Initial Business Response /[redacted]/
we did a large project for [redacted] and David the job was done to perfection,,, as for as time yes weather was a big factor and David and [redacted] are fully aware of that aboout the drain pipe that needs to be buried yes I did offer [redacted] a refund of...

75.00 so she could have some one close to do it the drain pipe is about 8 ft long to be buried under the path it will take about 20 min too do and to be completely honest I got extremely busy and for got to send one of my guys out,,, I take 100 percent of the responsibilty [redacted] and David loved the hard work and professional concrete and landscape job we did but at the end of the day I drop the ball on a berry the drain I will send one of my crew members to berry the drain with in the next 10 days it should take about 20 min to do
Initial Consumer Rebuttal /[redacted]/
(The consumer indicated he/she ACCEPTED the response from the business.)
I appreciate [redacted] taking responsibility for the length of time that it took to get this drain completed. [redacted] responded quickly to my complaint he sent a crew yesterday and they completed getting the drain buried. I am glad to have this completed.

I've never spoke with mrs. [redacted] not one time after the job was complete last year not one time! I've always talked to her husband Officer [redacted] through text and phone. I've never been hostile or threatening,,,,please give me a break..... thats...

just defamation of character..... We were in fact scheduled for Sat. 8/29/15 but an issue occurred with one of my work trucks so I could not make it there sat it was out of anyone's hands. I spoke with her husband the same day and we arrived Monday and the issue has been completely resolved.

Initial Consumer Rebuttal /* (3000, 9, 2015/09/10) */
(The consumer indicated he/she DID NOT accept the response from the business.)
It is blatantly obvious the character and intelligence level of this man by his response and his lack of grammar/vocabulary skills, so I shall not my hold my breath for an apology nor courteous outcome. He must have a hard time remembering all of his clients that he has spoken rudely to. I have spoken with [redacted] (unfortunately) but have recently only heard him speak rudely with my husband (I monitored the calls but let my husband actually do the talking). Every time my husband has spoken to [redacted], he has had it on speakerphone and recorded it so I may hear what [redacted] had to say. Finally, one of [redacted]'s employees came out to "fix" the water feature. After letting the concrete set (as we were instructed to do so), we turned on the water again just to find it is having the same issue of lack of water pressure to one side of the waterfall. Instead of even attempting to get this company back out to fix it (for the 3rd time), my husband is attempting to fix it himself. There is no way that this company can stay afloat with their consistent lack of inconsistency. Good luck to any consumer that dare hire them. There is nothing more this company can do for us, as they would never show anyway, therefore, my only hope is to have this compliant been seen by perspective future clients and save them the hassle.
Final Business Response /* (1000, 14, 2015/09/17) */
This project was completed last year. there was an issue with the pump for the waterfall that we fixed. The issue has been resolved!
Final Consumer Response /* (3000, 16, 2015/09/18) */
(The consumer indicated he/she DID NOT accept the response from the business.)
In response to the owner's comment from this morning (I reply immediately vs. after several days, such as how his company works), we do not except his "response". After waiting again for several days, we ended up fixing the water feature ourselves. We do not wish to deal with this company any further. This complaint can be closed with the caveat that the customer in fact ended up having to fix the issue on their own accord.

2015. Again I request that Mr. [redacted] tear out the patio that he built on Wednesday September 27, 2015 and replace it with an identical patio that meats the requirements specified in Section R401.3 of the International Building Code Council adopted by the City and County of Denver which states "Impervious surfaces within 10 feet (3048mm) of the building shall be sloped a minimum of 2% percent away from the building." Because the patio Mr. [redacted] built is approximately 14 feet away from the building that means it should have a slope of 2% or at least three inches from the high point to the low point in order to meet the code requirements. The patio that Mr. [redacted] built carries a drop of less than one inch or slope of less than 1%. If Mr.[redacted] is not willing to correct his mistake immediately and replace the current patio with a patio that carries a 2% slope or three inch drop in order to meet R401.3 code requirements then I request that he specifically state that. If Mr. [redacted] is states that in this case he is completely unwilling to abide by the standards specifically stated in section R401.3 of the International Code Council: Adopted by the City and County and Denver and therefore will NOT replace our patio with a patio that carries a 2% slope and three inch drop as defined by the code, I will consider the matter resolved as far at the Revdex.com is concerned and will proceed to resolve this situation through alternative means.

accept the response from the business.)
[redacted] and [redacted], both agreed verbally and via text message to do the job for $800.00. As text messages are a legally recognized contract and it is the same as an oral agreement if you can show valid proof of your text history. To which I can!! On 09/08/2015, I have an agreed upon price for tear out of $800.00. "I just talked to him (the owner [redacted]) he said he can do it for $800.00 he said he can match $600, that's about what it will cost him to have it installed and materials. To which we responded Ok [redacted] says OK it's a go. Thanks. [redacted] then texted back Ok great I'll let them know. On 09/24/2015 I texted [redacted] and asked, Any word when we are getting our front porch redone. We were told 10days and it is almost 2wks now. [redacted] responds , No let me find out I won't know tell tomorrow I'll call you back.10/02/2015, I received another text from [redacted] stating, [redacted] I'm bringing my concrete guy there today to look at the job. So basically were just knocking that concrete out and reporting it the way it was just new right?
I then called [redacted] after the issues with the sub contractor they used.
A contract is an agreement. The agreement can be reached orally, by email, text message, or any other means (some contracts do have to be in writing to be enforceable, but a text message can be a sufficient writing). Most contracts do not require witnesses, notaries, or other formalities to be binding. However, if you did not intend to be bound until you had signed a document, you did not form a contract. In other words, if you sent a text saying "I agree to pay you $50 for your car", you would be bound by this contract".

Therefore [redacted]'s company has a legally binding and enforceable contract to do the work as spelled out in numerous court cases.
Final Business Response /* (4000, 10, 2015/10/27) */

Initial Business Response /[redacted]/
Ms.[redacted] called me and asked me if she had a warranty on any of the trees and shrubs I told her know I do not warranty any soft scape ,,, that made her upset and she told me if I dont,, she will file a complaint with the Revdex.com if you had a...

warranty with me it would be in writing iam not going to replace your tree or shrubs that you neglected unless you have a written warranty from me
Initial Consumer Rebuttal /[redacted]/
(The consumer indicated he/she DID NOT accept the response from the business.)
I have a written warranty and it was sent to them by their request because they didn't have a record of it, go figure. We called them again, emailed them again, and no response to honor the written warranty. I will no longer be in contact with this business, I will take actions & he will again see our written warranty before the courts. As for neglect of the plants 3/4 of installed are alive and well.

Complaint: [redacted]
I am rejecting this response because: I'm sorry, but I don't understand why I'm getting this...

notification.  It is the same response from the Revdex.com and the owner that I received in July.  I responded to that brief response on approximately July 27, 2016 with the following: I'm sorry, but I do not feel that this is an acceptable solution. Far from it. First, as mentioned in my original report, it cost me $500.00 to have the concrete professionally removed from my fence, shed, patio doors and house exterior. I then had to spend approximately $200.00 more for paint, stain and equipment to put back what was removed along with the concrete. Furthermore, the concrete that is now permanently bonded to our asphalt carport cannot be removed. This property belongs to the HOA and I am waiting to hear if we are going to be held responsible for repairing this damage. Second, I did not approve any forms. I wasn't home at the time. My wife was home and as previously mentioned in my original report, when she saw that no form was constructed for the curb, she begged and pleaded to the supervisor to add the decorative curb as specified in the contract. His reply was, “You don't need it.” I came home to find my wife in tears talking on the phone to the owner about the curb. It did no good. The curb was not poured. Judging from my experience to date with the owner he would not have given us a $200.00 credit for the missing curb on the final invoice if he didn't think his company was in error. Third, anyone who thinks, as the owner does, that there's “noting wrong with the concrete” is blind or hasn't seen the YouTube video I produced. The link was in my original report. Here it is again: https://youtu.be/1CU9r1QUAtUThe concrete pad, in my opinion, wouldn't be suitable for a foundation for a barn, much less a patio in a residential area. It should be noted that before I contacted the Revdex.com, I enlisted the help of another concrete contractor just to get their opinion of the mess and the poor quality job. They were embarrassed for the concrete industry as a whole and offered to be in my corner if I needed someone to verify the validity of my complaint. Although it was after-the-fact, I also checked YELP for reviews on this company. Long story short, it was a tremendous comfort to know that others have had the same or worse problems with this company. My wife and I are on Social Security and could really use the $500.00, but we feel accepting this meager amount would absolve the company from their obligation to provide what we paid for. So we respectfully decline the offer.
Sincerely,
[redacted]  P.S. I don't understand is why this business is allowed to included his association with the Revdex.com on his advertising when his Revdex.com status is "Under Review" and has been for a long time.  I would appreciate a final resolution to this even if it is a notice that there is NO resolution.  The outcome of this inquiry will determine what steps I need to take next.  Thank you.

Complaint: [redacted]
I am rejecting this response because:  I will not agree to have the cracks simply "sealed."  They will be repaired (ground out and filled).  I have received a quote of $2750 to $3000 ($20 per linear foot) to repair the cracks which extend the length and width of the patio.  The patio is now pulling away from the foundation of the house.  The repair work has been "scheduled" multiple times and no workers ever show.
Sincerely,
[redacted]
