This letter is in response to your letter dated May 26, with regard to Mrs*** ***I spoke with and provided a quote for seasonal snowplowing service for her residence at Gates Mills Boulevard on 12-7-At that time she stated that she wanted the service for the 2015-
seasonI instructed her that we would hold a spot on our route for days to allow her time to mail us the signed agreement and checkAt that time we discussed the terms of the contract including the date that the second installment was due which was NO LATER than December 31, When I got back to my office we added her to our route and into our billing systemOn December 15, an invoice was generated for the second half payment that was due NO LATER than December 31, and was sent the same day to her residence via regular mailIn the interim we had a snow event on 12-19-that required snow plowingAt that time we had yet to receive her agreement and deposit checkMrs*** called and asked If I would come to her residence and plow her drive and pick up the signed agreement and deposit checkUpon providing the service she gave me a deposit check of $ to secure a spot on our routeWhen I picked up the contract and check I reiterated to Mrs*** that the balance of the contract was due NO LATER than December we did not receive the balance of the contract by December 31, so we sent out a service hold letter on January 1, stating that the service would not be resumed until we had payment in full for the contractWe had a snow event on 1-4-that required serviceAt that time as per the requirements outlined in our snowplow service agreement we did not provide service to Mrs*** due to a breach in contract from NON PAYMENTMrs*** did contact us several times during the snow eventAfter the snow event was over I contacted Mrs*** to discuss the status of her serviceAt that time she stated that she had secured another service and to discontinue providing service for her property which we didSeveral months later I received the enclosed e-mail demanding a refund of $ of the deposit and a threat of small claims court actionWe did not feel the need to respond due to the fact that she was in breach of her contractwould welcome a small claims action to provide us the opportunity to counter sue her for the balance of the contract she defaulted on
In closing I would like to state that the comments made by Mrs*** are at best and inflammatory to our companies good standing in the Greater Cleveland Area since we are willing In let this matter be resolved as it isWe will forgo a small claims action to recoup the S ( plus interest ) that is owed to us and accept the $ payment in lieu of the total of the agreed to and signed contractWe expect that there will be no negative feedback on our company that would tarnish our good nameIf inflammatory and untrue comments are in any way disseminated about our company we will purse with vigor any and all action entitled to use by law to clear our name of these and baseless accusationsIn the future I suggest Mrs*** read any contract that she signs and adhere to the conditions set forth in said agreement to forgo any such unpleasantness in the futurePayment of the balance of the contract would have eliminated the situation we find ourselves in and continued the service for the balance of the contract's EntiretyWe feel this situation was entirely caused by Mrs*** and feel no refund is entitledWe consider this matter closed with no further action warrantedI await your expedited response
