CMA is responding to case # XXXXXXX as a representative of the homeowners association, Sherman Meadows Homeowners Association
The Mr*** is an owner of property and home in the homeowners associationThe homeowners association is structured through their Declaration of Covenants, Conditions, and RestrictionsThe Association through its Board of Directors is responsible for exterior maintenance of the homes in the Association
Mr*** as a member of the Association took title to the property under the Deed Restrictions of Sherman Meadows Homeowners AssociationHe, and other members, pay a monthly assessment not to CMA, but to their Association for the expenses and duties of the Board as defined in the Declaration
In an email from Mr***, dated November 19, 2015, he reported that the roof was leakingCMA, as representative for the Association, arranged with a contractor to perform the repairs to the roof
On December 9, Mr*** was informed of the Board's policy regarding interior repairs as follows: "The Association does not do interior repair on units; only exterior repairs." This policy was restated in board meeting minutes from April 13, as attached

I am rejecting this response because:
Dear Dispute Resolution Department, I am responding to the response made by CMA community managers pertaining to complaint ID # ***In this response I will be including a copy of the rules that were
given to me upon purchase of my home, a copy of the manufacturers description of my fence, corrections of statements made in the response provided by CMA, as well as more reasons my fence should not be considered unacceptable In the written rules provided by CMA you will see that what is required in section titled " FENCES " is a 48" white vinyl fenceIn the manufacturers description you will see that the fence I purchased is a 4' white vinyl fenceI will not dispute the fact that the drawing doesn't match the fence exactly but the fence does meet the requirements written in the rules and should be allowed without any modificationsIf certain designs are going to be prohibited even though they meet all specs, then those exclusions should be provided in the same written rules I followed when purchasing my fence. Drawings are merely a reference and my own plot plan drawings don't even match what is actually presentHas CMA fined *** homes for that or is that just something that happens? My contractor says most drawings don't match realityafter all they're drawings and not every drawing works in real world applicationsAsk any architect or engineer you want and if they tell you differently they're simply afraid to admit they're not perfect. In the written response by CMA it was claimed that Miss *** made several attempts to reach out but I couldn't disagree moreWhat really happened is that yes' it was brought to my attention that the fence "might" not meet the desires of someone who does not live in this community, did not pay for the lot or the fence and someone who would not take responsibility to maintain this fenceI asked Miss *** at that time how to proceed and I was told to write a letter to the board which I did and sent on October 7 of 2015. A letter that to this day has never been properly responded toThe ONLY written response that I have received was one saying that I am being fined $for my first violation and doubling every days if I don't comply to modify or remove the fence. After that letter was written I waited months to finish installing the gates which were the only part of the fence not installed when the issue first came upTalk about devaluing the neighborhoodIf I waited for a response I still would have a fence with no gateMake sense of that! Nowin every letter that I have received from CMA, none of which mention an issue with my fence until the 2017 fineI have been told to comply within ten days which I haveHow come CMA can make such demands and not play the game by there own rules? If I had been responded to in a timely manner I could have worked with the fence supplier to exchange the fence but years later is just a little longer than what any material supplier will exchangeTherefore meaning the ball was dropped by CMA and I'm a victim of their desires for extra money years too late to do anything rationally about it. On top of that, after receiving the letter from CMA I made an appearance at a neighborhood meeting in which I was informed by one of our elected neighborhood officials that my fence was going to be the topic of conversationWhen I arrived at the meeting, Miss *** was quick to tell me I was at the wrong meetingWhen I spoke to the neighbor trustees I was told to set up a meeting with them, without miss ***Now I have reached out to them and as far as I'm concerned that is now who I am dealing with so for Miss *** to tell me I owe fines when I have complied with EVERYTHING I have been told is just absurd and harassing. If this was such a big deal then why did you not address the problem you created in 2015? Elected board or not at the time it was YOU who decided there was a problem, not the elected officials who live in the neighborhood but a company I give my hard earned money to every single month do a job that they don't successfully complete in the opinion of myself and many of the residents in this neighborhoodAnd speaking of the neighborhood, the people who live in this neighborhood and live in seeing distance of my fence as far as I can tell seem to absolutely LOVE my fence and think that CMA is way over stepping their bounds. I have started a petition and so far haven't had one bad thing said about the fence, only about CMADoesn't that count for something? After all, we're having a vote on speed bumps in the neighborhood so why don't we have a vote on my fence? A vote of the people who live here and care about their community and not about how many fines they can impose to make bonuses fatterThe biggest problem with this neighborhood is CMA, not my fenceI did not purchase a home in North Korea, I purchased a home in the United States of America! I would like to know what kind of building background the people making the rules have because they want to pick on a fence that is not only BEAUTIFUL but installed to the actual specs of fencing manufacturesThe rules say go ahead and install your posts 1'-6"Might be why the fence down the street is falling over, but I guess that's not a problem either as long as it has a top rail right? That depth isn't acceptable by any manufacturer according to the contractors I know and have spoken toAlso, is every fence in the neighborhood that is not exactly 48" getting the same threats of fines because my tape measure shows me that you'll be removing a lot of fences creating even more devaluing of OUR neighborhood Has anyone from CMA ever even been educated on fences? I'm sure they've noticed by now that my yard has multiple slopes of different degreesMy fence is designed to accommodate those slopes and not leave the fence looking crooked and jagged like the artwork of a third graderI absolutely could modify my fence but seriously what part of doing so makes any sense? The neighbors are speaking and I promise they will overwhelmingly approve of this fence so If I haven't made a good enough case by now then spend the neighborhood money and take me to court because I have a child, a job and a life that are enough to juggle already without having to spend my spare time fighting against a company who has horrible business practices and no concern for the community they are being paid by to provide a service forWhat a joke! As far as CMA claiming that they made an error while assessing me with fines I find that to be completely unacceptableIf I owned a business and was telling people they owed me money when in fact they don't, I would be called a scam right? Not having your i's dotted and t's crossed should not be a problem that I have to deal with! I had to go purchase copies of checks to prove what I already knew and what CMA ABSOLUTELY should have knownThe time and effort I'm putting into this is a nuisance and after over two years of trying to do things the right way I am officially fed up and I am taking a stand not only for myself but my neighbors who also feel violated like the girl CMA told she owes $for a tree that was dead before she even moved in and another who I recently found out feels harassed as wellThose are just two of many complaints, You people seriously need to get it together!
