We are in receipt of your email dated December 5, advising us of a complaint filed by our memberWe have been in contact with this member concerning her account since September 4, She currently has a savings and checking account
with us and is a joint owner on five additional accounts,Attached is the history on the member's account detailing her activities which brought her account to a negative balanceThe history also notes the dates the credit union provided the member with courtesy notices of these activities and the requirement to repay the funds advanced through Courtesy PayI have also attached copies of the letters sent to the member,Please note that the email address and street address used to the notices are the same as the member provided as part of this complaint:
In addition, on October we also called the member and left a message regarding her negative balanceSince there wasn't a response from the member, on October funds were transferred from one of the accounts that the member has joint ownership in order to satisfy the outstanding negative balance owed to the credit unionThe member agreed to the use of other accounts to satisfy the obligation owed to the credit union when they became a member of the credit unionThis is stated in the Membership Agreement and Account Disclosures booklet that is required to be given to ever new member upon account openingSection 3C reads as follows:
Joint Account Owner LiabilityIf an item deposited in a joint account is returned unpaid, a joint account is overdrawn, or if we do not receive final payment on a transaction, the owners, jointly and severally, are liable to us for the amount of the returned item, overdraft, or unpaid amount and any charges, regardless of who initiated or benefited from the transactionIf any account owner is indebted to us, we may enforce our rights against any account of the indebted owner, including all funds in the joint account regardless of who contributed the funds in the account.We are in the process of contacting the member to explain her options with regard to continued use of Courtesy Pay.We appreciate the opportunity to address this complaint and thank you for allowing us to clarify the member's situationSincerely,

Review: I am an overdraft protection on my account in the amount of $700.00. In the month of October the credit union side that they send me a letter to let me know my accout is going to me close if I did not paid the amount, watch I did not get the letter. In the month of October they have taking it out of my son account watch I did not know about it until he came home and look at his account online and side to me. Mam CommonWealth One has taking $700.00 out of my account and put it in your acccout. I call CommonWealth One the next day and they side yes they did and now you have to pay him. Will in the month of November CommonWealth One open up the overdraft account again with out asking me. I received a letter in the mail said I owe $28.00 dollar. I then call them and side I did not give permission for this company to try to talk money out of my account. Will in November I started used the overdraft and on the 29th of November I put $700.00 dollar in my checking account. Will on the 1 Dec 14, CommonWealth One FCU has taking money out of my son's account again in the amount of $470.00. Because I did not pay the $47.00 in October. DO NOT OPEN AN ACCOUNT WITH COMMONWEALTH ONE FCU.Desired Settlement: Give my son back his $470.00 and put it back in his checking account.

Since there wasn't a response from the member, on October 17 funds were transferred from one of the accounts that the member has joint ownership in order to satisfy the outstanding negative balance owed to the credit union.The member agreed to the use of other accounts to satisfy the obligation owed to the credit union when they became a member of the credit union. This is stated in the Membership Agreement and Account Disclosures booklet that is required to be given to ever new member upon account opening. Section 3C reads as follows:Joint Account Owner Liability. If an item deposited in a joint account is returned unpaid, a joint account is overdrawn, or if we do not receive final payment on a transaction, the owners, jointly and severally, are liable to us for the amount of the returned item, overdraft, or unpaid amount and any charges, regardless of who initiated or benefited from the transaction. Review: Someone gave me a a bad check from a closed account and it was deposited into my account. The I didn't use all of the money after the bank cleared the check it was fraud charges. Now the bank is trying to charging me the amount of the whole check or pressing charges against me . I think this is unfair treatment and as well as this is banking error as they are the ones who cleared the check .

Someone please call me .Desired Settlement: That I [redacted] only be responsible for paying half of the money and no false charges filed against , because I had no knowledge of the closed account .

Response:

The complainant had a $3,812.45 check payable on [redacted] Bank deposited to her account on 08/27/13 through our Main Branch ATM. Prior to the deposit, the account had less than $2.00. The check was deposited by a friend of the complainant to whom she gave her debit card and PIN. Over the Labor Day holiday weekend, $950 was withdrawn from the account via ATMs and three bills were paid using the debit card for approximately $2,463. The check was returned “closed account” on 09/03/13. The complainant’s account has been closed but has a negative balance of $3,448.98.
