also a part time employee for our golf course maintenance departmentMr*** lived in our community for years and worked for the club for yearsDuring that time Mr*** seemed to enjoy living in and being part of our community and we enjoyed having him.Mr***' complaints however are 100% unfounded and untrueAt the time Mr*** and his family decided to move and resign from the club, he informed us that there were health issues in his family and requested both in person and via email and letter (attached) that we disregard our agreement with him and give him his refund back immediatelyWhile we sympathize with any hardship Mr*** may be facing, to disregard our agreement and provide him with an instant refund and breaking our agreement of how refunds will be handled with over of our other existing and former members with identical agreements would not only be foolish from a legal standpoint, it would be dishonorable to his former fellow club members and friends.Mr***' application for membership states that he was an attorney for years prior to retiring and joining our clubThe reason Mr*** has resorted to an attempt to smear Comanche Trace's name with a baseless complaint is because he knows that he has absolutely no legal ground to stand on and is absolutely in the wrongIt is unprofessional as a former attorney to make these baseless claims and hurtful that he would make them against our company and his fellow coworkersMoreover, what attorney would base their decision on something someone says (which we wholeheartedly dispute was ever said in the first place) rather than what was written in a contract they were signing? He states multiple times in his complaint that he did his due diligence before joining the club, however it is more likely that he did not review his membership agreement until he decided to resign and was unhappy with the language he had agreed to which is why he requested that we break our agreement so he could get his refund without having to wait.The *** Family Foundation has made a number of large donations over the years to various charitable causes in *** and *** L*** III is affiliated with both the *** Family Foundation and Comanche Trace, however the *** Family Foundation and all of the other entities that Mr*** mentioned have no control over Comanche Trace's operations and have nothing to do with his refund nor his membership agreement with Comanche TraceMr*** is also aware of this as he has spoken to *** *** who informed him of all of these facts. In the end, Mr***' refund will be given to him just as it will be to every resigned refundable member on the waiting list, which is based on new membership sales as is outlined in his agreement that he signed stating that he had read and understood and is not relying on any oral representations (attached and applicable sections highlighted)As the controller for this company it is my responsibility to make sure that there are checks and balances in place to make sure everyone is treated fairly and equitably and as is spelled out in their membership agreementAgain, we sympathize with Mr***' situation but this is how we have operated our club since day one and is how we will operate into the future.Sincerely,*** ***, CPAController
