On October 22, 2016 the tenants of [redacted]’ property called about the air conditioner leaking.  Because we are not responsible for repairs which cost more than $75.00, we notified Mrs. [redacted] regarding the problem.  Three days later, on October 25, 2016, [redacted] Mechanical was...

dispatched by Mrs. [redacted] to fix the problem, but the condenser line was clogged and the unit was leaking in the laundry room and into the master bedroom flooring.  Mrs. [redacted] was notified of the leak, but did not want to take any further action at that time.   After the tenants left the property needed substantial cleaning.  The cleaning fee was paid by Trudy Thomason Realty, Inc.  The refrigerator mentioned by Mrs. [redacted] in her complaint was in the garage.  Trudy Thomason Realty, Inc. had already paid someone to move the refrigerator and clean it out, but Mrs. [redacted] took it upon herself to remove the food from it before our maid service went back to finish cleaning the house.  There was NO damage to the refrigerator other than it needed cleaning.   Mrs. [redacted] had previously taken the majority ($1,200) of the $2,000 deposit.  A relative of Mrs. [redacted] brought a check by for $1,200 to reimburse that portion of the deposit because she was not entitled to withhold it.  Ultimately, $425 was deducted from the amount returned to the tenants to reimburse Trudy Thomason Realty, Inc. for cleaning fees, and an additional $50 was withheld to reimburse Mrs. [redacted] for fees associated with cleaning the refrigerator.  $1,525 was returned to the tenants.   An accounting breakdown of the entire term of the lease was provided to Mrs. [redacted].  A copy of the cashed check for $1,200 was provided to her as well because she denied she ever received the check, which cleared our bank on June 26, 2016.  A check in the amount of $240 was paid to Mrs. [redacted] ($180 for rent owed, $50 for cleaning fees, and overpayment of $10) after the deposit had been returned to the tenants.  Because Mrs. [redacted] had not submitted a proper change of address form, the check was sent to the address on file.    Mrs. [redacted] complaint appears to be based on the premise that Trudy Thomason Realty, Inc. promised to reimburse her for repairs necessitated by the leak into the master bedroom.  However, no such promise was made and Trudy Thomason Realty, Inc. was in no way contractually obligated to cover those expenses. Trudy Thomason Realty, Inc. would have helped Mrs. [redacted] find someone to help her to get the flooring fixed, but never made the statement that it would cover expenses associated therewith.  While Mrs. [redacted] states in her complaint that she enclosed proof that Trudy Thomason Realty, Inc. promised to reimburse her for those expenses, no such proof was provided in the complaint forwarded to Trudy Thomason Realty, Inc., likely because none exists.   Those expenses are Mrs. [redacted]’ responsibility, and she was aware of the issue for quite some time.  In support of this response, I have attached an email exchange evidencing that Mrs. [redacted] was indeed undertaking the flooring repairs on her own.  Further, Mrs. [redacted] made her complaint only after Trudy Thomason Realty, Inc. opted not to renew any of its management agreements with Mrs. [redacted] due to ongoing difficulties with dealing with her.  Trudy Thomason Realty, Inc.’s belief is that the complaint was made out of vengeance and spite and is not based on facts.   That said, Trudy Thomason Realty, Inc. would like to resolve this dispute amicably and without intervention from a Court.  If any additional information or documentation is needed to aid in that effort, or if you have any questions or concerns regarding this response, please contact me as soon as possible.
