This is my response to the above complaint. We were hired by the ***s to complete a large remodel job all of which was work left uncompleted by previous contractors. The job we submitted an estimate for consisted of laying new flooring on the first floor, staining and finishing
woodwork in the kitchen, finish woodwork in the den, creating oak panels for the dining room, creating a wooden throne for the downstairs bathroom and a solid oak door for the bathroom door, building an island for the kitchen, and numerous smaller projects throughout the house that were left unfinished by previous contractors. When the estimate was delivered to the ***s, they paid a deposit of $12,which I deposited into my account on October 11, 2016. This money was used for materials, expenses and some labor pertaining to the job, for which I have all of the receipts, which total more than $8,in materials and expenses and $8,in labor from the start of the job through mid-November. They had agreed to the deposit and were aware there would be further draws necessary throughout the job for additional materials,expenses and labor which is typical for a job that takes weeks to complete. When we began this job, Mrs*** was continually adding extra projects above and beyond the estimate for which she was informed would increase the cost of the project. We completed all of the projects that she wanted added as extras. We finally had to demand that she let us get back to the original projects listed on the estimate but she insisted that she wanted these things completed first It was a challenge to get one project completed because the way she wanted it done was continuously changing. An example of this is before we could lay any of the laminate flooring, every piece had to be inspected by her before we could lay it. This particular laminate flooring had been sitting in their possession for over years. This extended the labor costs because we couldn't just install it. She would go so far as to have us remove and replace pieces that we did install if she didn't like how it looked once it was laid. The installation of this laminate flooring took us 3x longer and we did not complete the den or the living room mainly because Mrs*** wouldn't sort the flooring to her satisfaction so we could complete it. Another labor expense was when it came to the stain for the kitchen and remaining woodwork throughout of the house. We had completed the sanding and prep work for the woodwork in the kitchen area and when we asked for the stain that we were told they had already, she informed us that there was no stain match to the color that she desired to have. So that project took an extra weeks of my time working with Sherwin Williams out of Wadsworth and Akron to try to create a perfect match for the kitchen cabinets and woodwork in the kitchen that had previously been completedI was finally able to create the match and complete the woodwork and the cabinets in the kitchen. On November 15, 2016, FIVE WEEKS LATER we asked for a draw of $12,for which they would only give $11,000. This money was used for labor for work that was performed since the start of the job that wasn't covered in the deposit and was used for additional materials and expenses for extra brick work that was added by Mrs*** to install brick veneer on the walls in the dining room and living room area and additional walls in the kitchen. We were originally only supposed to install it on one wall in the kitchen. Additional kitchen walls and all of the dining room area and living room area was not included in the original estimate. This extra veneer was ordered and paid for by the ***s, but all materials needed to install it were purchased by us. When we went to install the island in the kitchen where the gas stove was to be installed, we found there to be several gas line leaks in the older pipes for which we then had to repair by taking them apart, resealing them, and putting them back together. The island frame that was built by a previous contractor was done incorrectly by size and location, so I rebuilt the frame, moved it, and added support to accommodate the existing cabinets and my raised panel shell that was custom built by us. This additional work was not included in the estimate. When we went to install light fixtures in the kitchen and dining room area, there were numerous electrical issuesThe ***s had said another contractor had already ran all new lines and they thought it was ready to go and all we had to do was hang lights. We had to trace down junction boxes, which were behind walls (which is illegal) and mount them on the face of the walls to gain access to the wire connections. The wire connections we originally found were arcing and were a fire hazard. In good conscience, we could not leave this in its present state so we fixed it. None of this was included in the original estimate. Were there things not completed in the original estimate? Yes. Were we planning to go back and complete the job? Yes. My son did continue working for a short time while I was off work awaiting surgery and they asked him to not come back because they didn't feel his expertise in staining and finishing woodwork was as good as mine. He could have finished other projects for which he is definitely qualified to complete, but they wouldn't allow him to do it. This job should have been completed by mid-December but because of the extra work completed, it extended the completion an extra weeks putting it at the end of January. If we would have been allowed to complete the work on the original estimate, we would have been done mid December. The $11,that they are calling an "advance" is not an advance, it was for the work that was performed up through mid-December along with any additional expenses. We were already $4,in deficit for labor from the first deposit until we received the November draw and we continued to work through mid-December incurring additional labor costs, materials, and expenses. When we received the $11,on November 15, 2016, I had no idea I was going to have to have surgeryWe only received payments from the ***s, one October and one on November 15. As for not staying in contact with them, I had talked to them several times by phone and I have email responses every month from May 28, through September 19, 2017, at which time he informed me he was hiring another contractor to help finish the job. I am happy to provide those conversations in writing if you deem necessary. I was intending to return to the job after my hip surgery but my recovery took longer than anticipated and we were scheduled to go back on July 17, 2017. On May 30, 2017, I was involved in a motorcycle accident which left me unable to work again. I ended up having my other hip replaced and a wrist fusion surgery as a result of this accident and am currently still not released back to work. My son is continuing to do small jobs for other clients to be able to sustain his family while I am off of work. I do still have my business open for that reason and am still taking some phone calls from previous clients that we do repeat work for but am not soliciting any new work at this time. I am in possession of the toilet and am happy to return that in return for my tools that were left in their possession because we intended to go back and complete the job. This was a unique situation from the start with trying to accommodate the clients wishes and then the surgery issues that no one could foresee. We provided top quality work and were very diligent in being there every day and working to the best of our abilities to provide exceptional quality and service. The only rebuttal we would want placed into the case file is the following:  We dispute most of what Mr. H[redacted] wrote in response to our complaint and strongly believe we are owed money and can document it.  Also, while Mr. H[redacted] claims to have documentation that he was owed the money and stated that position when he requested that we provide him the money in question, we believe strongly that the money was given to him as at least an 85 percent advance for materials and future services that were never received.  One fact we will present as a direct rebuttal to his claims is that he had requested $10,000---NOT $12,000--- as this advance and we graciously provided him $11,000 because we did add in the brick installation that was not in the original contract and that work had already been done.  Furthermore,  he has refused to communicate to us since September, 2017 so we could exchange our positions, negotiate a settlement and arrive at an amicable agreement.  His total lack of response to any of our many tests, emails and phone calls in the past six months can only indicate to us that he knows he owes us money and is hoping we just go away and write off the loss. Given the inability of Akron Revdex.com to serve as an arbiter in this complaint due to Complete Home Maintenance LLC not being a Revdex.com Accredited Business , we will not provide any additional details in our rebuttal to Mr. H[redacted]’s assertions for inclusion in the Revdex.com Complaint Case File for fear of risking a compromise of our legal position in the event we do decide to pursue this matter in Ohio Common Pleas Court.  Thank you again for your time and response.   Sincerely, [redacted]
