The complaint made against me by [redacted] is erroneous. The facts relating to this complaint are as follows.
January 2013 I was contacted by [redacted] who requested data recovery for her IDE 2.5 100GIG Laptop Hard Drive. She mentioned to me during our conversation, that after learning her hard drive crashed, an associate told her that she could recover her data by placing it in the freezer, which she did. She stated she realized she could not recover her data through that method, therefore, she called Computer Analysis of Texas. We arranged to have the hard drive picked up from her office location. The following day my associate [redacted] went to the arranged location, which was her practice, located at [redacted] She required my associate to show his identification before releasing the hard drive, which contained several years of patient information, personal data, and family photos.
After evaluating the hard drive I discovered that due to the hard drive being placed in the freezer it had deteriorated which would require advance recovery. I advised [redacted] that due to the condition of the drive the process would take longer than usual. [redacted] agreed. After two months of working I contacted **. [redacted] and told her that the hard drive would have to be recovered in a cleaning room and the fee would be $1500.00 [redacted] agreed to the cost because she stated that there was important patient information as well as personal data which she did not have a back-up to and she really needed it. I explained to **. [redacted] to recover her information would be a lengthy process due to the condition of the unit. [redacted] said that was fine because she did not have the funds readily available.
I spoke with **. [redacted] in July 2013 to let her know she could pick up her hard drive. She told me that she didn't have the $1500.00 that was agreed upon when I agreed to do her recovery. I told her that I would reduce the cost down to $1200.00 She said that was acceptable and would need some time to gather the funds. I did not hear from **. [redacted] until September 2013. She told me at that time she had a misfortune with her house burning down and she would pay me for the service rendered in January 2014. I spoke to **. [redacted] in February 2014 who stated that she wanted me to send her information via internet.
It is against company policy to send information via email, fax and scanning. Under no circumstances do we send information by internet. Most importantly, it is a HIPPA violation to send patient information over an unsecured line. At no time did **. [redacted] provide me with an email to accompany her request.
Computer Analysis of Texas is open for business Monday through Friday 8:00am - 6:00pm. At no time was I notified by my staff that **. [redacted] visited our office. Our office is under 24hr video surveillance and can review any date or time that **. [redacted] claims she was at our office.
I have accommodated **. [redacted] in a professional capacity I performed a service she expected, made unusual provisions for her due to her untimely circumstances relating to her loss of home.
The integrity of Computer Analysis of Texas has been asked to compromise, which is unacceptable. She sought my services which I provided, based on good faith and now does not want to pay, based on her allegations. Her hard drive was recovered several months ago and is being stored in a secure location at no cost to her. As stated before I will not release any copies of the content, off the hard drive, of the information to any one other than **. [redacted] (in person).
I have performed what **. [redacted] hired me to do which is retrieve information off of her hard drive. Some of the information on the hard drive is as follows:
1. Photo of a pregnant woman in a white shirt with a little boy wearing a blue plaid shirt with both of them having their hands on the woman's stomach.
2.Yellow Certificate of an immunization record card with [redacted] written on it with a birth date of 987 by the Director of Public Health by the Bureau of Communicable Disease Services.
3.Walker Counseling Associates Confidential Report of Psychological Testing on a [redacted]
This information shall serve as an example that Computer Analysis of Texas performed and completed data recovery on a water damaged 100gig hard drive provided by **. [redacted].
Based on the content and sensitivity of information on the hard drive I would not release any electronic copy of the data that is on the hard drive.

We have been assigned cases from the United States Government, several counties throughout the State of Texas including Harris, Montgomery and Fort Bend counties, University of Texas, several law enforcement agencies throughout the United States of America and many Fortune 500 companies without any known complaints made against us. [redacted] has issued the first known complaint made against Computer Analysis of Texas.
