we have not yet signed the change order that was again sent to us on 8/8/2016  Because of the error of the house angle placement, we request that RMHB/CMH install a perimeter drain by a licensed plumber at their expense. We at RMHB have worked very hard to keep this project on or under budget for the cus[redacted]er. This includes offering to move trees around their lot even though it is not included in the budget or our contract. After reviewing their complaint, we can only conclude that this is an attempt to have us pay for major parts of their home that we are unwilling to pay. As with every home we sell we always correct and address any issues that come up during a project and in this case have taken all of the appropriate steps in an expedited manner to clarify and keep the project moving. It was verbally agreed with RMHB/CMH of the site clearing to include the moving of all downed trees to one location on the property. Unfortunately this is just another example of verbal agreements not being met by RMHB/CMH, the site clearing was in the budget and has already been paid for. We understand it is our responsibility as clients to inspect all work prior to authorizing payment. It is with much regret that we trusted RMHB/CMH that they would do the right thing and act on their agreed statements. I'm not sure what is meant by RMHB/CMH indicating all the appropriate steps have been taken in an expedited manner. We still do not have Water well bids or installation date, no gas installation date, no driveway finish date, the dirt piles and downed trees are in the way of the septic company accessing the septic sight location, (pic attached). The house was built and final payment made on 5/4/2016 and was sitting at the factory from that point until delivery on July 21st (which we didn't know it had been deliver and sitting on our property,) and set on July 22nd. [redacted] mentioned that the factory had been contacting him almost daily, asking when he was going to be ready to take delivery and get it off their lot. It is with dispute that the house was completed but not delivered within the 60 days as stated in the contract.  RMHB has meet all of the terms of our contract including keeping all promised delivery and construction time tables.  This is despite the slow responses and approvals from the cus[redacted]er.    Our agreement with them says that they will provide their feedback and approval of change orders within XX days.  As is currently the case they are taking weeks if not months to approval them.  In many cases this keeps us from completing the same work that they have complained to the Revdex.com is not complete.  We have been waiting for their signature approval of the perimeter drain change order for over 2 months and have halted work in that area until it is signed.  Additional the electrical design is awaiting their approval which is delaying [redacted] from completing its work.    The only outstanding item for us to respond to is the change order for the perimeter drain. We have made every payment request on time and well within the agreed timeline. Our finical intuition can confirm all payments made and attests all were paid within the agreed timeline if not sooner. The perimeter change order is not delaying any other site work to be performed except for the backfill on the house. We were advised that they only have one excavator and it is not always available. We can understand that, however when the excavator was on site, why was the driveway not graded. There are still piles of dirt around the base of some of our trees, which is probably damaging the trees. The electrical design is as we now understand our responsibility, so this would in no way prevent RMHB/CMH to move forward with all the other outstanding items that have not been completed.  We would like to work with the Revdex.com to resolve this complaint in a timely manner. Attached are the contracts, change orders, and other supporting documents. If it would be helpful we would be willing to meet with the Revdex.com as well as the complainants in order to prove that we have acted with integrity, ethics and with the best intentions for our clients.   We are requesting our contract be terminated with RMHB/CMH and all remaining projects be turned over to our finishing contractor, and, reimbursed for all projects that have been paid for but have not been completed to date 8/28/2016. Driveway/walkways: $4,000Construction site clearing:$500Excavation: 6,000 - this is half of what has not been completed. Amount paid 12,000
