[redacted] Please See Attached Documents [redacted] October 15, 2015Revdex.com Re: Claim # [redacted] PO Box DuPont, WA 98327To Whom It May Concern:Thank you for providing us with the opportunity to address this owner's concern.This unit has a quarterly assessment that is charged every January 1, April 1, July 1, and October Thirty (30) days prior to the assessment charge, a statement (example enclosed) is sent out to each owner to serve as a courtesy reminder of the upcoming assessment chargeThis Association has a thirty (30) day grace period, and any assessment not paid by the 30,hof the month in which the assessment was charged will receive a $late fee per the Arbor Vineyards Collections Resolution (enclosed, page 2, item #2.)After the late fee is assessed, the owner is mailed a statement reflecting the addition of a late fee as well as a copy of the collection resolutionIf the balance remains unpaid after the next day grace period ends, another statement is mailed to owner advising them of the outstanding balance, requesting that they remit payment immediatelyAs this owner paid the July quarterly assessment on September 2, 2015, the statement mailed on September 4, (received copy from owner enclosed) reflected the late payment, and also included the upcoming October assessmentPlease note that all of this information is provided to each owner after the home has been purchased.In the event that a homeowner feels that they have received a late fee in error, they have the option to contact our office via the phone number or mailing address that is included on every statement that is sent outIf the homeowner chooses, this option, we can then provide a fee waiver form that they can then complete and returnOnce this has been done, we reach out to the Board on their behalf and ask that it be reviewedOnce the Board has made a decision, we then reach out the owner to inform them of this decisionHowever, this owner has not reached out to us, nor provided our company with the opportunity to assist themShould they have any issues in the future, we hope that they will communicate those concerns to us directly.If you have any other questions, please let us know how we can be of assistance.Thank you,Edward H [redacted] President, Community Association Partners, LLC

To Whom It May Concern:Thank you for providing us with another opportunity to address this owner's concern.1) Please be advised that per page eleven (11), item number four (4) of the Arbor Vineyards Covenants,Conditions, & Restrictions,"Any lot owner failing to pay his or her proportionate share of costs assessed by the Association within thirty (30) days after it becomes due shall be liable for interest at the rate of 12% per annum, a reasonable late fee and costs of collection, including attorney fees, of such assessmentsAll such unpaid amounts shall become a lien on the lot or lots to which such amounts are attributable".2) Enclosed is an image of check number which is dated September 1, and was received byNorthwest Bank on September 2, In the memo line of the check, the owner wrote, "7-1-7-StmtDate 8/5"The statement dated 08/05/15, as well as a copy of the Arbor Vineyards AdministrativeResolution Number 1, Assessment and Compliance Payment Policy, were sent to inform the owner thatthey were late and had incurred a late feePer page of that resolution,"NOW, THEREFORE, BE IT RESOLVED THAT pursuant to the authority of the Association as set forth in ORS 94.630(l)(n), there is hereby levied a late fee against any assessment account for any assessment that is not paid in full within thirty (30) days of the date such assessment is due, and such late fee shall be $In addition, if any assessment remains unpaid for sixty (60) days or more, the Association may levy an invoice statement charge of $for each additional month the assessment remains unpaid".3) It is correct that the owner contacted the Revdex.com regarding the late fee assessed to theirHOA accountHowever, as stated in the prior response, the correct course of action for any homeownerthat had a question regarding the HOA, or their account ledger, would be to contact our office, via phone,fax, or physical address in person or via mailPlease note that all three (3) options are listed on everystatement that is sent out to ownersA simple Google search of "Arbor Vineyards" will bring you to theAssociation's website where there are also ways to contact the management companyAt this time, thisowner has still not contacted our office directly. 4) Please be advised that the management company does not have the authority to waive any Association feesIf an owner requests that a fee be waived, they must go through the fee waiver process and request that the Board consider waiving the feePlease note that this process was also described in the previous response and has not been followed by the ownerEnclosed is a late fee waiver form that must be filled out by the homeownerOnce the management company has received the completed form, it will be provided to the Board at the next Association meeting and will be reviewed at that timeOnce the Board has come to a decision, we will then inform the homeowner.If you have any other questions, please let us know how we can be of assistance.Thank you,Edward H***President, Community Association Partners, LLC
