(ID [redacted] ) On April 29th we signed a contract to start the production of a custome 14.5ft steel hand rail , with hand made maple capIn addition this includes a maple floor base plate ( at 14.5ftx 7" wide, 3/thick) In addition there are ea maple grab rails ( first @ inches and another @ inches)Note: to this date all these items are finished as to request and building code requirements, in storage, awaiting final payment and deliveryAn email was sent to the client on Nov6th stating this information, to which I have not recieved a reply(please see email attachments) From the beginning of our conversation it was disclosed between both parties, that we both had major travel plans and events through out the coming summer, so we agreed that that we would be flexible with each otherOpon recieving the down payment a comment was made by ***," You are not going to cheat us out of our money are you"To which I assured her "No, I will get this done though timeThere maybe some questions or engieering that effect the process, but we will work through them"We agreed to go forward and be in touchThe time frame was subject to to different elementsFirst the design and manufacturing of the steel portion, and the second would be the ordering of the four maple elements of mapleThe cleint originally wanted birch, so I researched through a large number of vendors seeking to find the raw birchThe response took weeks of time due to their exhaustive resourses and networks as they waited for a responseDepending on their information I later was told that no one would be able to get raw birch to startThey also told me they would have trouble locating the maple at these lengthsSo, I then contacted the client and explained the difficulties of not being able to get the birch, and the problem of getting that lenth in mapleThey encouraaged me that maple would work, to which I agreedI then went back to the vendor to special order the maple The date quoted by the client for install is incorrect, they determined that after they determined to lose patience and imposed this on their own accordThe original discussion of both our travel and on going difficulties of engineering of the hand rail system seem to lose value In all conversations I reminded them that I am not the builder of their products, I am just provide the sales and installationThe clients comment, of calling me in June and requesting a refund is falseIn all conversations up to July 10th we were working, building the steel hand rail and struggling with deliveries of parts along with a back order for 16ftlenths of maple to build the four elementsOn the 10th of July I recieved a call from [redacted] (not [redacted] ) while I was on vacationShe was angry and did not want to hear honestly from me, as I tried to explain their order statusShe followed, with comments insisting," Tell me the truth, you need to tell me the truth!", "You can't build this project, can you!", and "I want a refund"To which I explained that the down payment is taken to ensure and cover the cost of production of ordersHer response was," You mean you are not going to refund my money", and I said that we were committed to getting the project completeShe then hung up the phone on meSeveral days later her husband [redacted] called while I was still on vacation, and said that they changed their minds and wanted to continue The next time I contacted, was when both [redacted] and [redacted] drove to my house while I was mowing my yard [redacted] walked up to my side walk and began to yell at me in confrontationWe never scheduled to have a business meeting and they were trespassingMy [redacted] is a mailing address not a public office or show room, and their angry suprise attack was less than unprofessional and unnecessary [redacted] sat in his car while [redacted] continued until she seemed to understand I would be intimadatedthat's when [redacted] then began to yell out his car window," If you would have done this right, this would have never happened" [redacted] again, added once more demanding for me that to refund the down paymentI then reminded her of her present unwelcome and unprofessionalismI tried once again as before when she called me on vacation, to explain that we were getting closer to finish, and down payments cover manufacturing costs, but she refused to hear me and they then both drove offI realized this was cazy, as I looked over at the neighbors staring at meThis was the second demand to end this project which showed me they were willing to aban [redacted] their commitmentInspite of these things I sought remedy, knowing that we are invested and still willing to keep our committment I sent them a email on Aug19th that stated our cost and how we are indebt we were for this project and that we should seek and settle with a peaceful solution [redacted] emailed back on Aug 22, and with no apology justified their actions once again blaming me for their lack of self controlAt this stage I felt that they were ambivalent and didn't care how things were accomplished, so I re-thought the design elements of the hand rail fearing the they back out again if something wasn't just rightI quoted a time of four weeks for them to respond ,or I would try to sell the custom items for something to recoupe cost of investment workThis occured in the peak of the our high season and thought it best to us some spaceDuring this time I researched the code requirements in the International Code book and saw that there was a conflict with the demensions of the maple cap, so I thought it would be wise to console with several building department officals before I sell the itemsAs with everyone, it took some time to hear back even after I went to their officeBut, my findings were correctthe maple cap was to large and it needed to be modifiedNow knowing this I choose the side of the lawWe at Comfortzone find it imperative to adhere to all local code standards for safety, insurance and resale.This had become a sensitive situation and we were concerned inregards to our own liability Presently, they have a very nice maple hand rail with maple baluster system was installed upon completion of their newly built homeSo , for us there seems to be a question of necessity or safety On Sept21, I informed them that their 3ea (14ft., 12.5ft and 4ftmaple caps) would need to be re-done due to the code requirementsThis meant having the maple hand milled againSo once again, we were in a unwanted waiting period for the work to be complete and, at our costNow that the work is done they have not made an attempt to contact me for final closure and offered delivery due to the length and weightInstead, in addition we are under a threat of public accusation and an attempt to mare our imageTo this date, no contracted client has justified the right to persoanlly attack our business as they mis-handle and abused proper professional pathsWe seek to be compensated for the cost incured, and we ask your organization to assist us in redeeming this unnecessary crisis To finish, we have a strong reputation with the community and we will not let one unwilling client tarnish our long standing imageIf necessary we will seek legal action.During this business committment we have never stopped in finishing this projectWe feel that they have requested I received a message from The Revdex.com on November 16, that MrJ*** never responded to The Revdex.com and that the case was now closed.Then on November 18, The Revdex.com sent a message to inform me they heard from MrJ*** and the case was reopenedIn Mr J***'s response included in the November message from Revdex.com, he left open in his offer that he could attempt to charge us further for the project which itself was not completed to our satisfaction.We reject any further charges and consider this contract fully closed without any further payment or action on our part
