[redacted] was shown a unit several months prior to his arrivalIt was stated that the unit available for his time frame would be the unit directly below the one he originally sawHe was told that the unit he was going to get would be totally redone and in the same condition (if not better) then the one he looked atHe went ahead and submitted his holding fee to reserve the unit coming available for his desired move dateOur application specifically states "After the holding fee is paid, should the applicant decide not to rent the premises, the holding fee will be forfeited to the property owner." This is due to the fact that we do not market or show the unit to anyone once a holding fee is submittedThe unit is held solely for the approved applicant who submitted the holding feeUpon [redacted] 's arrival it was simply expressed that the unit was not "clean" and that he wanted his holding fee backThe owner of the property was there before and during his arrival and confirmed the unit was in a perfectly acceptable move in conditionFor some reason [redacted] still felt it was not clean enough to his standards so to help resolve his concerns the owner offered to have it cleaned againThat was not accepted and he stated he just wanted his holding fee backSince the holding fee is not refundable, the owner tried to resolve the situation that would work for the both of themHe offered to have him move into the unit he originally toured due to it still being vacant and that too was not acceptedThe owner then offered again to have it cleaned and was even wiling to deduct a few days of rentThat also was not accepted [redacted] was given several options to not have to lose his holding fee but he was not interested in any of the options that were offered, even though the original unit he was to move in to was perfectly fineThere was nothing else that could have been offered so the end result was [redacted] 's forfeiture of his holding feeWe do our best to try to make our tenants happy with what they are moving intoEven though we felt the unit was fine and move in ready we still offered to go above and beyond to make a compromise with this situation Unfortunately, the tenant ultimately did not want to move into the unit and expected his holding fee to be returned which is not refundable if the tenant decides not to take possession of the property

it was not simply a matter of the apartment being cleaned; it was a matter of it not being ready or fit for someone to move into on the agreed upon dateAllow me to state the reasons:Despite advanced notice of my modate (paid the deposit on January 12th), the apartment was not ready for someone to move into on February 2st, the agreed-upon date.The light switches had no covers were in a terrible state that begged whether their corroded condition was a fire hazard.Unfinished kitchen counterWas promised it would be ready by the modate.Floors were unclean and muddy."New" fridge and stove smelled bad and were not clean (they were not new)Bathtub was extremely dirty.Vanity was sitting inside the bathtub.Giant hole in the bathroom above the sink where the vanity should go; the entire bathroom was a construction siteUnfinished grouting in the tiles above the tubToilet contained fecal matter and was unsanitaryWhile my family and I waited for the landlord to arrive for hours, we were forced to use a restroom in a nearby pizza shop.Counter offers were unacceptableThough you offered the nicer apartment on the second level to me instead, I only agreed on the unit below because of its ground floor level (something I wanted) and was assured of its equal quality to the one aboveI’m a responsible tenant who values a respectable place of residence and a landlord who upholds his duties to his tenants to provide an acceptable place to liveI wouldn't have agreed to one in such shamblesAnd even with a couple day's worth of rent taken off, what kind of message from landlord to tenant is that sending? A completely soured relationship would have ensued as it was shown out the gate that irresponsibility was at play--who would want to rent from such a first impression?Childish denial of the state of the apartmentPlayed completely ignorant of its condition despite the fact that no self-respecting person would have moved into such a unit.The above would have taken days to resolveI was not able to move in on the promised day at the moment I arrivedI needed a place THAT moment; not 5-hours later when the help I acquired for mowould not be available

I'm the Broker Owner of Columbus Realty Source LLC I wanted to respond to complaint I looked into the issue and talked to *** (my past assistant who handled this tenant) about this I'm not sure we could have done anything differently to have elevated the issue*** said
she made the owner aware of tenants credit issues but to my understanding she wanted it rented and agreed to having this tenant I would like to verify this with the owner We had no issues till the end of the lease when he stopped paying We posted the day notice and had our attorney we use (*** ***) evict the tenant after we did not receive rent From the deposit we collected we took out the attorney fee (with no mark up) and sent the rest of the deposit back to the owner I would be happy to talk to owner if she wants to call me directly

We were almost positive that the upstairs unit would be rented prior to your move in date so we couldn't hold that specific unit for you in case it was rented by the time you arrived. It just so happened that on your arrival date it was still available which is why we offered that option for you since you were going back and forth on what floor you preferred“ When I toured the upstairs apartment, I did consider it but I would have had to rent it out a month earlier than I planned to move, so that really wasn’t an option unless I rented it out earlyThe was the only decision I was makingRegardless, it doesn’t matter whether or not I verbalized my decision-making thought process out loudWhat matters is that I opted for the bottom unitPeriod“The move in date went back and forth as wellThere was a big snow storm coming, along with scheduling your moving help, so you arranged to arrive early We tried to accommodate as best as we could! Relocating from out of state can be hectic so we understand things happen.” The planned modate was established as the 21stThe day I arrived at the unit was the 21stThe only accommodations you did (which I appreciated) was placing the key for me to arrive on the 20thI did not arrive on the 20th because of the storm, but I triedI arrived on the 21st, the originally planned modateIn fact, I had to correct you guys once as you once thought I was moving in on the 20th all the way up to February 17th, when I corrected you and clarified that it was the 21stWith this assumption, you should have been prepping it for moon the 20th the entire timeIt wasn’t even ready for moon the 21stI have attached proof of this“When you did arrive they were finishing up some last minute punch out items such as the mirror in the bathroom and light switch plate covers and other minor details but that certainly did not inhibit you from moving into the unit or delaying any movers you had available.” When I arrived, there was nobody there doing anything at all. I called *** and waited for an hour and a half with my family for him to show upI called again at that point and he still hadn’t even left the office, even though he claimed he’d be there in 30-minutesI was not able to move my stuff inside onto an uncleaned floor, etc(I think I’ve made my point here crystal clear) for my belongings to be subjected to unfinished construction and cleaning“I am not sure what else we could have done to help resolve your concerns at the timeWe do value our tenants concerns and want to be sure they are happy with where they are living. The owner even suggested moving your items into the unit that day and he would pay for a hotel to stay in since you felt it wasn't clean enough or habitable for you to stay that night. We exhausted all of the options we could to where you wouldn't lose your holding fee, but you chose to not move in insteadIt was clearly expressed that the holding fee would not be returned should you decide to not take the unit, even with numerous options to work with you on your concerns were given to avoid thatWe do apologize things did not work out.” I take all the counter offers as an acknowledgement of the terrible condition of the apartment I wanted to move into on the agreed-upon dateI couldn’t move into the one I wantedPeriodYou will argue with me about it being moready or not until you turn blue, but the point remains that anyone outside of someone who has a vested interest in defending your stance would agree that it wasn’t readyIt’s as simple as that
