I, [redacted] of Competitive Edge Construction was hired by [redacted] to remodel a bathroom in her rental property. The job did take longer than I had anticipated. I had problems with the plumber and home depot and had a tragic death in the...

family. With all this going on I was in always in contact with [redacted]. The job was finished except for the shower door, which was a special order and you had a third party, that was not qualified for tile to look at the job. He told you that the job needed to be torn out and redone. Even though I thought that the tile needed a little work to make it satisfactory. I did not feel that everything needed to be redone. In our last email to you was, you are my highest priority. All I was asking from you was to give me two to four weeks to get the money together so I could buy the materials and get my highly qualified tiler in there to finish the job. I never received any email or text messages or phone calls from you. Your third party told me that you wanted me removed from the job. [redacted], you decided to throw Competitive Edge Construction off the job, without giving us a chance to fix the issue. I was willing to remove everything and start fresh but you did not give us a chance to rectify the situation. Colorado State Law Statues state that you as a homeowner have to give the company that is working on your job the right to fix the problem. You did not. Colorado Revised Statute, XX-XX-XXX through 13-20-807. Before instituting a lawsuit against any home builder or contractor,you need to review the language of "The Construction Defect Action Reform Act of 2003," which can be found in the Colorado Statutes at C.R.S., XX-XX-XXX through 13-20-807. The Act applies to any "construction professional"-including architects, contractors, subcontractors, developers, builders, builder vendors, engineers or inspectors performing or furnishing the design, supervision,inspection, construction,or observation of the construction of any improvement to real property. Contractual Waiver of certain rights afforded by this Act is prohibited.(XX-XX-XXX). The construction professional must be given an opportunity to inspect the property and to make an offer to settle the claim by payment of a sum certain or by agreeing to remedy the claimed defect described in the notice of the claim. The Act also contain limitation on the kinds and amounts of damages you may recover against a construction professional.Therefore, you gave up all legal rights to ask for Competitive Edge Construction to pay for something when our rights were taken away.

When I spoke to [redacted] on the phone, after I sent him an email of the pictures of the bathroom and the extensive list of problems with his poor and unsafe labor and installation of the tile in my bathroom, to explain to him that the work was unsatisfactory I asked him what was going to be done to fix this problem. [redacted] informed me that he would give me two options, one was that he could come in and spot fix only the problems that I had pictures of, I declined this option because I didn't want to discover problems in the future that we might have missed at the beginning, the second was that he would come in and redo the tile but it would have to be done on his schedule, he never mentioned how long this would be and he never mentioned getting a different tile company to come in and do it, I declined this option also, because the job had already taken 4 months, an amount of time which [redacted] agrees was longer than it should have taken and, even though I understand he was having problems in his personal life, business is business and my bathroom remodel should not suffer because of personal problems.
After receiving this response yesterday from [redacted] I consulted with a lawyer who informed me that while I was required to give [redacted] an opportunity to try to rectify the problem, I am not legally required to accept unacceptable resolutions nor am I legally required to allow an individual who has already done poor labor back into my home to potentially do bad labor again. Both of the resolutions [redacted] offered to me were unacceptable, I was not willing to allow him to fix the bathroom on his schedule after it had already taken him 4 months to do the job poorly nor was a willing to allow him to come in and fix only the problems that he thought needed to be fixed.
Also I had two separate companies come in and look at the tile work after [redacted] had finished it and I have written statements from both companies stating that the tile work was unsafe and not done properly, because of this it could cause injury due to the existence of sharp edges along the top of all the tile as well as the soap dish and improper draining.
In summary, [redacted] was given an opportunity to fix the problem, both of solution options he gave me were unacceptable and I am not required to accept them.

In the addition to the last response, Competitive Edge Construction has given the customer a resolution to bring in MBS Tile who is not associated with Competitive Edge Construction. We as a company tried to resolve the problem as a result the customer denied us the right to fix the tile. In addition, the customer did not respond to our last email stating you are our highest priority. The email address has not changed. We were waiting for a response from her. But instead she gave authorization to [redacted] (the third party) to remove us from the job. I have several texts from [redacted] stating she did not want us back and they were having another company come in immediately. The second company came in and she had them removed from the job and everything ripped out again. Now the customer is on to the third company to do the job. Also, the picture that she sent are from the renter and are extreme close ups which can make anything look bad that it really is. The customer lives in Canada never saw the work for herself. She never came in and inspected the job. She took the word of the renter who is not a tile professional and the opinion of the third party ([redacted]) who is not a tile professional either. In summary, we were denied the opportunity to come out and look at the job, to find the best resolution for both parties.
