Attn: [redacted] RE: [redacted] # [redacted] Dear [redacted] ***: We are writing in response to your letter of September 24, 2014, a copy of which is attached The Fairway was purchased in May of Upon takeover we did not receive information from the prior owners in which would inform us that this apartment did not come with both washer/dryer connectionsAll of the other apartment homes in this building have connections so we had no reason or information to lead us to believe this home did notWe did not intentionally mislead this resident and once we were informed the dryer ventilation was missing we started the process of working to install itHowever because of the extensive nature of this work contractors were hired to come and bid out the work and in addition inspectors were neededUnfortunately it did take some time to complete but the dryer vent was installed as the resident requested We as [redacted] always wish that maintenance in our apartments always work as they are designed however we simply cannot control things from breaking from time to timeWe can however do our best to make the repair once they doAll of the items have been addressed as requested for this resident We are in receipt of this complaint after a resolution was made to the resident's preferenceWe are glad that this issue could be resolved with a satisfactory solution for the resident Very truly yours, [redacted] *** [redacted]

Thank you for notifying us about this complaint [redacted] ***'s originally gave notice to vacate at the end her lease on September 30, She came to the office on September 23, to notify us that she was unable to move at that time and that she thought it might be closer to the end of the year before she was able to moveI explained that she could go month to month and went over the month to month rate and feeShe stated that she was not able to afford the month to month rate so I offered her a short term lease at the current rate I also explained that she would be required to give new day notice to vacated if she planned on leaving at the end of her new lease on December 31, Our records indicate that we sent her a renewal offer November 1, and that we attempted to reach [redacted] ***s by phone She came to the office on December 6, and stated that she was moving at the end of the month (Dec) at which time we advised her of her day notice Her second notice to vacate is dated December 6, I offered to make her notice effective December 1, 2016, which would make her responsible for rent through the end of January I have documentation that can be provided upon [redacted] ***'s authorization The final month to month fee for January rent of $is system generated because [redacted] ***'s lease was up December 31, I will adjust the $off of her balance in a good faith effort in resolving this issueI know moving is a stressful time for everyone and our goal is to provide smooth transitions for residents whether they are moving in or out We have a procedures and policies in place to provide exceptional service to our residents but we are always looking to improve on them We have a sincere desire to resolve this issue with [redacted] ***s and hope that she will find this to be a reasonable resolution Please feel free to contact me should have questions or would like to discuss further Sincerely,

I am rejecting this response because:
I was out of hot water for daysI have phone records that I called maintenance each day serveral timesI did in fact inquired with tenants from other buildings and they were not without hot waterI also asked my neighbors and I discovered the same thingSo it is not a fact that as soon as I called it was fixed within 4hoursI have a small child and I'm 8months pregnantIt was extremely hard to cook, clean, and bath with hot waterOr should I file an EEO complaint because they were full aware of my condition when the water was out

I have checked on your compliant and I found that the community had a boiler that supplies the hot water went out on Saturday October 4th Maintenance and an outside plumber were called to take care of the problem The plumber replaced a pump and the water was restored within hours
The community does not have the ability to turn one resident’s water off, however, when we have an emergency situation we do have to address the issue immediately and sometimes those emergency results in the water to the entire community or several buildings being turned off to make repairs

We are writing in response to your letter of September 29, 2014, a copy of which is attached
The Management has communicated with the residents on several occasions and also wish to resolve the issues
reported by the residents
Due to the unique architecture at Fairway, the first step was to clear the roof valleys to allow for drainage of the arched roofsThis was done immediately on all buildings including the building where the residents reside
We apologize if the communication on the 13th, 15th and 22nd was not as thorough or
prompt as expectedUnfortunately, we were short staffed during that time frame
We did complete a temporary repair around the 17th of September to the exterior shingles and decking in hopes to prevent further damage until a more permanent repair was completed in early OctoberAfter the next rain, the residents were contacted and it was reported that there were no additional leaks
An outside vendor has been contracted to repair the interior issuesWe will do our best to communicate each step of this repair with the resident to bring their apartment home to a satisfactory condition

While renting an apartment through your company, I experienced harassment by neighbors, my neighbours were shot at in the parking lot leaving for work, there was black mold in my bathroom, my packages were stolen from the front porch, and management lies, cheats and steals. I emailed my concerns to management throughout the year, they refused to do anything to help. At the end of my lease, they inflated move out expenses and broke things on their own, then charged me for it. Worst experience I've ever had.

This letter is in response...

to your letter dated July 25, 2014, concerning [redacted]'s apartment [redacted]. On Thursday, July 24. 2014, at approximately I:15p.m. it was reported to the property management office that there was a water leak in apartment [redacted]. The maintenance staff immediately checked all the apartments around the unit where the leak was located. It was discovered during this time that [redacted] was also affected by the leak. The [redacted] called all parties whose apartments were affected. The [redacted] also called a contractor to come out and extract the water. Prior to the contractor arriving the maintenance staff removed items from the wet area as best they could and then the contractor moved them again to extract the water. The entire staff did whatever was possible to minimize damage.
In your letter you allege that [redacted] and [redacted] stated that "corporate would take care of this". This is not true and both employees are willing to provide sworn affidavits to this. In fact, [redacted] was not working the day of the incident and when you called on July 25th [redacted] stated you asked for [redacted] and she told you [redacted] was out of the office and took a message only.
[redacted] was allowed to transfer to another apartment immediately in order to remove him and his belongings from the water-damaged apartment.
[redacted]'s TAA Lease paragraph 8 states: -Our insurance does not cover the loss of or damage to your personal property" and paragraph 24 states: "We're not liable to any resident. guest or occupant for personal injury or damage. loss of personal property, or business or personal income from any cause. including but not limited to fire, smoke, rain, flood, water leaks, hail, ice, snow, lightning, wind, explosions, interruption of utilities, pipe leaks, theft. negligent or intentional acts of residents. occupants or guests. or vandalism unless otherwise required by law.- And the Lease Addendum for Requirement of Renters or Liability Insurance paragraph 2 states: -You understand that our property or liability insurance may not protect you. your guests or any occupants against loss or damage to personal property or belongings.- [redacted] signed both of these agreements and they are attached for your reference. [redacted] chose to only take the Liability Insurance issued through his provider, [redacted]. Had he taken the Personal Property Coverage, all of his items may have been covered by his insurance provider.
 
Therefore, as stated in the Lease and Addendums [redacted] signed and agreed to, we are not liable for his personal property. [redacted] had an opportunity to insure his personal property through his insurance provider and chose not to do so.
