April 10, 2017Dear [redacted] ,I appreciate your office bringing this matter to our attentionMifflinburg Bank & Trust (MBTC) is dedicated to providing excellent service and personal banking experiences to every one of our customersBeing a local community bank we are willing and often go beyond "the norm' when it comes to providing and assisting our customer's needs.Having said that, I am grateful for the chance to clarify the issues you have brought to our attentionI have discussed the matter with the parties involved at MBTC and have come to the conclusions outlined below based on several of [redacted] statementsI will be quoting what [redacted] has written (in italic typeface) and then providing an explanation for each item"I made the correction and called to close the account"Our Collector Michael R [redacted] contacted [redacted] by phone May 4, advising him of the over-draft [redacted] was informed he would need to make a deposit to cover the over-draft balance in order to close the account, to which [redacted] agreed to do [redacted] failed to follow through with his commitment [redacted] could not have closed his account over the phone due to the over-draft and negative account balance"I called Mike R [redacted] at MBTC to find out what happened." [redacted] did have a conversation with our Collector Mike R [redacted] was informed during that phone conversation exactly what transpired [redacted] held two (2) checking accounts with MBTC, the first account, from the above paragraph, was closed June 9, after [redacted] failed to follow through with the arrangements he made on May 4, [redacted] second checking account was closed and the overdrawn, negative balance charged-off August 1, In March of 2017, [redacted] accounts were sent to a collection agency along with every other deposit account that had been charged-off by MBTC in 2016.3.? "I stated I did not understand how that was possible..." [redacted] was sent, via internet banking, a monthly statement for both of his checking accountsThose statements ceased to be sent after MBTC closed [redacted] accountsThe final statements sent to [redacted] included an image of the transaction ticket used to close the accountsIt is clearly printed on these images, "Close Acct- C/O NSF.4."The only time Mike R [redacted] contacted me was before I closed the accounts".This statement is incorrect [redacted] never personally closed his accounts, See & above.5."After automatic withdrawals came out, overdrafting my account, they charged me overdraft and many dormant fees." [redacted] account was not closed (see & above) and he must have been aware it was an active accountIf [redacted] "thought” he had closed the account, he should not have authorized automatic withdrawals to be debited from the closed accountIf he intentionally authorized transactions through a closed account we have a bigger issue [redacted] account was assessed overdraft/NSF fees for the returned items presented for payment[redacted] checking account was never assessed any dormant fees"I was never notified about the overdraft, never sent statements"This statement is incorrect [redacted] received a total of fourteen (14) NSF Notices from January 1, through June 9, and six (6) monthly statements in for the first charged-off account [redacted] received nine (9) NSF Notices January 1, through August 3, and eight (8) monthly statements in for the second charged-off accountThe notices were mailed to [redacted] address as directed by him and were not returned to MBTC by the US Postal Service [redacted] also had access to his statements and account information through our internet based electronic banking systemPhysical copies of these statements were recently mailed to [redacted] by our collector Mike R***"They took my $out of my savings account for dormant activity fees."This statement is trueUpon further review, the $was refunded to [redacted] account on April 3, "Mike R [redacted] has still not returned my calls'This statement is incorrectMichael R [redacted] returned a voice mail message to [redacted] onFriday March 31, MrR [redacted] left a message on [redacted] voice mail advising statement copies were being mailed and to call if required or needed"...all I needed was a phone call or statement, I was told the accounts were closed." [redacted] received a phone call [redacted] received numerous statements (at least fifteen combined) [redacted] received numerous NSF notices (at least twenty-three combined)MBTC did not receive any of these mailings back or returned from the US Postal Service [redacted] was most likely "told his accounts were “closed by the collection agency, after they were closed and charged-off by MBTC.Branch Administrator Mandi R [redacted] contacted [redacted] on March 30, to discuss his complaintThe facts listed above remained the same.Quick Summary:? [redacted] never closed his accounts by paying his negative balances [redacted] failed to keep his accounts in a positive status [redacted] received numerous notifications for his NSF activity [redacted] received statements outlining his account activity on a monthly basis [redacted] received copies of his statements.In conclusion, we understand customers run into financial difficultiesWe make every attempt to work with our customers through these situationsIt is our belief, given the statements above, that [redacted] understood his account status and obligation to MBTCIt was unfortunate that [redacted] chose a path, which in the end, lead to the actions legally taken by MBTC and the subsequent events.I thank you for your time and practicality in handling this matter.Sincerely,Jeffrey JKPresident & CEO

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed as Answered] Complaint: [redacted] I am rejecting this response because:Until this day (April 18) I have not been refunded my $as they said they wouldI was told I would receive a check and that has not happenedI never got any statements regarding these accountsThat statement is inaccurate and falseMike R [redacted] never tried to contact me after the phone conversation in April on I did receive copies of statements regarding these accounts after this matter arrived and I asked for themI can tell you this bank is the biggest bunch of liars I have ever worked withFirst Mike R [redacted] tried to say they mail me statements every month, now their story is changing that they were "emailed"Every time I talk to them it is a different storyAlso, they never tried to contact me after the second account was overdrawn in August Why would I have not been given a phone call then?I will more than gladly pay the charges on the accountI am still asking for the debt collector fees and the savings account money backI apologize I used the wrong terminology in the first complaint on the fees I was wanting refundedEvery time I talk to them, their story changesFirst it was "we called you"Then it was "we sent you statements, now it's "we emailed you statements"When I would log into my online banking, no accounts would appear for me to even check the balances of.Their response is inaccurate and false Regards, [redacted]
