Review: I was invited to have my income tax return processed for free due to my hearing imparity. It was offered this year and I was thrilled. I used to use Turbo Tax but would always have issues with computer. So when I found out about this being offered to OVR I jumped on it. However, I have not received my refund. I have contacted several people numerous times and still have not gotten a response. I am getting worried. The woman who set all this up said that she was approached several times since the tax season and was told they have not received their returns either which makes me wonder if my paperwork may not have been processed or submitted?Desired Settlement: I would greatly appreciate my refund. My home is about to foreclose so I need this money to get an apartment for me and my son : (

Thank you for the opportunity to respond to the complaint referenced above, logged by [redacted] on 9/22/13 regarding his tax refund from the IRS and the role of the Volunteer Income Tax Assistance (VITA) program at Community Action Committee Lehigh Valley. I have reviewed the details of the complaint with our VITA coordinator and am able to provide the following facts:

**. [redacted] received assistance from the VITA volunteers at our [redacted] site and his return was rejected by the IRS on 3/19/2013 due to their identification of it being a duplicate return. Per the IRS, **. [redacted] was either claimed by someone else as a dependent on their return, or he had previously filed on his own. It was rejected by the Taxwise system as a “duplicate return, do not efile". **. .[redacted] was informed that he would need to contact the IRS to determine status, as the duplicate filing was rejected.

Neither the volunteers, who participate during the tax season from January-April, nor the VITA Coordinator, are able to resolve individual issues with the IRS. Their role is to assist with preparation and filing of tax returns during tax season. A participant having questions regarding status of their refund, rejected tax returns, or refunds being held by the IRS for back taxes due, child support, defaulted student loans, or other issues are referred to the IRS office in [redacted] or the toll-free number for IRS dispute resolution. In instances where there may be additional legal issues related to the rejected return, participants are referred to [redacted] for further assistance.

I assume the reference to "the woman who set this all up" is either the VITA coordinator or I. He is correct that we often receive inquires in the post-tax season regarding delayed refunds, due to the multiple IRS disputes referenced in this response, We refer such disputes as outlined above.

I was NEVER told I was rejected due to a duplicate request. I NEVER sent my information into the tax. I trusted the company to file it for me. I want to see the actual document that clearly states that I was rejected and why and I need

to speak to the gentleman who "submitted" my request at this place of business.

Okay, now I am FURIOUS!I just went to start a FAFSA claim so I can begin schooling at [redacted] College. I was told that I need to transfer my Tax File that was submitted this year for the year 2012. Guess what?! There was NO claims filed under the name of [redacted] at my home address under my work information nor my age AND my social security number!!!!! WHERE IS MY FILE?! I want to know the name of the CEO of your company and the manager that allegedly filed my claim that received an "error" stating it was a duplicate submission. I want copies sent to my home at my address. [redacted] PA [redacted] stating this! IRS states anyone withholding my file is ILLEGAL!!!! I will get a lawyer involved if I have to!

I want my claims filed and I want my refund!

[redacted] – I have attached the document from the IRS tax filing system, taxwise, which indicates that at the time you requested assistance, the e-filing could not be completed because the IRS had already received a return filed using the TIN (taxpayer id number, which is your Social Security Number) and it was rejected based on that duplication. There is nothing a VITA volunteer could have done to resolve the IRS rejection. You need to resolve it with them directly.

Please provide this info to the IRS as it was their flagging that resulted in their rejection of your return. You can take it to the IRS office this Friday, you can also call them today at their general 800# (###-###-####), or, if you prefer, they also have a TDD line for hearing impaired filers at ###-###-####. They are available to assist you M-F from 7:00-7:00.

If they are unable to resolve their rejection, provide them a copy of your return and file this week. They will accept a late filing. Either they will identify the reason for the duplicate error flag, or they will accept your late filing. Either way, they have the ability to resolve. Please contact them directly, so that they are able to provide you the proof of filing that you need for school.

Thank you, I plan to go to IRS office again this Friday to determine what is going on. The college that I am trying to attend will not allow me

to attend until my Tax is updated and I even have proof that my claim was filed but according to IRS, my claim was never submitted.

The last e-mail I ever received from anyone from the CACLV was a response to the Revdex.com e-mail and she stated that she received an error when

trying to resubmit my claim saying that it was rejected due to being a Duplicate request. BUT when I spoke with IRS they said it was never

submitted and they checked by my name, my work information, my date of birth, my address AND my social Security #. Nothing was found for

the year 2012 claim. I am hearing two different stories and quite frankly it is scaring the ?[redacted]? out of me. I am already in a process of losing my home

because I just don’t make enough money. I am trying to do whats best for me and my son by attending school full time to seek a better career

and now this happened. I am at a lost for words as to where to go at this point. If IRS states that my tax was still never submitted when I show them

this e-mail and the copies given to me by the tax preparer in April provided to me by OVR, I will have no choice but to seek legal advice. I am not giving

up college over this.

Thank you for the opportunity to respond a second time to the complaint referenced above, logged by [redacted] on 9/22/13 regarding his tax refund from the IRS and the role of the Volunteer Income Tax Assistance (VITA) program at Community Action Committee Lehigh Valley (CACLV). I have reviewed the details of his response rejecting the detailed explanation previously provided with our VITA coordinator and am able to provide the attached additional documentation from the TaxWise system used by the volunteers to file the returns.

**. [redacted] claimed in his rejection of the detailed response provided on 10/4/13 that he was never told of the rejection from the system for duplicate use of his Social Security Number, as detailed in the original explanation from CACLV. Attached please find the document provided to **. [redacted] at the time of his attempted filing, which clearly explains that his SSN was previously used to file a return, and therefore a second duplicate return could not be entered.

Taxpayer TIN in the Return Header must not be the same as a TIN of a previously accepted electronic return for the return type and tax period indicated‘in the tax return. Duplicated Submission"

This information came directly from the efiling system provided by the Internal Revenue Service (IRS). The "TIN" is the Taxpayer Identification Number, which is the IRS term for SSN. Once their system rejects an attempted filing, the individual must follow up directly with the IRS to resolve the dispute, again, as outlined in the previous response this is also the information provided to

filers who have a rejection of their return. The information is given to them immediately, and they are informed of both (1) the rejected status of the attempted filing, and (2) instructions on how to proceed directly with the IRS to resolve.

There is no further action that anyone is able to take to either further explain a fairly straightforward action (a rejected tax return for duplicate us ofSSN), or further assist with an individual's dispute with the IRS, if in fact **. [redacted] believes that the IRS is in error. The action he needs to take, which has previously been communicated to him, is to contact the IRS to determine where his SSN was used by another individual to file 2012 tax returns.

I trust this provides the clarification sought on behalf of **. [redacted] regarding his rejected efiling. One further clarification -I am not sure **. [redacted] comprehends that the free volunteer assistance is not run by a for-profit corporation, as he has contacted our volunteer coordinator asking for our CEO, and states in his response that he doesn't know why he needs to speak to the gentleman who assisted his "at his place of business". The volunteer tax preparers donate their time and expertise during the active tax season only, and they provide services free to the public in donated space in church basements, schools, libraries, etc. There is no place of business. It does make me wonder if perhaps **. [redacted] has confused us with another, for-profit tax preparer.
