The vehicle in question, VIN ***, silver, Volkswagen Tiguan owned by *** ***, was dropped at this dealership, Hudson Valley Volkswagen, sometime on the evening of March **, after business hours as evidenced by the signed night drop envelopeThis vehicle has no prior
history with the dealershipOn March **, 2017, the vehicle was attempted to be driven into the garage by the technician and would not go into gear. The technician determined that there was no oil left in the transmission causing this. The transmission oil was filled and driven approximately yards from its parking spot into the garage where it was put onto a lift. The technician that was working on the vehicle brought to the Service Managers attention that the transmission pan was leaking severely due to visually confirmable impact damage. The plastic under shield that normally covers the pan was also damaged by said impact. At this time there were no fault codes in the vehicle’s computer*** *** was advised that the pan would need to be replaced and the transmission filled with oil but that there MAY be damage to the transmission due to him driving it with low fluid. At the time of the pan replacement it was noted that there were no visually confirmable damage to the bottom of the valve body (the only part of the actual transmission that is visible with the pan off) and also there appeared to be no damage to the wiring harness to the transmission. Once the pan was replaced and the transmission refilled with oil, the vehicle was test-driven miles. It is noted that the vehicle performed similar to like vehicle and no issues were noted at that time*** *** picked the vehicle up on or about March **, On May ***, *** *** vehicle was towed back to Hudson Valley Volkswagen. It should be noted that the vehicle was towed with a “wheel lift” which leaves two of the vehicles wheels in contact with the ground. This vehicle is an all-wheel drive and as such, should never be towed in this manner as per Volkswagen manufacturer requirements as damage to the AWD systems may occur. Also the vehicle was received with a battery that was too low to start vehicle or check systems. *** *** informed the Service Manager that the vehicle had been brought to another Volkswagen dealer and had been there for three weeks prior to the vehicle being towed to Hudson Valley VolkswagenThe vehicle was jump started and assessed using Volkswagen diagnostic system, which determined a mechanical failure of gear in the transmission. Due to the damage that was found on the transmission pan and subsequent missing transmission fluid from the previous visit, the damage to the transmission is determined to not be a manufacturing defect and therefore will not be covered by Volkswagens warranty. *** *** was advised that he could place a claim with his auto insurance because the vehicle, according to *** ***, was damaged while driving. The estimate to replace the transmission was given to *** *** and he has not given permission to repair the vehicle nor has the vehicle been picked up. Hudson Valley Volkswagen is not responsible for the failure of *** *** transmission nor do we offer financial assistance with the replacement
