I did give [redacted] a estimate and then a contract to review. A start date was then tentatively schedule (permits, weather dependent).  The first of the delays were brought on by other job delays in relation to weather. At this point we where pushed back in the winter months where it has...

been to cold to do any of the work. I also ran into some issues with one of my subcontractors who had also priced the job which messed up my scheduling once that was brought to my knowledge. At this point with the extremely cold temperatures this winter and my framing subcontractor issue, I thought it was best to withdrawal my bid.  I should have contacted the [redacted], there is no excuse for that. I apologize to them for the delay and not contacting them.  I will dis regard the contract, and release the permit and send it to [redacted]. The permit will be forfeited to the them at no cost.

Review: July 2013 we contacted Colt Simmons Construction and asked for an estimate on an addition to our home. He came to our home and met with us in July, and provided us with an estimate. We agreed to his price. He then emailed us the binding contract for the project. We signed the contract and emailed it back to him on 8/8/13. Colt emailed us on 8/27 that he had obtained the building permits for the project and would be starting in September. Then the contract start date of 9/9/13 arrived, but Colt did not show up nor contact us about his missed start date. A week later WE contacted him, and he had an excuse that he was behind on a project and would start on our project by late October. We allowed that delay and requested he let us know if he would not meet his delayed start date. He did contact us on 11/1 but again asked for a 2-3 week delay. We patiently waited again, as he NEVER insinuated he did not intend to fulfill his obligations to the contract. The three weeks went by, and Colt did not show up to start on the project. [redacted] again emailed him to ask of the start date, addressed our concerns of his staying on schedule, and to again request a copy of the signed contract. Colt replied to that email on 11/5 stating I will get that emailed to you. Once again sorry for the delay. That was the last communication we received from Colt Simmons. We never received the emailed copy of the contract he promised and he never showed up to start on the project. We have attempted to contact him numerous times but he has ignored all emails, phone calls, and texts from us. On 12/31 we mailed him a certified letter to his businesss address asking him to contact us concerning his default on the contract. But after 3 attempts to deliver the certified letter... he never accepted to receive that letter and the unopened letter was returned to us. This type of deceptive behavior from a builder is not acceptable. He should never have offered us a contract with his business if he had no intentions of ever fulfilling his obligations to that contract. His actions kept us from hiring another builder and completing the project on time. We are now four months after his missed start date and no construction has been started, he has not attempted to legally dissolve the contract and has not responded to our attempts to get answers to this unbusinesslike behavior.Desired Settlement: As he has ignored all contact from us.. we request an full explanation from Colt, for why a reputable builder would bid for a contract, get the contract ...make numerous delays, then start ignoring the other party to the contract... in hopes they just give up and move on without reporting this unethical business practice. If he has a legitimate reason then he should provide us immediately with this reason and then we will make a decision on the next steps pertaining to the contract.
