agreeing to the terms and conditions of the contract, and then signing at the bottomAll of the membership information is displayed in the contract that she signedOnce signed, she is also automatically sent a copy of her contract to the email she placed on fileAt the top of her contract, in the largest font on the page are her membership detailsThis is where it states how much she is paying and what membership she is onShe is an AMember to her spouse drafting on cycle Cycle 1 means the 3rd of every monthShe paid $for her enrollment and $for her first month dues totaling $This was paid at the time she joinedIt then shows her monthly dues are $per month, not $The $is prior to tax, because the tax is added when it draftsHer monthly dues are $after tax each monthThe cancellation fee is disclosed in the contract that she signed in Section (6) of her contractI have attached a copy of her contract above so you can see what I am referring toThere is a return fee added to the balance any time a payment declines and returns for any reasonThis fee does not change due to the balance owedThis charge is also discussed in Section (5) of her contractThe annual charge is in the first few sentences of her contract under Terms and Conditions and then Annual June EnhancementThe contract states June Enhancement is $plus tax per year for 42nd location members and is drafted out the first week of every JuneThe June Enhancement has never been $100.00. These two individuals signed up under a 12 Month Membership as a couple. When they joined the enrollment was a 2 for 1 special. This means one person’s startup fees would be waived when they joined together. They joined under this special, and we waived the fees as we stated we would. They emailed...

us after their first draft confused as why the bill was so high. We explained exactly what the contract agreement states. The primary pays $60 per month and the second person pays $40. We showed them the membership contract they signed and where it clearly states this information. We honored the membership discount upon enrolling and the contract they signed. They said there were not aware of the fees upon joining and “were told to just sign here”. This information is inaccurate because each member that comes in is explained our pricing and drafting options. The member MUST choose the membership agreement based upon the price and term they prefer and then we allow them to select the draft date. The member fills out the contract and is automatically emailed a copy. Since these individuals are college students and were on a tight budget we offered them a discounted monthly price under a special that already expired. This dropped the primary’s membership to $45 per month and $25 per month for the link. We not only extended them this special even though it had already ended, but also waived the upgrade fee that was owed with this special. We did not have to do this because we honored our original agreement, but did this to assist these individuals with the budget they were on and to show them we appreciate their business. We have not only upheld our agreement as the contract states, but went over and beyond to tend to their needs. Upon rewriting their membership, they were pleased and thankful. No further assistance was requested.

We have looked over her membership and there is a large difference in our month to month membership and our 3 year contract. She states we told her it was a 2 year membership, which is incorrect and stated in the attachments. Our month to month membership is $75 per month with a...

$130 start-up fee, and our 3 year membership is $45 per month with a $40 start-up fee. Your husband signed for a 3 year membership and you signed for an add-on membership which is a discounted membership for spouses. There was no accident in signing up on the wrong membership because not only is it boldly stated the membership the member is signing for at the top, but your husband signed up twice for a 3 year membership. He originally joined on June 16th, 2014 and then renewed his 3 year membership on December 13th, 2014 when he added you onto his membership. The add-on member completes the same term as the primary but at a discounted rate of $40 per month instead of full rate of $45. The add-on membership discount is also only eligible with contract membership; such as the 1,2 or 3 year agreements. The add-on membership is not eligible with the month to month contract. You signed for a 3 year membership at $45 per month for the primary and $40 per month for the add-on. This is the rate you have been charged each month as you signed and agreed to. As you can see, there is a large different in payment upon joining and monthly billing for a 3 year membership compared to a month to month membership. If at any time you are being billing incorrectly then you should have informed Flex 24. You have not stated at any time you were being billed incorrectly for a 3 year of $45 plus $40 instead of month to month rates of $75 plus $75. The membership prices are stated to our members upon joining and then once the member decides what term they would like to complete,the employee will hand them the IPAD paperwork coinciding with the member's choice. The contract clearly states at the top the membership the member is signing for and again states the membership in the terms and conditions. Upon signing and completing the sign up process, the member must check the boxes and sign agreeing that they have read and understand the terms and conditions for their contract. In the membership terms and agreements it states the process to cancel a 1,2,3 year membership which again reinstates that it is not a month to month membership. For the member’s records, once you sign your contract a copy of your agreements is automatically emailed to the email you and placed on file as a PDF document. Since you have signed a binding contract, we are not able to simply close the account until the contract is completed. Failure to completethe signed contract and make the necessary payments agreed upon will result in your accounts being sent to collections. Regarding your concerns with us contacting you and responding to your requests, I have attached a copy of emails sent between you and [redacted]. The screenshots show she has responded to all attempts when contacted and each time she resent the previous emails that you stated she did not receive. There is also a screen shot of the contracts being emailed to you as requested. [redacted] will be happy to further assist you in closing her account, but she will need to complete the cancellation process as discussed in the terms and agreements of the membership you agreed to.
