I have contacted your new orthodontist (you had only provided his contact information to us as of 10/3/16) I have provided him with necessary documentation for your daughter to continue treatment at his office I wish you luck with her treatment There should be no further reason for you to have any dealings with Comfort Dental Braces North Loveland If you feel it necessary to contact my office and utilize my services/time in the future, then an appropriate fee will apply.-Dr D***

Complaint: [redacted] I am rejecting this response because: Your office was originally supposed to send the records for my daughter to continue care If your office had treated her professionally and if she had received the care you would expect from an Ortho office, we would still be clients I had to seek care elsewhere due to the lack of care We had an understanding that I would go elsewhere, as I could not trust her care in your hands any further due to the constant mistakes and miscommunication So instead of sending the records as promised, you have held them The fee would have been $100.00, not it is $ You have been fired from lack of care, therefore the contract is void I asked repeatedly to have the records sent, your office told me it has been done I called again on Friday, your office told me they emailed the records to her new ortho She is at the appointment as we speak, and there are no records, therefore the new doctor can not continue with the appointment Again, you office is costing me money and time Had I know that your office is just telling me it has been done, but had no intention of doing it, I would have approached the appointment differently I called your office today, and to my surprise the records have not gone anywhere When my husband was in your office on Friday, you receptionist told him he had no rights to her record, no explanation, just that Now I am told the records were not sent anywhere and the cost to email them is $ If I am not a client, and the contract was null and void due to the lack of care, how is this ethical? Your office has been so unprofessional, has told lies, and has lied to another office regarding the records Meanwhile, my daughter can not receive care due to your lack of communication and refusal to send records or be honest to anyone regarding them My daughter's record is mine, it does not belong to you It is protected information, but not protected from the parent when the child is a minor Your office has even refused to let me review it I have gone out of my way to get her care; your lack of care when she was your patient has caused this effect The resolution would be to email the records to her new ortho or email them to me directly, as I am the parent - at no cost There is no contract Regards, [redacted]

In response to your concerns:1) Broken bracesThere are many reasons why a brace can break off including, but not limited to: hard or sticky foods, heavy biting pressures, and saliva touching the tooth during braces placementOn 5/14/16, the lower braces were placedUnfortunately, a single lower
brace broke off and was then fixed the exact same day (by the doctor)Two days later, another brace broke offThe patient was seen by a staff member to ensure her comfort (an orthodontist was not present on that day as we were not scheduled to see patients)Without an orthodontist present, the staff member is unable to fix the braceThe patient was scheduled to fix the brace at her next visit, but did not return for treatment. 2) Referral to oral surgeon for wisdom tooth extractionsOn 4/5/16, a referral was given to the patient for the removal of third molarsA phone call was placed to Dr M***'s office (an oral surgeon that specializes in removal of wisdom teeth) to discuss the caseDr M*** recommended that the extractions happen in a timely mannerIt is most likely that the patient was not taken to the office where we correctly referred her.On 6/29/16, I spoke with the patient's mother on the phone to bring her in as soon as possible to solve these problemsI even offered to discount future treatment. 3) Request for refund: orthodontic records and placement of upper and lower braces has been accomplished at my officeIf a patient wishes to transfer from our office, there is a transfer out fee ($as stated in the signed contract)At this point, the outstanding fees to transfer is $($+ $monthly payment June + $monthly payment July)As an act of good faith, I am willing to waive all transfer fees, but a refund is not warranted nor appropriate in this case as we have made several efforts to resolve your concerns.I wish you the best of luck with your treatment at your new orthodontic office.-Dr D***

I am rejecting this response because: I went to the office yesterday, before I read DrD***'s response On tape, DrD*** stated that not only was my daughter's care 'mishandled", but there have been several incidences of "miscommunication" regarding the front desk and stated he phoned the new doctor; in his response to Revdex.com he stated he sent documentation When I asked him in the office what he had sent, he did verify and said he did not send anything to new doctor While at the office I asked to review my daughter's chart, the receptionist did not comply, nor give me a form to fill out in order to do so DrD*** also advised me that the office now charges $records feeI verified with the state that this cost in unreasonable, and should not be paid I am asking the records be emailed to the new doctor, as I want him to have a full history That is my right I am asking that I be able to review the record, as that is my right as well, with no fee attached I explained that if the care had been there for my daughter, we would still be clients, but because I had to fire the office due to lack of care, I should not be punished and have a $200-$fine to get her records That cost would never have occurred if the care was received I had no choice to go elsewhere for her care, and now the refusal on their part to comply with the law is hindering my daughter's care and health

I am rejecting this response because: ? The records are not correct? I went called the surgeon that was listed on the referral and that is the office I went to? That office did not do that type of surgery? I voiced my concern several times, and not once did I get right back in to fix the problem? I voiced my opinion that I felt it was unsafe to have brackets falling off, as they could be swallowed, DrD***'s response was that they are so little, it should be okay if that were to happen? The brackets began falling off shortly after they were put on, so there is no way it was due to something my daughter ate or drank, as we were in the car driving home? When I spoke with Maria, she informed me this happens often and she has spoken with the doctor about these complaints? Again, the contract has been breached by Comfort Dental given the care my daughter received? The first bracket that fell off was not "fixed" it was just verified that it fell off? The office scheduled the follow up appointment and made it when a doctor was not in the office? Again, wasted time and wasted money? None of this is my fault? I will not pay a penalty due to the care given, or not given? The comfort dental staff gave me the number to call for the surgeon? Again, wasted time and money? That is why I asked to review her record, which I was unable to do unless I paid $to ensure the notes were correct, as according to the statement, they are not? My second opinion will verify the problem with the brackets, and how there has not be a replacement, nor have they been "fixed"? They are missing? Anyone in their right mind would really evaluate everything that has happened and wonder if Comfort Dental is competent to continue to care for their child? Especially when the employee verified that this happens often? No thank you? If you are in the business of braces and the brackets fall off often enough to warrant the employee to speak with the doctor about this happening, there is a problem? That problem is not for the clients to correct or pay ridiculous fees to seek care elsewhere? I paid for functioning braces? The brackets are falling off? I came right back to have the problem fixed, and it was not handled? I should not have to continue to take time off work, lose money while I am gone, to be on time for appointments that get me no where in her care? They should have been fixed completely the same day, as I made the appointment to have functioning braces that day? If she had surgery and the stitches began to come out, would that surgeon have her come back on another day to fix it- and pay additional costs if she went elsewhere? ? If she had a fracture and needed a cast, would the doctor have her come back another day to fix that? ? If she needed vaccines, would the doctor make one appointment to verify it, and have her come back to receive one at a time? ? Sounds ridiculous right? ? This is ridiculous and you can't force me to receive care from a company I don't feel comfortable with, given the care already received? You can't force me to stay with your company because there is a contract? The contract is breached
