Thank you for the opportunity to re-open this complaint. My response to US Window & Door is:You write that you have ‘not forgotten’ me, yet I only hear from you when I inquire if my door has finally been ordered correctly. You write that you want ‘to ensure it is resolved correctly,’ yet refuse to honor our contract, as written, and order my door according to that contract. You write that you ‘are working to get the matter resolved as immediately as possible,’ yet you have spent three months trying to get me to accept your mistake with a big band-aid over features for which I paid extra. I am just asking to get what I ordered, contracted for, and in good faith partially paid for. So, re-submit my order correctly and stop trying to cover up your mistake and expecting me to accept that. Or, return my money so I can go elsewhere. *** ***

Hi ***, I am sorry for the delay and inconvenienceWe are actively working on the issue*** will be sending an official response to you soon to wrap everything up

** ***We are terribly sorry for how things have gone with your installationHowever, please be aware that we have not forgotten you nor do we intend to leave this matter unresolvedThis was an administrative error that was brought up at several meetings to ensure it is resolved correctly
Things are still in process but we are working to get the matter resolved as immediately as possiblePlease contact *** *** for updates as necessary and sorry again for the terrible delay in getting this done right

August 11, 2017[redacted]Re: US Window & DoorOur File No. [redacted]Dear Ms. [redacted],Our office represents US Window & Door. On February 24, 2017, you entered into a Cash Contract with US Window &Door (“USWD") for the purchase and installation of two doors for your home. The contract price was $8,674. (Exhibit A.) You made a down payment of $867. You further agreed to pay $5,907 upon the delivery of the doors to your house, leaving $1,900 due upon completion of the installation of the doors. Standard terms and conditions were set forth on the second page of the Cash Contract, and initialed by you. (Exhibit B.)You purchased one double door with sidelites for the entry opening (“Entry Door”). The total cost of the Entry Door was $7,490. (Exhibit E.) You also purchased a utility door for the garage (“Utility Door”). The cost of the Utility Door was S1, 184. (In your letter, you mistakenly indicated that the Utility Door cost S984.)A description of the doors, the style, colors, and hardware selected by you were set forth in a separate attachment to the Cash Contract. (Exhibit C.) You initialed this separate attachment confirming your selection. (Exhibit C.)On or about April 24, 2017 the doors were delivered, accepted and installed at your home. At that [redacted]e, per your contract, you made a payment of $5709 for the cost of the product. (Unlike your letter states, the payment was for $5709.00 and not $5907.00 as called for in the contract). (Exhibit H.) After the installation, you mentioned the interior of the entry door was to be painted white not brown. Only the exterior of the door was to be finished in a walnut color. (e.g. A “split finish.”) USWD acknowledged this defective workmanship, and reached out to the manufacturer [redacted]. The manufacturer offered to paint the door white. USWD also provided you with the name of a local licensed painting contractor, in business for 30 years, who could finish the interior of the door white. These two options were offered to you at no cost. Please further note that pursuant to the spec sheet for [redacted], a custom door can either be stained or painted. Walnut can be stained, but white must be painted. (Exhibit F.) The two offered options provided you with what you ordered, a painted interior Entry Door. Nevertheless, you rejected these two options to correct any defective workmanship and instead sought a full refund of the door,Pursuant to the manufacturers spec sheet, the list price of a split finish for a double door with sidelights is $4,610.' (Exhibit F.) You were only charged $2160 for the finish. (Exhibit E.) This represents a 48% discount from list price. The list price for the “split finish” is $1,410.00. You were therefore only charged $731.00 for the “split finish.”Under section 12 of the Cash Contract, USWD has the option to replace or refund the money for items not delivered on an order. (Exhibit B.) Furthermore, under California law, the cost of repair is the usual measure of damages for construction work performed in a defective manner." The cost of painting the door should not exceed $731 discounted charge for the split finish. As you have rejected any solution provided by USWD to furnish the “split finish,” USWD is exercising its right to refund you the money paid for the “split finish” in the amount of $731.00.Original contract amount: $8674.00Down payment: (S. 867.00) Payment at delivery: ($5,709.00) Split Finish: ($731.00)Balance Due: S1,367.00Ouad Unit: $3,200 Stain Cost = $1,410 Split Finish = $4,610. (Exhibit F.) $4160 (list price) - $2,160 (price charged) = $2,000 discount, 2,000/4,160 = 48% approximately S1410 x 48% = S679 discount on list price. $1,410 (list price) - S679 (discount) = $731 price for the split finish. See generally, 9 [redacted] (4th Ed.) S33.10, p. 33-46.2 USWD has fulfilled the terms of its agreement by refunding the value of the split finish. According, the $1,367 balance due is payable at this time. Please forward this payment directly to USWD, [redacted]We are attempting to collect a debt. Any information obtained will be used for that purpose.Respectfully,[redacted] AND [redacted]CC: client via email only
