We are in receipt of the above-caption complaint, submitted by [redacted], owner at [redacted] - [redacted]. Please consider this Concord's formal response. Please know that Concord is a completely independent, third party billing, payment processing and collection agency...

for [redacted]. Concord offers collection services to its clients within the guidelines of all state and federal laws and regulations. After receiving Ms. [redacted]'s complaint, Concord has placed her account in a "disputed" status on our account management system. This status notifies [redacted] Recovery to cease collections efforts and will block future collection attempts until the dispute has been resolved. Also, on our next transmission, Concord will notify the credit reporting agencies that Ms. [redacted]'s account is in a disputed status. Part of Ms. [redacted]'s desired outcome is to have her down payment refunded and her contract voided. As the third-party payment processing agency, Concord is not the recipient of the down payment nor are we in a position to offer refunds of money paid to [redacted] or to cancel a contract between Ms. [redacted] and [redacted]. Also, [redacted] has indicated Ms. [redacted]'s cancellation request was received after the rescission period had expired; they are requesting Ms. [redacted] contact them directly to discuss her cancellation options. We encourage Ms. [redacted] to contact [redacted] directly at: ###-###-#### or [redacted].**If you need any further information or would like to discuss this matter in further detail, please call me at my direct dial phone number, ###-###-####.

Review: Concord printed bill on 07/27/2015 I received bill on 08/03/2015 with a payment due date of 08/05/2015.(A late payment is 10 days past due date) As of Monday 08/10/2015 payment has been sent for two months.Today I received a call at place of employment about this bill and was warned the bill would go to collections.Just to be clear I have had this loan since 2007 and have never been late as of yet.My employer has made it clear that no phone calls are made to employee's unless it is about a family concern. My phone records show no calls made from Concord or no e mails. This is pure harassment.I can and will take legal action is this ever happens again. All past billing was mailed and received with a two or even three week period to pay bill.I feel this is an attempt to gain late fee's on accounts. Also the interest rate is 12.49% way too high for my credit rating and good standing.Desired Settlement: To avoid any future harassment legal action taken I feel Concord should pay off this loan at once. This billing issue is a scam and this company should be investigated. The main concern for now is employment contact and harassment. This must stop.

Response:

We are in receipt of the above-caption complaint, submitted by [redacted]. Please consider this Concord Servicing Corporation's (hereinafter "Concord" ) formal response. Please know that Concord is a completely independent, third party billing, payment processing and collection agency for National Bear Hill Trust, owner of Ms. [redacted]'s home improvement loan. Concord offers collection services to its clients within the guidelines of all state and federal laws and regulations. After reviewing Ms. [redacted]'s concerns, we have identified two items within Concord's ownership: timeliness of the monthly statement and contacting Ms. [redacted] at her place of employment. Concord has been in contact with Ms. [redacted] regarding these concerns. Unfortunately. Concord experienced a system issue that delayed the production of Ms. [redacted]'s monthly statement. That problem has been rectified; on review of the account today, Ms. [redacted]'s statement for September has already been generated. We are confident the problem has been resolved and sincerely apologize for any inconvenience this may have caused Ms. [redacted]. Concord does provide additional payment options for Ms. [redacted] should she choose to take advantage of them. We offer: payments that automatically draft on her due date each month, a 24-hour website and phone system where she can make her monthly payment without having to mail a physical check each month, or email statements that are sent to her electronically each month. In addition, we accept "bill-pay" payments that are automatically sent by Ms. [redacted]'s bank each month. We would be happy to assist Ms. [redacted] should she choose to utilize one of these payment options. In regards to contacting Ms. [redacted] at her place of employment, as soon as Concord was notified that she could not receive calls at work, we removed that contact number from our system and placed a note on her account indicating we do not have permission to contact her at work. The interest rate on Ms. [redacted]'s loan was set at the time she signed her contract (please see attached). However, National Bear Hill Trust does offer a loan modification option. If Ms. [redacted] is interested in this option, she is encouraged to contact our customer service department to see if she qualifies. Our customer service number is ###-###-#### (M-TH 6 AM-6PM MST and Fri 6 AM-S PM MST). Finally, per the attached loan documents, this loan is a valid obligation Ms. [redacted] contractually agreed to when she signed them. We politely decline Ms. [redacted]'s offer for Concord to payoff her loan. If you need any further information or would like to discuss this matter in further detail, please call me at my direct dial phone number, ###-###-####.

Review: This company is pursuing me for unpaid maintenance fees for a time share company that never notified me of the charges before sending me for collections. I would be happy to pay the dues owed but not any penalties much less over $114.00 of them because I am not at fault. When trying to speak with this company and explain to them to unusual nature of this case they not only tell me I have to deal with them and not the original company ([redacted]) but they tell me I am irresponsible in not paying my bills, tell me I am disorganized, should schedule all of my bills due with alarms set (because that's of course what all the flawless people working for this company do), etc.. None of this is relevant, but it is also extremely unprofessional, rude, and really unnecessary since I am willing to pay the original amount. I would also be willing to pay fees had I done something wrong. But I did not. [redacted] screwed up in sending this to them and I'm trying to get them to see that but that's a separate issue. I will not pay one cent in fees for a problem created by someone else.Desired Settlement: I want this case referred back to [redacted], and I will pay them. Then they can correct their systems that failed to notify me of payment due by mail, email, and phone ALL of which they have used in the past. Not one was used this time. I want any derogatory information given to credit bureaus corrected.

Review: I own a number of [redacted] timeshares in [redacted] and [redacted] and I pay my maintenance fees either to pueblo bonito directly or to [redacted] serving who does some of their collection work. I pay my maintenance fees well before they are due. [redacted] continues to harass us with letters and automated telephone calls to collect amounts that we do not qwe. We have begged them to check our records at [redacted] as we have done, but they refuse. We have received about 30 automated harassing calls from [redacted] as late as 8 pm!Desired Settlement: Cleared statements and an acknowledgement that they are wrong, and have implemented steps to prevent these kinds of mistakes and harassment in the future!

Review: A two-month old debt was past to Blackwell Recovery (Concord Servicing Corp) for $680 which already includes a $50 late fee, and Blackwell set a collection fee of $238 which is 35% of what is owed for a total of $918. I tried to talk with the Blackwell agents and supervisor and they said there was nothing that they could do, but once I paid the debt that I could talk with [redacted] and possibly get some type of credit towards next year's maintenance fees. I called [redacted] and they said they was nothing that they could do and that the collection fees was set by Blackwell Recovery.Desired Settlement: Refund of the $238 collection fee, as $50 late fee is already included in the $680.

Review: Purchased timeshare properties but cancelled the contract within the five business days allowed. All documentation has been sent to the origianl seller and to this collection company via registered mail showing we cancelled. Concord is still trying to collect on a debt we don't owe and has placed a negative report on our credit report.Desired Settlement: Remove the negative report on all credit reports and quit trying to collect on something they aren't owed. Send a confirmation letter stating we owe nothing!

To Whom it may concern:

We are in receipt of the above-caption complaint, submitted by [redacted]. Please consider this Concord Servicing Corporation’s (hereinafter “Concord”) formal response.

Please know that Concord is a completely independent, third party billing, payment processing and collection agency for [redacted]. Concord offers collection services to its clients within the guidelines of all state and federal laws and regulations.

On or around January 28, 2014, Concord received correspondence from [redacted] disputing the validity of the obligation on Concord’s system. At that time, we coded the account as disputed and sent a request to [redacted] to verify the account was still valid. On March 12, 2014, Concord received instruction from [redacted] that the account was valid and to continue collections efforts. This validation was forwarded to [redacted]’s [redacted] address we have on file.

In August, 2014, Concord received notice from [redacted] to cancel the account in our system as a “voluntary surrender.” In light of this information, Concord will instruct the credit reporting agencies in our next transmission to delete the data furnished regarding this account.

If you need any further information or would like to discuss this matter in further detail, please call me at my direct dial phone number, ([redacted].

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me. I will wait until for the business to perform this action and, if it does, will consider this complaint resolved. I do want to make sure that they will completely remove all account information regarding [redacted] and Concord from all three credit reporting agencies.

Response:

Good morning Ms. [redacted]:

After reviewing [redacted]'s rebuttal, I have attached copies of our original complaint response and subsequent correspondence to Shannon. I would like to direct your attention to specific information in both letters. (I highlighted them for your convenience) I believe these actions fully satisfy [redacted] request to delete the data submitted to the credit reporting agencies. For clarification, the term "voluntary surrender" is an internal term used to code the account in our system and does not affect the credit reporting action we have taken.

Our file was submitted to the agencies on 11/7/2014; the bureaus typically take 7-10 days to process the data and load the changes to [redacted] credit report.

Please feel free to contact me if you have any additional questions or concerns.

Review: I purchased a timeshare in MEXICO ([redacted])! [redacted] extended the time for our downpayment, which we sent to them. We also sent our monthly payments to resort (a day or so after we made out last downpayment). It took me almost 2 months to even get in contact with [redacted] because they do NOT have a toll free number. I reached out to a rep on FB, left messages, etc. I noticed that out payments were not cashed. Again, I tried to reach out to the company, no response. On June 10, 2014, I received a letter from Concord that my MAY 1, 14 payment was due, yes more than 30 days - this was first correspondence I had with the company. I tried to reach out to Mexican timeshare to understand what was going on, again NO response. Since my check was not cashed, I began making payments via online banking as proof or payments. FAST FORWARD...I get a copy of my credit report and note that I have a mortgage that is past due. I called and asked to remove these lates as Concord is just a servicer. A Mexican company does not have jurisdiction in the USA to report on a credit report. [redacted] does not have standing to even sue me unless they sell the debt to. The contract says that Mexican laws apply, therefore, I am asking to have the late payments removed bc this debt is not valid in the United States of America. The contract explicitly states that Mexican Law applied, we did not have the 3 day recission of contract right (applies to mortgages in the USA). We were told we could cancel, but out downpayment would not be refunded. AGAIN...this is a Mexican company that does not have standing in the USA. I request that the late payments be removed from my account immediately or I will file a compalint with [redacted] and lawsuit against Concord for reporting debt that is not even valid in the USADesired Settlement: Delete all negative notations of delinquency from all credit reports.

Response:

We are in receipt of the above-caption complaint, submitted by [redacted], owner at [redacted] - [redacted]. Please consider this Concord Servicing Corporation's (hereinafter "Concord") formal response. Please know that Concord is a completely independent company from [redacted], and performs third party billing, payment processing and collections for several clients, including [redacted]. Concord offers collection services to its clients within the guidelines of all state and federal laws and regulations. On January 6, 2014, Concord loaded Ms. [redacted]'s account on our system with an expected down payment due date of March 2, 2014. Per [redacted]'s instructions, Concord would not bring Ms. [redacted]'s account live in our system until the down payment was received. Our records indicate this was completed on May 28, 2014. Once this was completed, we activated the account in our system, sent a welcome letter to Ms. [redacted] and ordered coupon books for her. Our records also indicate that Ms. [redacted]'s first installment was due on May I, 2014 according to her cont ractual agreement with [redacted]. Because of the delay in the down payment, the account reflected a past due status when it was brought live into our system. To ensure the accuracy of our records, we have requested copies of Ms. [redacted]'s signed contract, installment payment instructions and clarification of down payment dates. Unfortunately, due to the devastating events of Hurricane Odile, we have not received those documents or the clarification we have requested and do not anticipate receiving them before this complaint response is due. Therefore, out of an abundance of caution and as an accommodation to Ms. [redacted], Concord will instruct the credit reporting agencies in our next transmission to delete the negative information on Ms. [redacted]'s account. Finally, Ms. [redacted] has been in contact with our Customer Service department and we will continue to work with her to clarify payment dates and contract dates to ensure our records are factually correct. We will communicate with her once we have received the information requested from [redacted].If you need any further information or would like to discuss this matter in further detail, please call me at my direct dial phone number, [redacted].

Review: Concord was hired to process billing for the [redacted] Resort and Spa. I was charged an incorrect fee which I was told would be removed, and they never removed it and sent me to their collections department. The Resort confirmed several times that this fee does not belong on my account and that I'm always paid in full, and Concord and now Blackwell Recovery do not remove the fee. I have to call email, argue, go through the facts over and over, and my contract does not have this fee. The amount of time, effort and money wasted on dealing with these discrepancies and this company's inability to properly communicate and fix this problem once and for all is inexcusable. I want to warn others that they will have to deal with this incompetency and unprofessionalism.Desired Settlement: Proof in writing that this fictitious additional charge which is NOT a part of my contract will never be charged to my account again. Any reports to any credit bureaus will be fully rectified and erased in writing with proof from each credit bureau. I pay my annual maintenance fee early each year and should never have to deal with this incompetence again.

Dear Dispute Resolution Consultant:We are in receipt of the above-caption complaint, submitted by [redacted], owner at [redacted]. Please consider this Concord Servicing Corporation's (hereinafter "Concord") formal response. Please know that Concord is a completely independent, third party billing, payment processing and collection agency for [redacted]. Concord offers collection services to its clients within the guidelines of all state and federal laws and regulations. We appreciate Ms. [redacted] bringing this issue to our attention. When Concord loaded Ms. [redacted]'s account onto our system in November, 2014, a set of fees were provided to us from [redacted]. One of these fees is assessed to certain [redacted] Fie sta owners once every five years (a "quinquennial" fee). On 8/19/2015, [redacted] confirmed this fee was incorrectly placed on Ms. [redacted]'s account. We regret the error and apologize for any inconvenience this has caused Ms. [redacted]. The fee and all related late charges have been removed and the account has been reset in our system so it will no longer receive this recurring fee. A copy of Ms. [redacted]'s account ledger indicating these changes is included in our response. Additionally, no data from either Concord or Blackwell Recovery has ever been furnished to the creditreporting agencies regarding Ms. [redacted]'s account. Our investigation into this issue has allowed us to identify a gap in our procedures. This issue should have been resolved in 2014 when Ms. [redacted] first brought it to our attention. This type of activity does not align with Concord's values; we take great pride in providing world-class service to our clients and their owners. We have adjusted our procedures to ensure this issue does not happen again and we have taken the appropriate measures to coach and train the employees involved. While Ms. [redacted]'s account has been reset in our system, we will continue to monitor it through the 2016 billing cycle to ensure no additional charges related to the quinquennial fee are included. If you need any further information or would like to discuss this matter in further detail, please call me at my direct dial phone number, ###-###-####.

Response:

I have reviewed the response sent in reference to complaint ID [redacted], and find that this resolution will be satisfactory to me contingent upon written confirmation that the $70 late fee has also been removed from the attached collection notice from Concord's collection division Blackwell Recovery. I will consider this complaint resolved as long as I receive this written confirmation and remain unreported to any credit agencies.Regards,[redacted]

I work at a law firm in Washington State that handles probates of estates and also, at times, will serve as Personal Representative of an estate. We are currently serving as Personal Representative of an estate and, as common procedure, we filed a Notice to Creditors and published it in our local news paper. After 4 months of publication, creditors can no longer make claims against the estate.

More than 4 months later, after the creditors' claim time period was expired, the decedent's phone number (which we transferred to his granddaughter) started ringing regularly with calls from Concord Servicing Corporation. They kept asking the decedent's granddaughter to supply them with her dead grandfather's death certificate and a court-issued Certified Letter Testamentary showing who the appointed Personal Representative is. They kept saying, "we cannot give you any information." She informed us about these calls and I followed up...

I spoke initially to [redacted] at Concord Servicing Corporation who told me I must send him those requested documents but that "he could not give me any information." I told him that I refused to send him any documents that contain the decedent's SSN or the power to transfer any of his assets until he could identify what his intention was with those documents and why he was calling. He wouldn't tell me anything. He also wouldn't even identify what Concord Servicing Company was or what sort of business they conduct. I told him we are professionals and that as professionals we assume that his agency would follow the established procedures for submitting a creditors claim, if that's what he was trying to do. He wouldn't tell me anything. So I told him I was not inclined to supply him with his requested information.

The way in which Concord Servicing Corporation has approached this decedent's family in an unprofessional manner as well as attempted to gain important personal information about the decedent from us is not standard procedure for any agency. If you are attempting to collect on a debt, there are standard established procedures for how to do that on an estate - and Concord Servicing Corporation has failed to do so on many levels: missed the time limit, contacted the wrong entity, and did not give the Personal Representative a legitimate reason to supply any information.

Please examine your processes and procedures you use toward contacting decedents or their estates. Especially if you are attempting to collect on a debt.

Review: I was sent my annual maintenance bill from Concord for my time share with an added assessment of $500 for "hurricane recovery". This added amount was not clarified as a voluntary amount to be paid on the bill. When I called to ask what the extra amount was for I was told for the Hurricane recovery but was still not told this was voluntary. As I had not budgeted an extra $500 for the maintenance fee plus the Hurricane assessment I informed Concord I could not pay the maintenance fee until April. In March Concord called me about the outstanding bill and this was when I was informed the extra $500 was a voluntary fee. I then asked for an updated bill to be sent in the mail prior to paying as I have had difficulty in the past with Concord giving me information about billing on the phone that was incorrect. I never received an updated and corrected bill so I called again in May asking for an updated bill and informed Concord I would pay the maintenance fee once I got the corrected bill, which I never got. I was then sent to collection by Concord with no prior notification, to [redacted] Recovery with an extra $100 for a late fee and $256.25 recovery collection fee added onto my maintenance fee. No corrected bill was sent or a phone call informing me of an intent to send me to collection was made. I have attempted to call Concord 5x and each time I was rerouted to [redacted] Recovery. I have arranged payment with [redacted] to avoid a negative mark on my credit report even though I should have never been sent to collection in the first place. Concord has refused to resolve this issue.Desired Settlement: I would like the late fee and [redacted] collection fee refunded. A total of $356.25

On 10/24/2014, Concord mailed an annual maintenance statement to Ms. [redacted] with a due date of 1/1/2015. This statement (copy included) included a $299 line item for a hurricane damage assessment. In the attached cover letter from [redacted], the owners of the resort were advised this assessment was voluntary. The information below is a timeline of events and a summary of recorded telephone conversations between Concord and Ms. [redacted]:On 12/5/2014, Ms. [redacted] contacted Concord to change her mailing address. During that conversation, there was no discussion regarding the hurricane assessment or the annual dues. On 1/31/2015, at the instruction of [redacted], Concord removed the $299 hurricane assessment from owners who chose not to pay the assessment. Ms. [redacted]'s account was part of that process - please see the attached account history. On 2/2/2015, Concord sent a reminder letter to Ms. [redacted], advising her of the status of her account. On 2/13/2015, a Concord collections representative contacted Ms. [redacted] to remind her of the status of her account and to advise if she made a payment, she would avoid the $50 late fee that was about to be assessed to her account. During this call, Ms. [redacted] indicated she was interested in sel ling her timeshare. Since Concord is not involved in the purchase or sale of timeshares, the representative gave her the phone number to the resort to discuss her options with the resort. The representative also advised Ms. [redacted], per instructions from Hacienda Encantada, her account would need to be current in order for a sale of her timeshare to go through. Ms. [redacted] inquired about the hurricane assessment and the representative advised her he was only speaking about the $925 annual maintenance dues that were past due. He advised Ms. [redacted] the hurricane assessment was optional. Ms. [redacted] indicated she did not want to make a payment on her account at that time and the representative advised her that collection calls would continue. On 3/2/2015, a second Concord collections representative contacted Ms. [redacted] and advised that her account was past due for the $925 annual maintenance dues. Ms. [redacted] advised the representative that she would not be using the timeshare in 2015 and she would not be making her annual payment for another couple months. The representative advised that collection calls would continue. On 3/13/2015, Ms. [redacted] contacted Concord for a balance on her loan account and to confirm Concord had her current address. The customer service representative informed Ms. [redacted] about the status of her maintenance account and she indicated she had mentioned to the collections representative she would be making her payment in June. On 4/3/2015, Concord sent a reminder notice (copy included) advising the account was in serious default and in order to avoid any further collection activity, to mail in a payment or contact Concord to make payment arrangements. Several additional attempts were made through the month of April to contact Ms. [redacted] by phone. On 7/10/2015, at the instruction of [redacted], Ms. [redacted]'s maintenance account was placed with [redacted] Recovery. Once an account is placed with [redacted] Recovery, Concord's collection and customer service representatives are no longer allowed to assist on the account and all calls rece ived are to be directed to [redacted] Recovery.Ms. [redacted]'s desired settlement is for [redacted] Recovery collect ion fees and late fees to be refunded. [redacted] Recovery co llection fees are not negotiable and will not be refunded. In regards to the late fees assessed on Ms. [redacted]'s account, once her account has been brought current with Blackwell Recovery and returned to Concord, we would be happy to discuss her options regarding a possible refund of late charges. If you need any further information or would like to discuss this matter in further detail, please call me at my direct dial phone number, ###-###-####.

Review: In the summer of July 2014 I decided to purchase at timeshare. That was a mistake. I purchased the time share with [redacted]. Once I got home I decided to read up on this time share and realized I made a huge mistake. I put down over a $2000 deposit. I realized I needed to void and null my contract at once. I made numerous attempts to contact the agency but the phone just stays on hold forever or the line will just hang up on me. I've even been on my house and cell phone at the same time in hopes of reaching someone on either line. I also sent a letter certified mail with confirmation that it was recieved by Concord corp. This was the only address and number I received in the timeshare packet in regards to my timeshare. I don't know what else to do to stop the calls from now yet another agency called [redacted] trying to collect as well in regards to this timeshare. I have never used this time share. I don't understand why they will not void the contract. Services were never rendered to me. If that isn't a scam I don't know what is.Desired Settlement: I would like to be refunded my $ which exceeded$2000.00. I'm willing to pay a fee but 2,500 is way too much to void a contract. I would like them to reverse this delinquency on my credit report, stop contacting me and void this contract at once.

Review: My wife and I purchased a timeshare at the [redacted] in [redacted] on March 13, 2014. We decided to cancel the purchase within 24 hours of making the transaction.

Concord Financial, of [redacted], Az., was the bank involved in the transaction. We had to file a complaint with the [redacted] in [redacted]) to get released from our contract and receive a refund on our deposit.

Our credit report with [redacted] shows that the Concord Financial has filed a charge against our credit for the sum of $2832 past due for a balance of $16120. I contacted Concord and told them that this report on our credit in inaccurate. We supplied them with correspondence from [redacted] and [redacted] verifying that our contract was canceled and our deposit was refunded. I asked Concord to remove this report from our credit report which they have not.

I want this claim to be removed off my credit report. I am in the process of purchasing a car and this claim has damaged my credit score.Desired Settlement: I want Concord Financial to remove the negative report from our credit report.

It is after 6pm on a Saturday night, I have worked all day and am trying to finish up my legal medical documentation, and I keep getting calls (6+ times) from this collection agency, who are not looking for me. When I call back they are closed. If they are closed why do they keep calling me. I feel I am being harassed. Their message says if I am not who they are looking for to hang up, but I am not picking up the phone since I am trying to get my work done, I am forced to listen to this over and over and over. This last call came after 8PM- I am so angry I could scream.
