There are currently 2 types of a/c condensing units being made by HVAC manufacturers.
One that uses R-22 Freon and one that uses...

R-410a refrigerant.
Since 2010 the only way units that use R-22 units are made is called "dry ship" R-22,
meaning, they are not filled with refrigerant. The R-410a units are manufactured and shipped from the factory filled with R-410a refrigerant.
The reason they still make the units that use R-22 is due to the fact that the 2 types of refrigerant cannot be mixed so if you purchase an R-410 unit you would also need to replace the evaporator coil, which is the indoor component of the air conditioning system.
Many of our customers purchase the dry R-22 units to avoid the expense of having to replace the indoor coil(if it is still working), along with the outside unit.
They do this knowing full well that R-22 Freon will have to be added to the system.
This customer most certainly would not have been told that the unit he purchased contained R-22.
As far as this being a unit we are "trying to get rid of", we sell several of these "dry 22" units on a daily basis, and continue to purchase them from our suppliers and keep them in stock.
Over the past few years we have sold hundreds of these dry 22 units in the greater St. Louis area and continue selling them, as there is an ongoing demand. It seems very odd to me that from these there has been just this (1) complaint filed.
Further, the customer could have returned the unit for a refund if he had not already had it installed.
I find it very unreasonable to think that we should "pay him for buying the freon".
