The gentleman from Liberty Mortgage does not have his facts correct In fact, Liberty Mortgage did this EXACT SAME FHA Streamline Reset for me several years ago It was this reason that I trusted and accepted this offer to perform another refinance and lower the rate once again.- At no point in time was I ever "notified" that my documents were in prep and ready to close I had to call and email MrC*** several times, asking about the status of my file Only when I finally called and emailed several times, did he finally call me back. - When he DID finally call me back, the rate was INCREASED through no fault of my own .25% on the refinance The amount of the subordination fee from *** would take months before I'd even see a net savings I moved forward aways, since I'd paid *** $and wanted to get this done.- I fully disclosed to MrC*** at the start of application processing that my home is a functional duplex, yet for some reason the county does not qualify it as such This was not withheld for any reason at all This unit has been a duplex for years before I bought it, and it was fully disclosed to all lending partys from the very beginning.- The day that I drove to close, I was at my *** side work office and drove from *** *** *** to *** ** to meet the closing processor Only when I was literally paying the tolls coming off the bridge in NY did MrC*** call me and tell me that there was a problem He 100% knew that I was going to have to drive to NY that SAME DAY to close the loan It was specifically setup and organised as such.- At NO POINT IN TIME EVER, have I spoken to Troy W*** I have never heard his voice, received a return telephone call from him, or gotten a single response to any email I have sent him Including the one threatening to go to the Revdex.com if someone did not call me back and explain what was going on with my file.Further to all of this, Liberty Mortgage does not make mention nor acknowledge that after speaking to the woman in the office about my case, it was admitted by her my file was mishandled and reassigned to a second loan processorThat second loan processor, Jeremy K*** reached out twice to get clarity on my file and continue to process it Again- the ball was dropped, no one ever called or emailed me and no one EVER told me my file was declined I am attaching the entire email communication between myself and MrK*** as reference.Overall, this entire file was not handled properly the SECOND TIME that I CHOOSE Liberty Mortgage to refinance my loan They did a great job the first time This time, has been horrible I paid $to *** to have the subordination granted for Liberty to have first position on the new mortgage This was done the FIRST time they SUCCESSFULLY refinanced my original loan with *** *** ***.There was no reason that this file should have gone the way it has, since the already demonstrated a clear ability to close my original refinance several years ago I am asking for $to be paid back to me by Liberty for the cost of the subordination, which was triggered AT THE REQUEST OF LIBERTY MORTGAGE

After reviewing theprocess of [redacted]'s FHA streamline, Liberty took correct action with customer.Process:1/26/15: Application was taken by Matthew C[redacted] NMLS # [redacted]. When credit was pulled itwas discovered Mr. [redacted]...
had a second mortgage. With a FHA streamline loan anyadditional liens against the property must be subordinated or paid in full prior to closing withsourced funds. A subordination was ordered.3/17/15: Subordination received and file went into underwriting for approval.3/18/15: File was received from underwriting with a conditional approval.3/26/15: Conditions gathered and file was sent to underwriting for final approval. At this timeunderwriter approved file for closing and file went to document prep. Mr. [redacted] wasnotified his file is in document prep and Matthew C[redacted] scheduled a time. Mr. [redacted] wasout of country [redacted] for work and needed to come to United States for the closing. Duringthe document preparation, closer discovered the homeowners policy stated the property wasinsured as a landlord policy. Mr. [redacted] was notified on his way back to the United Statesand explained that the upstairs was remodeled with kitchen and other 2-unit amenities. Closerrequested processor to get copies of work permits from the county to insure improvements wereup to county code. County stated there were no permits sanctioned for improvements and theproperty is listed as a single family dwelling. At this time the underwriter declined file due tothe alterations to the property and the county information description as a single family dwelling.From the complaint submitted by Mr. [redacted], he states he had to drive 70 minutes to aclosing but did not state he was not in the United States. Liberty schedules closings at thecustomer's convenience and our closings usually take place at the customer's home or thesettlement company's office.Another inconsistency is why he would not know his file was declined after telling MatthewC[redacted] he improperly updated his home. I did speak with Mr. [redacted] (unsure of actual date)and let him know his file.was declined. I see he would like us to refund $200 but this fee wasnever paid to Liberty Mortgage Company. The fee was paid to [redacted]. Mr. [redacted] paidthis fee to [redacted] prior to informing us that he remodeled his home.
