I have contacted ***, I do not agree with his claims regarding the chimneyIt has been cleaned and all we were contracted for was to replace the fireplace front and clean the chimney and regarding the leaky pipe for the bath tub was a cracked pipe from another contractor that damaged our plumbing and we did not leave any debris in the crawl space at all and we were not required to meet the inspectors expectationsWe had a very specific contract that we were followingI have agreed to give *** a check that he is extracting from me for ($577) and I spoke to him on August 14th and let him know that I would be mailing a check out to him within days

Please find the letter to be forwarded to Sheldon B[redacted].

Sheldon,
This letter is restating of the original Desired Settlement: Refund of the original complaint forwarded to you by Revdex.com.
The timing was...

established by the repair action of the home inspection for the buyers of my home, not by me, but I was attempting to meet their deadline.  You did not respond to the telephone calls or of this letter sent via the Revdex.com.
Having not responded and another timeline coming for closing of the purchase of the home, I am sending you this notice that I am still waiting for you to now refund part of the money established by you in the billing for chimney work.  I am attaching the original bill that set up the job and the requirements that we agreed to. I will also state now for the record that you came to me 3 times for the payment as the upgrade progressed.  All 3 times including the last one that included the chimney work, I met with agreement and immediate payment.  I am hoping that this letter is met with equal consideration and timeliness from you as I describe the further actions I have made to work this out with you and sets the timing for future actions if you do not respond.

The work for the Chimney rework was:            a.  remove the insert,
                                        ... b.  clean the chimney,
... c.  secure the screen covering to the fireplace after customer purchase.
After removal of the insert, another issue was found in that a hole or part of the fireplace brick was dug out and filled with a soda can to essentially supply additional air from the outside screened opening to create an air flow that would carry smoke up and out of chimney rather than let smoke drift into the living spaces.  Therefore, it was to provide the necessary flow up the chimney which someone had found that the stove when built was not free drawing.  This did not impact the chimney when the insert was installed but would affect the fireplace upon the inserts removal.  The hole had to be re-bricked or fashioned with a better solution than a hole with a can in it.  This was an unexpected condition to be repaired and added to the list for chimney and fireplace work.  I found this out later when your crew removed the insert and was not aware of it until later when I got involved with the inspection report that the chimney was not cleaned. Therefore, this unexpected work was added as the fireplace would not be completed without it.
d.  Replace fireplace brick.

With the exception of removing the insert, the remaining tasks were not performed by you to my expectations of the contracted work statement, and definitely not to the expectations of the home inspection personnel for the buyer of my home.  The chimney had not been cleaned and was heavily creosoted by my use while living there and mentioned to you at the time.
I contracted with Clint C[redacted] of Banks, Oregon as a qualified mason to replace the brick for $100.00.

I further needed to contract with The Top Hatter to clean the chimney, requiring two visits.
One billing was for cleaning around the chimney and inside the fireplace:                               $149.00
The second billing by Top Hatter was for chemical cleaning and certification.                           $185.00

Additionally, a plumber was called.  Josh W[redacted] of Pipe Systems LLC responded with an
Emergency visit price to repair the bathtub drain, that did not have any pipe dope on the
drain pipe to bathtub connection.                                  ...     $115.00

He did not have enough time to adjust the stopper, so I was left with that task and to remove
the debris from earlier work done in that area that was also called out on the inspection report.
I needed to remove the drain from the bathtub that was added above and replace with a part
that eliminated having the lever drain.   Parts from Ace Hardware.                                   ... $ 43.26

I needed to make 2 round trips from Springfield to get this work done and meet with contractors
to complete.  I am adding $100.00 dollars for my time and gas to get this task completed on time.
                                        ...     $100.00
                                        ...                                         ...    ___________
Total additional cost to meet the scheduled repair date paid by me that was covered by
the contracted value set and the repair that could have been managed by you.                         $ 577.26

This is the value of overage that could have been and should have been part of your work to finish the
upgrade that you and I agreed to.  I hope you understand that this is extra money and time I had to
put into this job to finish it on time and to be adequately completed.  I would appreciate your response to
this letter and especially the recovery of funds that I did not have to spend.  The date that I set is by
closing date, approximately August 15, 2016, for your response.

Sincerely,
[redacted]

Attachment 1:  Copy of email to Sheldon about inspection failures that created reevaluating work for the Chimney cleaning.

Hello Sheldon,
I am in the process of selling my home at 1617 Cedar St.  Various issues have come up during inspection that are putting this sale in jeopardy on work that your company provided.  I appreciate the overall quality of your work and the ability to work along with you and Rick to upgrade my home.

The list of problems begins with the contracted removal of the fireplace insert and cleaning of the chimney as listed on the contract.  The surprise with the vent hole in the floor of the fireplace needs to be filled with another firebrick and the chimney still has a lot of creosote that needs cleaning.   I do have a chimney sweep doing the repair of the brick and now will need to contract for him to re-clean the chimney.

Also included on the inspection report is the leaking of the hall bathtub drain pipe into the crawl space and debris left in the crawl space.  Also the drain stopper is inoperable in the hall bathroom sink.

The Chimney and leak in the crawl space are major items that can stop the sale of this home.  I would like you to work the issues with the leak and bathroom issues.  I know you were in a rush to move on and that left me with some things that still needed to be worked.

I would think it is also your issue to compensate me for additional cost to hire a chimney sweep to clean the chimney.

As a further note concerning the contractor you used for the bathtub refurbishing is the surface is not smooth, feels like some sand or particles were left or the finish was not finished properly after the new coating was applied.

I did spend a lot of money to your benefit on this home with your improvements and thank you for some very good work.  I just would like to appreciate your responsibility in completing the work.

Thanks,
