This is Bobby Wagner with Complete Contracting. I received a letter on a complaint stating that I was arrested and was reported for stolen tile. I took on the job because my partner in the business told me that he was a tile expert but I found out that he was not. I went and tried to fix what he... messed up with 2 other guys and it looked great. She was happy as could be til one day she wanted her money back and I had done spent it on materials the second time and I had previously told her that I was taking the tile to my shop to clean them up to reuse. I was going to take them back and she went and filed a lawsuit on me before I could. She was never home when I went to take them back and I have over 1000 dollars worth of tools over there which is worth way more than her 35 dollars worth of broken and dirty tile. She only paid 1500 up front and she started asking for that back then It went to 1700 and now its 2300. The customer is young and trying to get a job done for nothing.

the melted wires to the new battery that we installed. This was all done with no cost because the customer stated they didn't have the money after the repair was completed. The customer was called and told the jeep was ready and that we didn't test drive it because it had no gas in it, the customer picked up the Jeep. The Jeep was then towed back into our shop for overheating, Our Shop paid for the tow, it overheated due to the brake calibers being locked up from where the jeep set for a long period of time. The customer was given a verbal estimate hich was declined.The customer walked away with a $140.00 Battery and a $160.00 Tow, free of charge, our shop ate the cost for this customer, trying to help.Herrnstein Service ManagerChris Snodgrass

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.The contractor was given ample opportunities to rectify this situation before we took legal action. We already cleaned the yard ourselves, and the contractor has been instructed by the police that he is not to come to our house or contact us directly. If contractor wishes to improve the situation at this point, he can send us the amount we have filed suit for ($2363.57) in the mail (certified) to our address.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.  My concerns are with the vehicle still doesn't start. It needs a new computer it will not hold charge. I've been told the voltage regulator runs off computer.  It has been a computer this entire time. I have the computer, had it when I last brought it in. My brother has handled this for me mostly, I apologize for all miscommunication. Things were fixed that had nothing to do with issue of starting and staying charged. You are correct that last tow had more to do with brakes and rotors than the battery and charge but once it stopped it wouldn't start either.  Beca us e I work out he handles things for me.  Why was the comp it er I was told it needed never put in. I bought it but it wasn't put in. I never knew I was not charged for anything.  At first yes I wasn't expecting it to cost that much but I paid the bill.   Thank you.

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.The contractor's description of what occurred is inaccurate. I was happy with the laminate work he did, though there were two spots we talked about him fixing because the laminate was popping out. I even wrote him and his two workers at the time thank you notes and gave them each $50 tips when the laminate was done. The tile was a different story. The first time his company tried to lay the tile, it was completely unacceptable (tiles were popping up, the spacing was completely inconsistent, the grout color was uneven). He has admitted that the job was awful (when he came to the house the following day, and I said I wanted to talk to him). When I hired him, he assured me that his company had experience laying tile. The contractor states that he took the job because his employer had experience – but, he allowed his employer to continue laying tile for several days (even though he could see it was bad). I was out of town at the time. It is certainly not my fault that his employee was not an expert - that is the responsibility of the business owner to determine not the client. The contractor admitted that he knew the tile was done really poorly, and he had it grouted anyway. Despite this and the huge inconvenience to me, I told him that he had one more chance to do it correctly. He assured me that it would get done correctly and that I would be 100% happy with the work. Later, I noticed that the tile I had in my garage was missing. I asked the contractor, and he said he took it home to clean it (because grout and mortar were stuck to them from the first attempt). I asked him to bring it back. While he was re-doing the tile laying, he admitted to me that he had never laid tile on his own. Several times, I had to conduct research on my own to help him know what to do, how long the mortar had to set, when you could grout, etc. After a few days, the contractor consistently did not show up at the pre-arranged times to complete the work. I have documentation of all of this. He often worked less than 4 hours a day. After several days of relaying tile (and me often having to point out where the tile was not level, or the spaces between not even), he started working on the tile around the wall and in the pantry. The work was completely unacceptable again. He also wasted dozens of tiles attempting to cut them. He tried to cover up a cut mistake by using mortar to "glue" another piece of mortar onto a larger tile. At this point, I scheduled a meeting with the contractor for 8am the following morning to discuss how to get the walls and pantry done correctly. The contractor did not show up. I texted and called. When he eventually responded that he was on his way, I was already at work. At this point, he had breached the contract several times, repeatedly not shown up at pre-defined times, and made countless excuses (all of which I have documentation), and I was tired of dealing with someone who did not have expertise in the service that he was providing (and a service he said he/his company could do). We told him that we were going to hire someone else (which I warned him of) and that I wanted my tiles and money back. I paid him upfront $1300 for the kitchen and $350 for the bathroom (which was never even started). He damaged my door frame (gauged out the bottom), so I requested an additional $50 to cover the materials and labor to fix this (which he told me he would replace). He also put dents in my brand new refrigerator, which he said he would take care of. The contractor agreed on numerous occasions that he would "make this right" and get the $1700 back to us (which I have written documentation of) and that he did not want to get the law involved. After this, we scheduled 2 other meetings (with agreed upon times and confirmation of attendance the night before) for him to return the tiles, our money, and pick up his tools. Each time he never came. I warned him that if he did not show up, I would take legal action. I have this all in writing, and his acknowledgment that he understood. I had another contractor come and look at the work. He said that the work along the walls, in the pantry, and in the laundry area were all done and cut incorrectly. When he went to look at how the tile was sticking to the floor, he could pull them all up (even ones laid for several days) with a screwdriver. He said that was really not good and that the floor likely would all pop out within a year or two at most.Trying to work with the contractor, I gave him one more opportunity. We agreed to meet at 10am on Monday, Nov. 27th so that I could get my tiles and money, and he his tools. I confirmed this meeting the night before (and have documentation of this - to which he stated "Yes 10am."). 10am came and went, and the contractor did not show. I tried contacting the contractor, and he did not respond. At this point, I went to the police station and talked to a police officer. I filed a report of the theft of the tile. The police officer called the contractor, and spoke to him on the phone. During this call, the contractor told the officer that he had the tiles and that he knew he owed us the $1700 but did not have the money. The officer told the contractor that it is neither my fault nor the officer's that he does not have the money. The officer informed the contractor that we were filing charges against him, and the contractor was told to turn himself in (or he would be arrested the following day). He turned himself in. The contractor did not find out that he was being arrested via mail. Because this was his third offense under the larceny class, he was charged with a felony. After talking to the officer, I filed suit against the contractor (small claims) for the agreed upon $1700 and also for the materials I purchased and he wasted (I have very detailed documentation of the amount I spent and what was used, receipts, prices of products listed on the [redacted] websites). The contractor also used several of my tools without permission and destroyed 2 of my personal 5 gallon buckets, used my patio table as a table to cut the tiles (which is now filthy and has mortar stuck all over it), and left my house and yard a complete mess. He routinely left dip bottles around my kitchen, left tools spread all over the floor after leaving, and left dumped piles of mortar throughout my backyard. I spent several hours cleaning this up on my own, after we filed the report because it was an eye sore and also dangerous for my dogs.While I may be young, I am not asking for anything for free. I am asking for my money back because of a breached contract, very poor workmanship, and completely unacceptable behavior from the contractor. I was far more forgiving and understanding than most people would have been and did everything I could to resolve this before taking legal matters. The contractor never came to the house to return tiles and money or collect his (which I have documentation of), so him stating that I was never home when he came, is not valid. The tools that he left are still waiting for him to come get – they certainly are not worth $1000. I looked up the tools, and it comes to a couple hundred dollars. This project was supposed to be completed substantially by Nov. 6. It is not Dec. 1, and I have to not only hire a new contractor to complete the work, but also repurchase all of the materials that were wasted the first time. Again, I have documentation of all of this.Please see photos attached for some examples of the issues I am discussing. I have more if you would like to see.
