device is sold by BTL Aesthetics. Vanquish is a “non-invasive, non-contact selective radio-frequency (RF) technology system” that's designed for “cosmetic circumferential reduction and body contouring.” In simpler terms, the treatment heats up a patient's fat tissue layer using RF energy (which kills the fat cells), while the surrounding tissues remain unaffected. Prior to her purchasing these treatments, Ms. [redacted] had an in-depth consultation with regard to what was involved in the treatments, expectations, and costs. It should be noted that Ms. [redacted] purchased the TREATMENTS, she did not purchase any GUARANTEE of ultimate outcome. As in all areas of medicine, different people have varied responses to all therapies offered and given. Prior to initiating her treatment, Ms. [redacted] signed a consent form, which is also submitted here as part of our response.  Each line of this consent was individually acknowledged and initialed by her, and the final document signed by her. Specifically please note the very first line of the consent: "1. I understand the results may vary from person to person and that an exact result cannot be predicted" (this was acknowledged and initialed by Ms. [redacted]). (The last line of the consent): "17. I hereby give my consent and authorization and release this establishment and its agents of any claims that I have in the future connected with the described treatment" (this was also acknowledged and initialed  by Ms. [redacted]). Six months after her treatments (which is to allow time to see the full impact of the treatment) she was seen in follow up at our office (on 12/23/2015) in which she expressed disappointment with her results. A full series of repeat treatments were offered to her in an effort to help her achieve her goals (at NO COST TO HER), but she declined that offer. Ms. [redacted] states that later she was offered 'store credit' by a 'patient care representative' (which she refused, based on her email), but our policy is that issues of this type can only be addressed by [redacted] (Office Manager) or [redacted], and this is not the case (ie they did not make this offer to her). Ms. [redacted] states that "I have documentation from several sources that states Vanquish is intended for the abdomen which is most likely one reason I did not experience any results" but in reality she was treated with specific thigh adapters, designed exclusively (and supplied by the manufacturer) for use in the thigh area, as it was done with her. Ms. [redacted] states that "I have tried numerous times to reach out to them and was continuously told the person that handled refunds was away for a family emergency so I would wait a month and try again, same thing." This is also not true. [redacted] emailed her himself after her initial email he received on 1/28/2016 (one day after her email on 1/27/2016). She did not reply, but sent a second email asking for a response on 2/16/2016, to which he replied again on 2/17/2016. In her letters she demanded a refund, and threatened legal action if that were not forthcoming. Our response was to forward to her the contact for our legal counsel, for her convenience. While it is unfortunate that we were not able to make this person happy, in the course of medical (and in particular, aesthetic) treatment it is not possible to fully achieve the goal or satisfy all people. We tried to be as reasonable as we could in our offer to repeat the therapy in an effort to satisfy her (without additional cost) but she has been adamant that she wants a full refund, which is not our policy and which we simply cannot do at this time.
