Comenity Capital Bank issues the Overstock Store credit card account. We are here toanswer your questions and assist with your concerns.Your complaint states that you paid your account in full and was then charged a late fee.Furthermore, you state that you were not aware that you still had a balance owing because youdid you receive any notification or billing statements. You are requesting to have the late feescredited to your account and for a refund check to be sent to you for the payment you madetowards the late fees. In addition, you are requesting that the Bank update your credit bureau toshow that your account was not delinquent. We understand your concerns, and apologize for anyfrustration or inconvenience this may have caused you.Bank records indicate that you are enrolled in paperless statements and notifications are sent to[redacted], which is the email address you provided on July 10, 2015.Please be advised that on January 9, 2017, a statement was issued to you showing a balance of$23.89 with a payment of $23.89 due by February 4, 2017. Bank records further indicate that onFebruary 6, 2017, you accessed the account center website and made a payment of $23.89.However, as a result of the payment being made after the due date, a late fee was assessed toyour account.Please be advised that notification continued to be sent to you at the email address you providedshowing that your account still had a balance owing. However, no payments were received forthe months of March 2017 and April 2017. Therefore, late fees were assessed to your accountand your account became two billing periods past due. When an account becomes two billingperiods past due, it is reported to the national credit-reporting agencies as being 30 daysdelinquent.Bank records further indicate that your account has already received a courtesy late fee creditand is not eligible for an additional late fee credit. Comenity Capital Bank has not found any errorson your account, and we are unwilling to waive any additional fees, as they are valid.Please be advised that we are only willing to remove or change information that our companyincorrectly furnished to the credit-reporting agencies. appreciate the opportunity to assist you.In your complaint, you state that you opened your account in December 2014 and made a purchase that wasplaced on an interest free plan for one year. You further state that you were advised that your payments couldbe set up to be automatically debited from your bank account; however, your account was charged a late fee,as the Bank does not have the option for automatic payments. You are requesting that the finance charge becredited to your account. We understand your concerns and apologize for any inconvenience or frustration thismatter may have caused you.Please be advised that the Bank does not offer an option to schedule automatic payments to be debited fromyour bank account; however, you are able to login online at our account center website and schedule apayment up to 30 days in advance.Our records indicate that on November 16, 2014, a purchase of $2,299.00 posted to your account and wasplaced on a 12-month deferred interest payment required plan that was sent to expire on November 17, 2015.For purchases on this plan, the customer is required to make payments on the promotional plan balance basedon the standard repayment terms for their account. Interest is accrued (calculated, but not added to thebalance), and if the balance is not paid in full by the plan end date, the accrued finance charges, which werecalculated from the date of the original purchase, will be added to the deferred balance, and this balance will bemoved to the customer’s revolving balance. This information appeared on your monthly billing statements,under the heading, “Details of your plans”. I have enclosed your billing statements for your review.Upon further review, our records indicate that a statement was issued to you on October 25, 2015, indicating abalance of $380.00 and a minimum payment of $25.00 due by November 20, 2015. Under the “Details of yourPlans” section of that statement, it stated that the balance of $380.00 needed to be paid by November 17,2015, to avoid the accrued interest. As a result of the promotional balance not being paid in full by the planexpiration date, the accrued interest of $406.43 was assessed to your account on November 17, 2015.Comenity Capital Bank has not found any errors with the account; however, in the interest of customer service,a total credit of $206.43 in finance charges was issued to your account on December 8, 2015. Please beadvised that the Bank is unwilling to issue any additional credit.We hope that this information is helpful. I apologize for any inconvenience or frustrationthis matter may have caused you.Blair VIP Plus is an optional service that is offered through Blair. This program offers a specialintroductory price of $1.99 for the first 30 days, and if the customer does not call to cancel themembership within the first 30 days, the membership fee of $14.97 is automatically billed to the Blairaccount each month. Cancellation may be made at any time with no further obligation.Please be assured, the Blair VIP Plus membership was cancelled, and on November 27, 2016, a creditof $14.97 posted to the account to remove the Blair VIP Plus membership fee. An additional credit of$1.99 posted to the account on November 27, 2016, to remove the Blair VIP Plus introductory charge.In the interest of customer service, the Bank issued credits to remove the previously assessed latefees and finance charges. These adjustments created a credit balance of $1.99 on your account. Arefund check has been requested, and should be received in the next 10-14 business days, underseparate cover.Notification was sent to the national credit-reporting agencies, regarding the Blair account, withinstructions to remove the negative payment information from your credit bureau report. The Bank is charging $ 1,150.58 over a payment of $6,505.00, which clearly falls into the definition of usury, even if taking into account that I was gullible into believing that they had started a new cycle of 12 months after I telephoned them to complain that they had failed to send me any notifications. The records show  that after I telephoned them asking for information about my payments, they sent me a notification stating that "payment must reach us by 5pm CT on 11/27/2015. I assumed that the 12 months would run from 11/27/2015 and made all my payments on the 27th of every month from then on. The information about needing to pay in full until 08/05/2016 was buried in fine print on the second page of their notice. I was misled and I accept  that I have to pay some interest, but $ 1,150.58 is clear usury. I am hoping to find some common ground that could at least give me some credit when I next need to change my hearing aids.

Revdex.com, that you returnedmerchandise and paid the shipping and handling. You state it took the company over a month before the creditwas applied to the account. A statement arrived after you returned the merchandise with a late fee applied to theaccount. At that time you contacted the Bank and were advised that the late fee would be reduced to $10.98,and you paid that amount. Due to the payment being three days late, another late fee was assessed to theaccount. You do not think that the additional fees are justified nor should you pay them.Please note Comenity Capital Bank and Blair are two separate entities. The Bank issues and is responsible foraddressing questions related to your credit card account. Blair is responsible for handling matters related to sales,merchandise processing, returns and shipping.In regard to the additional late fees applied to the account, as you stated in the correspondence; the paymentwas received three days late. The Bank issues and isresponsible for addressing questions related to your credit card account. HSN is responsible forhandling matters related to sales, merchandise processing, returns and shipping.Please be advised that use of the account, or failure to close the account within 30 days ofreceiving the Credit Card Agreement indicated your acceptance of the terms of the agreement.At least some of your purchases were made using HSN’s optional FlexPay program. FlexPay isa convenient way to shop that allows you to easily divide your purchase into monthly installmentpayments with your credit card. The payments can be made using your HSN credit card or someother form of payment. You arranged to have your monthly payments charged to your HSN creditcard. again the business keeps redirecting and not confirming what was previously explained by them. My purchases should have been paid first with my large payment as long as the had a balance coming due. Their own terms and agreements say that payments will be applied to promotional purchases first if they are within the repayment period. The payment I made was within 60 days of 1 year of the purchase dates, clearly within their terms. I have paid much more than I was ever responsible and this company continues to have shady business practices. I will be turning this over to an attorney for breech of contract per PayPal ToA. I am done trying to reason and afford them the opportunity to make the situation right. They can't change their own rules when it benefits them. I decline this and will be having our attorney complete all further communications.

At no time before the account became overdue did the company notify my that "my bill was ready" in any manner.  The term "bill me later"  suggests that a bill will be sent to me.  No bill was sent to me until after the account was overdue.  After the account was overdue,...

the phone calls made to me on caller ID was "toll free" not Pay Pal; nor did they leave a message on my answering machine.When I became aware of the amount that was due, I paid the bill of the amount that I originally owed.  As far as I'm concerned, this was the amount due.  It looks like Pay Pal Credit is running a scam to get more money, which I do not feel obligated to pay.  No wonder so many companies are dropping their services.

My business name is [redacted] and my name is [redacted].  I filed the complain by my business name because the BJ's bill that you mailed to me and my account on your website have only my business name not my legal name.  It doesn't matter the complain is business name or my name but the true is your business still owe me $23.28.  You just see the attaches that I attach to you on this message.  It includes  the last  BJ's statement from Comenity Capital Bank, the old statement from [redacted]  bank, the credit line, the old BJ's Visa business card, the letter from you to notify me of acquire and own my account from [redacted] Banks .  If you say you can not refund for me by business name but how come  you could receive my last payment by my business name.  Please, mail a refund reward check to my address [redacted].  Nobody can cash this reward check but only me because this my mailbox.

No payments were received by PayPal Credit for theNovember 2016 billing cycle. I will check my report in a few weeks and make sure that they have been removed. If I see that they have not, I will file another complaint.
