After stating That the company was picking up final payment, which we have in writing, now the company has come back asking for additional payment. The company is refusing to provide a detail breakdown of why after stating they were picking up final payment they are due more money. In addition the company has used threatening language to my elderly mother.

Insurance paid the client as requested which left a balance owing by the customer. When the final check was picked up, it was explained to the client that that was the final check was from the Insurance company and that she would be responsible for the remaining balance. Our in house Insurance Claims Manager also explained that to her. The daughter has POA of the mother and also signed the contract which is why all communication was between our company and the daughter. The job was completed in May 2020 and after several attempts, (phone calls and emails) to reach out to the daughter to make arrangements to get the balance paid to no avail. Finally on July 8 I got a response from the daughter and she requested all copies of checks, all material invoices, all time sheets and all pay stubs for work done on the mother's house. At that time I informed her that according to our contract, signed by her, that states very clearly that the signer waives the rights to receive from us an updated list of subcontractors and supplies. I explained to her that she is legally obligated to pay the balance and if she refuses to do so, I will be turning it over to collections and start proceedings to place a lien on the house. My intentions were to clear up the outstanding balance owed and I apologized if she thought I was rude, I NEVER had any communication with her mother at all, I never threatened her mother in any way.She requested that the Company sign an unconditional waiver in exchange for a check for the remaining balance, We sent a courier over to her house with the signed and notarized waiver and he picked up the check.

I have been very happy with the work Compassion did for me on an insurance claim, so happy in fact that I personally hired them to do some interior work for me. Although their office is located approximately 50 miles away, I found them to be more competitive than those on my side of the metroplex. Also, their subs can 100% be trusted. I am a single working female and couldn't be home during the day or to let them in - they installed a lockbox with a key and they entered the premises daily without disturbing anything. Arrival times were late morning but it was well worth it, the workmanship is top-notch, and my house has received many compliments from my neighbors as well as from the City's own code compliance inspector. Compassion does everything that a contracting company should do, including a follow-up punch list walk to address anything that may need to be touched up. If you are looking for a company that does it well and does it right, this is the one to call.

Dear Mr [redacted] , We are sorry for any confusion we have caused Your insurance company told us to bill them for the Overhead and Profit on the claim that they left off of the original estimate That is what the $is for in addition to the charge we incurred for the returned check that we deposited and that you stopped payment on Per your contract with Compassion Roofing, we charge Overhead & Profit on each and every job We sent to your insurance company and they assured us they would forward to you to forward to us for final payment, that is why you are seeing the charge Our office was calling Mrs [redacted] because that is who we were discussing this claim with initially before the roof was put on We received no return call back to inform us of another point of contact We were calling to discuss with her exactly what is said here about our General Contractors Overhead & Profit Please feel free to call us if you have any further questionsSincerely, [redacted]

Mr [redacted] , Before we started work on your property, we discussed the claim with AAA We brought to their attention that they left our General Contractor's Overhead & Profit off of the roof portion of your claim, but they added it on everything else They assured us they would add it at the end of the project when we billed for it So we billed them, sent in our final paperwork for the roof portion and billed you Your contract with us clearly states that we charge Overhead and Profit on our work All other proceeds go toward the work and materials itself I have attached a copy of your estimate from AAA showing that it was entered as a $amount on the roof portion however it was calculated for the interior work Sincerely, [redacted]

Complaint: [redacted] I am rejecting this response because:I am not satisfied with this response We received your estimate of charges prior to starting our roofing project and it did not include extra overhead and profit chargesHowever, your estimate did correlate with what our insurance company was awarding us to pay you for the services they deemed necessary for replacement of our roof.We have been in close contact with our insurance company since the beginning of this project Our insurance company (which is AAA) has not informed us of any extra funds that were to be released I have strong reason to believe that you have not been in contact with AAA since the completion of our roof replacement regarding further funds that were to be releasedOn August we received an email from [redacted] our Claim Service Representative from AAA and he states "The overhead and profit cost for the roof and the cost listed for the asphalt starter course can't be paid as they are already included in our estimated costThe cost are factored in our estimated costThe cost are factored in to our estimate line items."Your overhead and profit charges have already been paid through our insurance company They have not released any other funds than what has already been paid to you nor have they been in contact with us to inform us of other funds that are to be released Your estimate of charges did not include any extra overhead and profit and only included what our insurance company was going to award.I believe these extra charges are devious I can not pay them and I will not pay them because you have already been paid by our insurance company.I will not pay your bounced check charged for your ware adequately informed that I was cancelling my check because you were not able to give me a reasonable start date to perform our roof replacement I will only be satisfied if this invoice for these extra charges is voided Regards, [redacted]

Compassion Roofing and Remodeling (“Compassion”) has had an incredibly condescending attitude toward us and appears to be engaging in willful insurance fraud as detailed in the following paragraphs.

I hired Compassion to be the general contractor for home repairs after a violent storm. One of the areas of damage was done to the fence in the backyard. After 2 separate insurance adjusters came to the house, the final claim amount came to $31,601.11.

Given the age of the fence and the amount that the insurance claim was going to pay out, we asked Compassion for an estimate on replacing the entire fence instead of the portion insurance was paying to repair. Compassion provided two bids, both of which were not competitive. We confirmed with them upfront that we could use the insurance money allotted for fence repairs and bring in a different contractor. They confirmed that we could put all insurance money allotted for the fence to having a different contractor replace the entire fence.

We had the fence replaced on 6-8-2018 by Jamesray Baker Construction. I paid *** with my money for the fence.

Compassion submitted a Final Bill and Certificate of Completion to *** on 11/16/2018, so that *** would disperse the final insurance claim payment. The final bill included all costs for the project, including costs associated with repairs to the fence. In doing so, Compassion falsely represented to *** that Compassion was responsible for doing the work on the fence. *** paid the remainder of this claim and Compassion handled the process of cashing the check. As a result, Compassion was paid for the fence work, constituting insurance fraud.

I have worked to sort this out with Ms. Stefanie *** at Compassion over the last few weeks and let her know that I would be reporting Compassion for insurance fraud if the issue was not resolved. She was adamant that Compassion did not have the fence money. She claims in one of her original emails, “No we corrected, You never paid us for that, it was mistake and it was immediately corrected. You paid us off of the invoice that I gave you earlier today, you never forwarded us any funds for a fence.” The check that Compassion was paid from was endorsed by myself and my mortgage company. That check came from *** and was paid out on a different invoice than the one Ms. claims in her email. The invoice she refers to is one that Compassion generated after making the claim to ***. Ms. claimed that they corrected immediately. I have repeatedly asked Ms. for the correspondence as proof of correction, but she has chosen not to provide it. A later followup with *** confirmed that Compassion never corrected the invoice that was submitted, blatantly lying about the occurrence of events.

In the next email, Ms. continued to charge that Compassion was not paid for any work that was not completed and said, “If there was money that was included in the check that you gave us, that would be considered on account for you for your outstanding balance, and would go towards your deductible.” However, considering the check came from the insurance company and that the insurance company is not responsible for paying out my deductible, I believe Ms. and Compassion were actively working to manipulate the events to their advantage. It was at this point she began claiming deadlines for payment to Compassion.

I sent a response email to Ms. to correct many of the details she was actively manipulating. These included the timeline of work, amounts paid, and the ability of my mortgage company to inspect the completeness of the work done on the property when work was not 100% completed. I also made sure to detail the unprofessional nature of different crews that were being used, including multiple crews that trespassed on our property.

After asking for an entire week that Compassion resolve the issue with ***, Ms. reached out to *** on the final day of the week. She claims in her email to ***, “I'm being made aware this week that you have an incorrect copy that was written and sent before Mr. decided to make the repairs to his fence himself.” This was a gross misrepresentation of the facts. The fence work was completed on 6/8/2018, far before Compassion submitted the invoice to *** on 11/16/2018. I followed up with *** to correct the record.

In a later email, Ms. claims that I was getting things confused. She said that their records show I have not paid my deductible. This contradicts one of her original emails that I had paid a portion of the deductible. She mentioned they have $559.94 which matches one of the line items Compassion claimed for the fence work, substantiating my position from the beginning that Compassion was paid for work they did not do.

In the next series of emails, Ms. says she will hand me a check for $559.94 on the condition that we pay our deductible to them. As such, Compassion is withholding money that is not their money, in exchange for the deductible amount. Upon further investigation, Compassion had itemized multiple fence items into the exterior painting line item. The only exterior painting that Compassion did was for the Garage door and the window shutters. The Garage door line item matches the insurance claim amount, while the outdoor shutters were allotted $87.23. However, Compassion claims that the window shutters were $1,745.02. I discussed this with *** and they will choose the lower estimate when choosing between the contractor’s bid and the insurance claim amount. So, it is impossible that *** would have approved a 2000% increase on painting shutters. Ultimately, Compassion is withholding $2,187.96 that was allotted for repairs to the fence and claims they only owe $559.94 to us.

*** told me the invoice that Compassion was using was not official because it was not what they paid the claim from. Ms. continued to claim I was confused and claimed that the invoice was corrected with ***, even though she had no proof and had already told *** that she just became aware that *** had a different copy. She again stated that we didn’t pay our deductible, which further proves that Compassion is withholding money for work that they did not do. Ms. then began to threaten that Compassion would submit me to collections if I did not pay on the revised invoice. In her final email, she again mentioned she will only pay the $559.94 when I pay the deductible amount. This was far less than the amount that insurance paid for the fence in the claim amount, which constitutes insurance fraud.

Compassion Roofing & Remodeling Response • Jun 03, 2019

Thank you for the opportunity to answer this complaint. Mr. continues to be confused with our billing process. I have attempted to explain this at least 3 times now, by email. Currently, Mr. owes Compassion Construction $1,559.06 for work preformed. Nowhere on this invoice is the fence charge. It was originally mistakenly billed to insurance, but was immediately corrected when it was brought to my attention, and even after multiple conversations with the adjuster, it was a non-issue, even the adjuster understood and agreed it was a non-issue. Compassion Construction cashed the checks that were given to us for payment toward the outstanding balance, we are never given a ledger as to what the check amounts are for, line by line item. We apply them to the account for the homeowner. If the insurance company sent money to Mr. for the fence, an amount that he is claiming is $$2,187.96, and if he gave us money for that, then there would be a credit on his account, and as detailed in the invoice that I have attached, there is no credit. Everything completed has been billed as it was approved. Mr. keeps threatening us and all we are trying to do is get paid for the work that we preformed and completed with since February.

Compassion Roofing & Remodeling Response • Jun 17, 2019

Revdex.com, and Mr.,

As you can see by the attached invoices, with the collected payments notated at the bottom, there is no charge for the fence. The only dollars that we have on account for Mr. is $29,472.41, and it all applies to the line items on my invoice, and as you can see, there is no fence listed on my invoice. If Mr. believes that his insurance owes more for work he had completed outside of us, then he needs to go directly to his adjuster, because as I've stated before, Mr. still has an outstanding bill with us for his deductible, which he refuses to pay us, and instead, has now opened a bogus Revdex.com claim against us, falsely accusing us of insurance fraud, which even his insurance adjuster agreed with us, is not taking place. We made a mistake over 8 months ago, and have since corrected that mistake by updating the invoice, but Mr. still owes us for the work that has been completed by Compassion for over 6 months now.

Sincerely,

***

Complaint: 13579863

I am rejecting this response because:Compassion’s response is an unfortunate display of the company’s
willingness to misrepresent the facts rather than accepting responsibility when
they have been caught engaging in insurance fraud. One of their
most egregious misrepresentations was that they said ***’s insurance
agent claimed that there was no insurance fraud. As I detailed in my previous
response, *** agreed with Compassion because Compassion claimed they did
the fence work according to the official invoice. Compassion then represented
to the insurance agent that they did the fence work, so of course ***
would have no reason to question their story. This was a blatant lie and an
intentional act of a bad actor actively engaged in insurance fraud. When I talked
with *** and corrected the record, they confirmed that what Compassion
did was insurance fraud. Compassion has failed to prove their version of events
or refute my version of events so far. This is ultimately an admission of truth
to what I have presented.

Considering Compassion refused to cross-reference the line items
from their invoice with the claim, and seems to not look at any of the
attachments I provide, I will detail each of the fence items, per the State
Farm claim, with RCV amounts that feed into the total amount of the
claim. It is plainly obvious that line item numbers 20, 21, 24, 25, 26, 27, 30,
and 31 are all fence items and total to the $2,187.96 I have referenced before.

Item 20: Seal & paint – wood fence/gate, RCV = $98.98,
93.48 square feet (SF).
Item 21: Clean with pressure/chemical spray, RCV = $35.22, 93.48 SF.
Item 24: R&R Post – 2 3/8” diameter metal – 6’ high fence, RCV = 226.86.
Item 25: Seal & paint – wood fence/gate, RCV = $561.70, 530.46 SF.
Item 26: Clean with pressure/chemical spray, RCV = $199.90, 530.46 SF.
Item 27: Wood Fence 5’ – 6’ high – Detach & reset – per 8’ section, RCV =
$333.08.
Item 30: Clean with pressure/chemical spray, RCV = $192.20, 510.00 SF.
Item 31: Seal & paint – wood fence/gate, RCV = $540.02, 510.00 SF.

Adding up these RCV values, the total is $2,187.96. This is the
amount Compassion owes me because they did not do the fence work but claimed
they did when they submitted the invoice to *** as if they had done the
work. When I reviewed the official invoice from Compassion, from which State
Farm paid out the claim money, Compassion only had $559.94 broken out for the
fence and has claimed that this was for all of the fence work. Items 24 and 27 are
the only two fence items that add up to the $559.94. This leaves us with items 20,
21, 25, 26, 30, and 31 that total to $1,628.02. The only logical bucket for
these items to end up in is the “Paint, Exterior Paint & Stain” bucket on
Compassion’s invoice where they show $1,745.02. Digging into this, it is clear
that items 20, 21, 25, 26, 30, and 31 (all mentioned above for fence work) were
grouped into this bucket along with item 23, “Seal & paint window shutters –
per side (set)”, with an RCV of $87.23. This totals to $1,715.25. There is only
one remaining item from the claim that has a value for the remaining $29.77 and
that is item 35, “Drywall tape joint/repair – per LF”, which for some reason is
under the exterior bucket when it is in fact an interior item according to the claim.
Compassion might try to argue that they painted the garage door and that is
where these items should have been, even though the items clearly say wood
fence and have square footage that match the square footage for
the chem clean items. According to their invoice the garage door cost was
$1,326.23. This matches the RCV total for items 18 and 19.

Item 18: R&R Overhead door & hardware - 16' x 7', RCV = $1,251.67.
Item 19: Paint overhead door - 1 coat (per side), RCV = $74.56.

As I have clearly defined above, Compassion owes me $2,187.96
for the fence items that they claimed on the official invoice and were paid for
when they did not do the work. In doing so, Compassion engaged in insurance fraud.
By continually denying this without providing an itemized breakdown that cross-references the claim items to their invoice items,
they are perpetuating their involvement in blatant insurance fraud and
deceptive business practices. The evidence that I have provided is irrefutable at
this point. Compassion should take responsibility for their actions and resolve
this as I have asked.

Regards

This client is an angry, estranged spouse of a client of ours. Yes at the time the contract was signed she was living in the house, however after that date she moved out and was no longer living at the residence. As a matter of fact, it was brought to our attention that Ms*** stopped paying the mortgage for months and the house that we were contracted to work on was entering foreclosure because of Ms***' negligence. We started working very closely with Mr*** to help in any way that we could so that he could keep the house from being turned over to the bank, the house that Ms*** claims to have wanted to be be informed of the repair process because she cared so deeply for it. It's evident that Ms*** didn't care about the house and only cared about the money, which is why she is so upset that she doesn't have control over. Insurance proceeds are to repair a house, not for personal gain, however I think it's fair to assume that Ms*** was only interested in intercepting the payments so she could keep them. As evidenced by her mail theft from Mr*** property, which I believe is a felony. Never did we tell her that she wasn't allowed to be updated about the project. Never did she call and inquire about how repairs were coming. She called several times and used very inappropriate language, which we have recordings of, making wild accusations and being very hostile and emotional. Even going as far as accusing us of employing an ex-girlfriend of the estranged husband. Our client, Mr***, has been notified of each time that Ms*** has harrassed us, as have our attorneys and Mr*** attorney. If Ms*** had acted more civil and polite and not been so hostile everytime she called us, we would have been more than happy to communcite scheduling with her, but she's nasty and ugly to our employees and uses very inappropriate language every time she calls. Mr*** sent checks directly to us to prevent Ms*** from interferring with the process any longer, especially as insurance companies have a very strict timeline in which repairs must be completed

On October 10, 2018 I received an invoice from Compassion Construction showing an outstanding balance of $6,949.36 for work that was completed almost two years ago.

I don’t owe Compassion Construction this amount, this was an insurance claim and if there is an outstanding balance the insurance company is responsible for any balance.

Per our agreement with Compassion Construction, Compassion Construction took, by contract, the responsibility of negotiating the dollar amount the insurance company would pay for each covered repair and based on Compassion Construction acceptance of this dollar amount Compassion Construction would complete the repair for this amount. Compassion Construction, by contract, also took the responsibility of interacting with the insurance company and handling the billing for completed work and to make sure they were paid in full for authorized work completed.

All the work was to be completed without any additional out of pocket cost to me, with the exception of any upgrades or changes that I wished to make. We did in fact make changes and upgrades that I paid for in full on 12/14/2016 which fully discharged my out of pocket expenses obligation.

It is evident that Compassion Construction failed to fully discharge its responsibility to bill the insurance company for all completed work and to communicate with them regarding any outstanding balances.

I have attempted to resolve this matter through communications with a Ms. ***, VP of Compassion Construction but her response is always the same……you owe us the money. Apparently because her company failed to fully discharge their contractual obligation to collect full payment from the insurance company, she finds it easier to threaten me in an attempt to collect the alleged remaining balance due from the insurance company than to discharge her contractual obligations.

Obviously, Compassion Construction has some internal problems if they are just addressing this problem two years after the project was completed and they expect me to resolve their problem by just paying them money that I don’t owe them, which I have no intention of doing regardless of their attempt to intimidate me with their threats of collection of legal action.

Based on their handling of this matter, I certainly would not recommend doing business with this company.

Compassion Roofing & Remodeling Response • Oct 25, 2018

Compassion Construction completed the repairs in December of 2016 and that is when we started to collect the outstanding balance from Mr.. In February of 2017, he stopped responding to our attempts to collect the outstanding balance, stating that he didn't agree with the outstanding balance. We explained to Mr. that our invoice is in line with his insurance's estimate and that his insurance informed us that they released on monies in regards to the claim in agreement with our invoice. I've attached the communication from his adjuster confirming that he was in agreement with our final invoice, which I have also attached. Since February 2017, we've been emailing and calling regularly in regards to his outstanding balance and did not receive any communication from Mr. until we sent a 10 day demand letter to him for the outstanding balance. At this time, we are requesting payment by tomorrow to prevent it going to the attorney for collections and further charges to Mr. for those services. Mr. claims that he doesn't have the money, and I've directed him several times to reach out to his insurance in regards to that because we've been told by his insurance that they released all remaining funds in December 2016 and that all checks were cashed by Mr..

Complaint: ***

I am rejecting this response because:

Compassion Construction once again is misconstruing the facts:
1. I did not quit responding to them, for the balance of 2017 and 2018 did not contact me. On September 21st of this year I returned a call to their office and they started this collection nonsense.
2. Again, if their invoices are in line with the insurance companies estimates they would have received all of their money. I have requested a detailed accounting from them regarding our account so that I may have a complete understanding of what they billed. They have refused to supply this information. Without this information it would be impossible for me to have an intelligently conversation with the insurance company regarding billing and payments. Although, not my responsibility, I am willing, if they supply the information requested to talk to the insurance company.
3. All checks that we received form the insurance company, for work completed, were turned over to Compassion Construction and were cleared through their bank. We did not deposit any of the insurance checks received, for completed work, into our account. They were all picked by *** and I assume that he returned them to his office.
4. We do not have any agreement in place with Compassion Construction to pay for any short falls or overages they may incur because of their in ability to properly conduct their business.

5. The email that Compassion Construction attached from ***, which I have never seen before, validates my point that Compassion Construction was responsible for commutating with the insurance company and that were responsible for all billings. (Note: The numbers are wrong in this email)

Summation

If there is any outstanding balance due to Compassion Construction it is because they are apparently incapable of handling the accounting portion of their business. To suggest that I have any responsibility for flaws in their business operations is ludicrous.
The balance that they elude to, may in fact be a missing check from the insurance company, if so, it is still Compassion Construction responsibility

Compassion Roofing & Remodeling Response • Nov 06, 2018

Mr.,

We are sorry that you feel that way, but I don't know how better to explain this. Our response proves that the numbers on the final invoice is inline with the final estimate from insurance company, also attached is our contract that states that the customer agrees with our payment terms, and it also states that client is to pay us within 30 days on final work. It is not Compassion Constructions job, nor would an insurance company even provide us with payment information as it pertains to a Homeowner's Claim with their insurance. We were hired to do the work insurance approved and we did that work, and now we need to be paid for the work that we completed. As we told Mr. last year, there is obviously some confusion on Mr. part and he needs to reach out to his insurance company if he honestly believes that he has not received all the money. But as it sits right now, we are owe the money and we deserve to be paid for the work that we preformed, and that balance is $6949.36. As in regards to our invoice, it perfectly lines up with Mr. estimate from his insurance that he provided us with before we started work. I have attached that as well.

Once we tried to pursue Mr. outstanding balance, he threatened us with legal action and this complaint. What Mr. is asking of us, is illegal and no insurance company would ever comply because of privacy laws, that has been explained to him over and over again. There is nothing further that Compassion Construction can do at this point to assist Mr.. We preformed all duties as stated in our contract and we deserve to be paid for the work that we completed. As you can see, Mr. is completely satisfied with the work we preformed.

The only thing to do at this time would be for Mr. to contact his insurance, get a full accounting of the claim and find the missing money that he claims he did not receive. They should be able to provide him with check numbers and clearance dates. Then Mr. needs to pay his final bill to Compassion Construction.

Sincerely,

***

Complaint: ***

I am rejecting this response because:
There is no confusion on my part. I have asked Compassion Construction, on several different occasions in my correspondence with them for details of their final billing (Contractors Scope of Work with detailed line items for each service preformed including labor material and profit) so I could have a conversation with the insurance company. This information should have been given to me at the completion of the project. As of this date they have not provided this information. As stated in previous correspondence, when I get the information I will contact the insurance company but under no circumstances do I accept their claim that I owe them any outstanding balance on the work they performed. This work was covered 100% by the insurance company. I did have them do extra work when they were doing the repairs which I have paid in full.

Their allegations that I asked them to do something illegal are of course false, I simply asked that they do their job as specified in our agreement.

Regards

I had multiple items of storm damage repairs. Repairs took way too long with poor communication.
Screens on AC unit were incorrectly installed and needed correction by my air conditioner service person. So not now needing attention.

Siding that was replaced and painted just a month later is cracking and coming loose. This is my major complaint.
I have sent emails with pictures of how the ribs are turning loose. Clearly improperly installed.
The paint has dried very unevenly so it looks terrible. The siding is cracking indicating use low quality materials.

I trusted this company and it's employees to do right by me and have been very disappointed.

In addition to the emails I have made multiple phone calls requesting correction and got nothing but promises someone would come out,. Nobody has made any effort to come out to my house and address these problems in spite of me working from home which means they could have dropped by at any time with or without an appointment.

I did not want to be trouble but this is my house, my biggest investment. And it has become clear I am going to get a run around until this is old enough they can claim age or other problems.

Compassion Roofing & Remodeling Response • Jul 20, 2018

Mr.,

Thank you for bringing this to my attention. After I discussed this with ***, our Vice President, whom is over all subcontractor's scheduling, she informed me that the siding work that you had done was actually discussed and orchestrated directly with our subcontractor that we had to the storm damage painting. That was work was a side project that you had directly with him, cutting us out of the loop, so we could not provide oversight. We were not a part of that agreement, nor would we have had our painter preform siding work. It is my understanding that the contractor has reached out to you to rectify the work with you, however it is not a part of the contracted work that you hired us to do. As for the AC repair work, we warranty all of our work, as well as the work we hire our subcontractors to do, and if it had been brought to our attention we could have addressed it at that time. Our AC Technician is a highly skilled professional, however since I wasn't provided the opportunity to inspect the work that is in question, I can't accurately address the complaint.

Please let me know if you have any other questions or concerns, my office will be happy to assist you.

Sincerely

We are very sorry that you feel that way.   We are also sorry to hear about your personal issues regarding the dissolution of your marriage due to your own mistakes and your own money problems, however please stop dragging our business into your personal issues.   As you can see,  the...

repairs are almost complete at Mr. [redacted] residence, and Mr. [redacted] has given us a 5 star review for the services provided to him, especially since we have handled every aspect of this insurance claim despite your attempts to steal the checks from his mailbox, calling the insurance company and having stop payments put on the checks that they issued so that we could not continue on with the work that Mr. [redacted] hired us to do.  You interfered on this project the entire time and impeded progress every chance you got.   Had it not been for your interference, we could have been done with all the work a year ago.   It is not our fault that you moved out of the residence shortly after Mr. [redacted] hired us to handle his insurance claim.   Your insurance company and your mortgage company were aware of your behaviour and helped us to secure the funds in the manner in which they saw appropriate so that we could do the work that they approved, even going as far as to mail the checks directly to us at our office to prevent you from stealing them out of the mailbox again.   Please stop making false accusations.   It is not right for you to try to bring us into your personal matters, we have and always will remain professional.  As far as your accusation of us treating you poorly, we have several recordings of you using inappropriate language with multiple members of our staff on several different occasions.   Sincerely, [redacted]

I am rejecting this response because: I am not going to address Compassion Roofing’s personal rants, hearsay, and complete lies against me. I’m sorry they felt like they had to go down to such a low level. I will address how they cashed two checks totaling over $ 6,000.00 without my signature/knowledge or their signature at two different [redacted] branches. They stated I moved out of the residence – so I’m no longer allowed to be involved in my home’s repairs. In their mind, I no longer had homeowner right after I moved out. However, my name is signed on the contract I was required to sign with Compassion Roofing before work could begin or a claim could be filed. If I had not signed that contract, they could never have started work, yet when it comes to checks, conversations about repairs and inspections, they excluded me. My name is on the homeowner’s insurance, my name is on the home mortgage as well as both checks they cashed without my signature/knowledge. I’m not sure what their business attorneys tell them, but cashing checks as they did without my signature/knowledge is not appropriate and bad business. If they can do that to me, they can do that to anyone they don’t like or who has moved from their home. When I called to talk to them the one time about the first check without my signature/knowledge, I was told I could not talk to them because I no longer lived in the residence. I was told to never call them back and I was hung up on. While the part about me moving out is true, (generally in a separation, someone moves out, but that doesn’t mean they don’t care about the financial interest in their home) they had no right to tell me I couldn’t call to inquire about the checks or the repairs of my home. My attorney told my husband’s attorney to “fix” that. Compassion Roofing is not a judge and had no right to tell a homeowner they couldn’t call about repairs to their home. I’m sure they didn’t want to speak to me because they knew I hadn’t signed the checks they cashed. I am an intelligent woman and realize these repair checks were not for my personal gain. That is insurance fraud and not something I would ever participate in. I read the contract that I signed with Compassion Roofing in good faith and understood the checks were for the repairs of my home. The issue is I was excluded from repairs to my home and two checks which should have had my signature were chased without my signature/knowledge. My husband’s mail was mixed up with mine for a short time after I moved out because of my change of address. I received a check in my mailbox for repairs after I moved out. I signed that check and sent via [redacted] to Compassion Roofing’s address on the contract. I have tracking proof that I sent that check with [redacted]. In the meantime, that check was stopped paid by someone other than myself. I’m sure that can be researched also to find out who did that. There is no mail felony here, and again, the check that was stopped paid by someone else came to my mailbox with my name on it as well. I can hardly see how that is mail felony. The other two checks they signed were without my signature/knowledge. In another review, Compassion Roofing stated they worked with the mortgage and insurance companies to get checks cashed without my signature/knowledge. After speaking with those companies, it is clear to me those companies did not conspire with Compassion Roofing and my husband to do anything inappropriate or illegal against me. I have copies of both checks, front and back signed only by my husband and a [redacted] tracking number if anyone would like to see that proof. I also have the contract signed my my husband and myself to Compassion Roofing.Perhaps they should remove the word Compassion from their name.
Regards,

Dear Mr. [redacted], We are sorry for any confusion we have caused.   Your insurance company told us to bill them for the Overhead and Profit on the claim that they left off of the original estimate.  That is what the $3993.78 is for in addition to the charge we incurred for the returned...

check that we deposited and that you stopped payment on.  Per your contract with Compassion Roofing, we charge Overhead & Profit on each and every job.  We sent to your insurance company and they assured us they would forward to you to forward to us for final payment, that is why you are seeing the charge.  Our office was calling Mrs. [redacted] because that is who we were discussing this claim with initially before the roof was put on.  We received no return call back to inform us of another point of contact.  We were calling to discuss with her exactly what is said here about our General Contractors Overhead & Profit.  Please feel free to call us if you have any further questions. Sincerely, [redacted]

Complaint: [redacted]
I am rejecting this response because:I am not satisfied with this response.  We received your estimate of charges prior to starting our roofing project and it did not include extra overhead and profit charges. However, your estimate did correlate with what our insurance company was awarding us to pay you for the services they deemed necessary for replacement of our roof.We have been in close contact with our insurance company since the beginning of this project.  Our insurance company (which is AAA) has not informed us of any extra funds that were to be released.  I have strong reason to believe that you have not been in contact with AAA since the completion of our roof replacement regarding further funds that were to be released. On August 11 we received an email from [redacted] our Claim Service Representative from AAA and he states   "The overhead and profit cost for the roof and the cost listed for the asphalt starter course can't be paid as they are already included in our estimated cost. The cost are factored in our estimated cost. The cost are factored in to our estimate line items."Your overhead and profit charges have already been paid through our insurance company.  They have not released any other funds than what has already been paid to you nor have they been in contact with us to inform us of other funds that are to be released.  Your estimate of charges did not include any extra overhead and profit and only included what our insurance company was going to award.I believe these extra charges are devious.  I can not pay them and I will not pay them because you have already been paid by our insurance company.I will not pay your bounced check charged for your ware adequately informed that I was cancelling my check because you were not able to give me a reasonable start date to perform our roof replacement.  I will only be satisfied if this invoice for these extra charges is voided.
Regards,
[redacted]

Complaint: [redacted]
I am rejecting this response because:
We were never made aware of any extra costs associated with our roof replacement and home restoration. We never made any agreement to pay any specific dollar amount. Our insurance company AAA paid you all the overhead and profit and there is no reason I should have to pay you more. We are fully aware of what the contract says and what your estimate proposed to the insurance company comprised of. We have followed through with our contractual obligations. We were never made aware that there were extra charges to be accountable for after our roofing project was completed. We never approved any of the "supplements" proposed in this extra invoice. No business has the right to charge more money without making their customer aware of it first. This invoice is so absurd it couldn't be a misunderstanding and is at best a retaliatory move associated with my previous complaint to the Revdex.com.

Mr. [redacted],  Before we started work on your property, we discussed the claim with AAA.  We brought to their attention that they left our General Contractor's Overhead & Profit off of the roof portion of your claim, but they added it on everything else.  They assured us they would add it at the end of the project when we billed for it.  So we billed them, sent in our final paperwork for the roof portion and billed you.  Your contract with us clearly states that we charge Overhead and Profit on our work.  All other proceeds go toward the work and materials itself.  I have attached a copy of your estimate from AAA showing that it was entered as a $0 amount on the roof portion however it was calculated for the interior work.   Sincerely, [redacted]

On or around October 17, 2017 a check was issued to *** and *** and Compassion Roofing & Remodeling. *** at *** allowed him to cash this check without my knowledge or signature as well as Compassion's roofing did not sign the check ***, dated October 17, 2017 for $ 3,011.58. On or around February 12, 2018 *** allowed check ***. $ 3,011.58, dated 02/12/18 to be cashed. This check was made out to *** and *** and Compassion Roofing & Remodeling. All 3 of these checks were not negotiated properly, but all three were either deposited or cashed by 3 branches of ***. I have spoke to several branches of *** and all say it was incorrect, but there is nothing that can be done about it. The second two checks with the contractor's name was for roof repairs (both checks were the same amount), but no work has been done on the property. I believe *** and the contractor may have split the money or *** may have kept the money for his gain. Please understand I know this money is not mine, but should have gone for the roof repairs. More checks are to be issued for the repair. I have spoken many time to our mortgage companies Loss Draft Department and although they admit the signing of the checks was improper they say they cannot do anything about it and will reissue more checks without inspection of property repairs. I have spoke to *** branches, *** and *** (as checks were drawn off them) with no resolution. It is my conclusion that anyone can walk into a *** branch and cash/deposit whatever they want without recourse.
I request that both the repair checks be disputed and reissued and required to have my signature so I will know work is being done on my home at ***. I no longer live there, but the home is still in my name as well as ***. The check for the musical instruments is requested to be disputed and reissued with my signature as a requirement. 50% of that check is legally mine, but *** made it possible for *** to cash/deposit 2 checks improperly. My name is on the homeowners insurances at ***. It seems like there is fraud going on with all these banks, ***, Compassion Roofing and Remodeling

We are very sorry that you feel that way. We are also sorry to hear about your personal issues regarding the dissolution of your marriage due to your own mistakes and your own money problems, however please stop dragging our business into your personal issues. the checks were cashed without my knowledge or signature even though my name is on the mortgage & homeowners insurance as well as the contract you required me to sign. I have proof all all discrepies. It does not matter that I moved out. My name is on all paperwork regarding the home which you ignored. You said I wasn’t allowed to call about the repairs. My attorney said *** was to correct that error which he did not. Any homeowner has the right to inquire about repairs and you know my name was on the checks caused without my signature. I am not involving personal issues only legal. Thank you for publically admitting your company excluded me and cashed checks without my knowledge or signature for company gain. Very much in my favor ***.

This client is an angry, estranged spouse of a client of ours. Yes at the time the contract was signed she was living in the house, however after that date she moved out and was no longer living at the residence. As a matter of fact, it was brought to our attention that Ms. stopped paying the mortgage for 16 months and the house that we were contracted to work on was entering foreclosure because of Ms.' negligence. We started working very closely with Mr. to help in any way that we could so that he could keep the house from being turned over to the bank, the house that Ms. claims to have wanted to be be informed of the repair process because she cared so deeply for it. It's evident that Ms. didn't care about the house and only cared about the money, which is why she is so upset that she doesn't have control over. Insurance proceeds are to repair a house, not for personal gain, however I think it's fair to assume that Ms. was only interested in intercepting the payments so she could keep them. As evidenced by her mail theft from Mr. property, which I believe is a felony.

Our client, Mr., has been notified of each time that Ms. has harrassed us, as have our attorneys and Mr. attorney. If Ms. had acted more civil and polite and not been so hostile everytime she called us, we would have been more than happy to communcite scheduling with her, but she's nasty and ugly to our employees and uses very inappropriate language every time she calls.

Mr. sent checks directly to us to prevent Ms. from interferring with the process any longer, especially as insurance companies have a very strict timeline in which repairs must be completed.
