Community Gardens Apartment

Me and my 6 month old daughter moved into the community gardens on 7/7/15. When I moved in there were nails every where on the carpet, I had no shower rod, the heaters had trash in them, and there were dead bugs everywhere. I told the office about the shower rod on 7/8/15 and was told they didn't have one, I told the office on 7/9/15, about everything else and she said she'll put it in the computer. There is also an infestation of roaches.On 8/17/15, the pest control guy was suppose to come spray my house because of roaches. I took everything out of the cupboards and was gone for 8 hours 8-430. When I got home I called the office to see if he came to spray. I was told that he didn't, I then explained that I was gone for 8 hours and everything was emptied out. She said that she just gave him the keys to go inside the apartments. So I told her that I didn't want him to spray because I couldn't leave, had no where to go after he sprayed. On 8/21/15 I received a note on my door basically saying that the pest control guy was coming to spray and if I didn't leave for an hour and my house wasn't prepared for spraying then I was going to be charged $25. I then called the office and asked why I was the only door with the notice and why I am being charged $25. I was told didn't I ask him to spray? I then repeated what I said on 8/17/15. I also said that I told by my people that stay here that when they spray it doesn't work, the bugs still come back. She asked if I wanted them to spray I said no she asked my apartment number I told her. On 8/24 15 I came home and seen that the pest control guy came to spray. I told him that I told the office to tell him to don't come, I asked if the office told him to not come he said no.I don't understand why the office to not have him spray and they sent him up my apartment anyway.Desired SettlementI don't want to live here for a full year with my daughter knowing there's roaches every where, climbing up the walls etc. I literally have to walk on egg shells every day and night and constantly spray them to die. I can't even leave dishes out, or any of my daughters food out because of them.I don't even feel comfortable buying furniture or have guests over and can't even have my daughter crawl on floor. I wake up in middle if the night checking for bugs. I can't even sleep anymore. Business Response We have worked diligently to resolve this residents issue with reported pest issues in her home only to be denied access on every attempt. The required solution to the problem is to let a licensed professional pest control company inspect the apartment and treat as needed. This solves the issue every time. The requires the landlord to provide this service free of charge to the resident, something we have repeatedly attempted. The law also requires the cooperation of the resident. Something we have not been able to get.That being said we have tried several other options all along during this process to accommodate the resident and resolve the issue. We have offered transfer to another apartment and letting the resident out of their lease. As of 09/09/10 the resident indicated she would accept our offer to a mutual recession of the lease, but this has not been signed to date. It is our position that we have acted promptly to this complaint and went above and beyond the required course of action to resolve this issue. We will vigorously defend our position on this matter.The residents complaint with you fails to mention all of our attempts to treat her home and other resolutions we offered. We have this all well documented with all the notices from the pest control company that was repeatedly denied access to inspect and treat the apartment as well as our other attempts to resolve this issue.
