Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.I have started the project using my own personnel, but due to my time restrictions and required involvement, I decided to hire an outside contractorCBD saw the progress and agreed to finish prepping the surface and offered to apply the proprietary texture/coating for decorative purposes.Initial color color application was satisfactory until it started discoloration (the texture sharpness was later discovered upon cutting the foot) Upon "repair work completion" all other punch list items were created.Facts and timeline:Pool contractor was not scheduled for week after the initial completion (well within the guidelines)Next time pool contractor was scheduled (hard date), CBD showed up also (floating date)Resulted in pool contractor being sent away by CBD, without consulting to meDuring the repair ( I was not present) the damage was done to the pool, house and other structures (including a 30-foot evergreen)Overspray (due to non-taping or covering) and un-uniform application is clearly visible to the untrained eye and still remains unresolvedSharp edges of the texture remains a safety hazardColor of stain was changed (probably accidentally) without approval due to applying additional unapproved stain coats on the entire area vsthe small area required to fixCBD were given months to fix the issue and each communication tried to argue, banter and denyThe communication provided by CBD clearly shows me concentrating strictly on the damage and resolution, while CBD trying to pick arguments$dollar offer via text by CBD to repair the damage myself was deniedThe damage was many times exceeding the offered amountThe credit card was contacted to help resolve the dispute, which resulted in additional fraudulent charges posted by CBD (later reversed as fraud)Initial payment of $6500+tax have not reached my accountCBD insurance company were contactedThey offered to cover only liability portion of the damage, while poor workmanship is not covered (additional major expense)I specifically asked them not to pay me, but rather send an approved contractor to fix the damage to my house, pool and other fixtures- currently in process.As of 12/22/I have not received any money back that were paid originally ($6500+tax).I am not asking for money, but rather to return my property to presentable shape.Regards, [redacted]

In Reference to the complaint, file ID no [redacted] , I will try again to response to the customer rejection of our offer for us to go back and replace and/or repaint over the sprayed areas in question and the small areas on the deck By the way, those areas are less than 10-sqft from over sqft that we have done, and one the four pictures was a duplicateI am not sure what any contractor would be able to do other than what we are offering We managed to resolve many previous issues with other customers and 99.9% of our customers are happy of our works and we normally get lots of referrals from them We have offered to do the same with this customer (to go back and work on those areas of question) and he repeatedly refused as we specified in our previous response (please refer to our emails attached to our previous letter), for an obvious reason, now we know, is to get all our work and services for free, (he is already withdrew all the contracted price and some more from our bank as well as getting over $from our insurance) His refusal and attitude to resolve this situation lead us to truly believe that he actually pre-planned /pre-mediated this whole scenario for not paying us for all the material and services we provided and get the whole work for free and some more from our insurance as well as trying to blemish our reputation in the process with Revdex.com to maybe trying to justify his actions I am a Chemical Engineer with over years of experience in construction and concrete development, I always pay extreme attention to customer service and had never insulted or did anything wrong to our customers as they are the bread and butter of our service, let alone encountered anything like this situation with this customer Also, for information only, the company have been in existence for at least years prior to actual registration date which is irrelevant to this case and has no meaning other than the customer trying to justify his wrong doing as he had personally approved our work when we left the 1st time and we used his pool deck as a reference work for another potential customer that he wanted to do a similar work to his pool deck with us Without repeating the facts stated in our previous letter, we know that the customer has a cleaning contracting business and he was initially tried to do the work himself with the least amount of investment but failed miserably When we took the project many things were already damaged and now he is trying to blame us for them (such as sand all over the property, rocks and sand in the pool, sand covered all the yard and all the trees which we actually spent many hours washing and cleaning the place which was not in our scope of work or in the contract, we even cleaned his car and garage too without any charge) What we did was fixing his mess that he started and already trashed pool deck by removing the mountains of sands from his property which he created before we were even in the picture, which he told us that he will clean before we are going to start, which he did not The facts remains as follows: 1- We completed the work with the texture and color as contracted as well as did many other services as mentioned which were outside the contract for free of charge2- He personally approved the texture, color and the workmanship in person when we finished3- He agreed to show his pool deck and our work after we finished to another potential customer of ours, which he actually came and visited the place and we could bring this customer as a witness to that ( This is to show that the customer, [redacted] was happy when we finished our work otherwise he would not agree to show his place to others and become as a reference to us) 4- Because he wanted to get his pool ready so quickly after we finished the work, he had hired a pool contractors before the pool deck was completely cured, (written instruction was sent to him), which they must have spilled some chemicals on the deck and damaged the surfaceEven though it’s not our fault, however, we agreed to go back and re-fix the damaged area free of charge and as a good gesture 5- When we went back, we found that he hired asked to pool people to work with us on the same day and time, which is impossible with the kind of work we were doing, we tried to arrange another time for us or the other contractor but he refused apparently they wanted to finish the pool and get it ready for the 4th of July weekend, which caused confusion and forced our crew to work faster to finish their work before the other contractor would walk on it an damage it again Because of this rush and confusion, one of the worker did over prayed a small portion of the house panel, the pool lip and very small area of the deck was darker than the rest of it, (these areas were only spots of less than 2xeach which amount to sqft out of ftpool deck ( one of the pictures included in his letter is a duplicate) This only happened due to his unwillingness to change the date for us or the other contractor as he wanted the pool to be completely done before the 4th of July weekend, which caused all kind of confusion and rush on our crew6- We, however, agreed again to go back and re-fix those small areas in question, which we did but he was not happy, and that’s when the situation between us started to take the wrong direction by him refusing to talk to us, started calling us names, insults and made it very difficult to work with and to finish this small problem, that is why do believe that he pre-planned this situation so that he can get, or he think, all the work and services for free 7- With all our attempts to go back to re fix this small areas (by emails, phone calls and texts) he consistently refused and made it harder and harder to complete the projectHe then started to blame us for damaging more and more things on his property, things we had nothing to do with, The latest one is that we also damaged the evergreen in his yard (in this latest response, he added the evergreen, which he claimed that we damaged, which we never heard that from him before) 8- He Re-charged and withdrew all the contracted price back to his bank, which mean he got all the material and services for FREE and he still asking for more compensation from us and from our insurance to make his claim legitimate or so he think(The insurance paying his over $2000) 9- He is getting reimbursed from our insurance for over $for the over spraying on the house panel and pool lip, which we think it’s too much for such small area, however, he is still arguing and asking for more money from them So you can see his pattern, he is not only he getting all what we have done for Free , he is also getting reimbursed for this little damage, which worth few hundred dollars close to $and he is still not happy 10- I am not sure what any company can or could have done with this customer to please him other than offering him to go back again and re-fix some of the mistakes so we can close the subject In any contracting work, things could go wrong sometimes, but to get it unresolved and to go this far by his consistent refusal for us to go back and finish the work, which only lead us to believe that he created this whole scenario, pre-planned and pre-meditated it to get the work for free and some more from our insurance and he is still complaining trying to justify his actions 11- Lastly, I am not sure how CBD has violated the Indiana Code 24-5-11-as the customer claim This only prove what kind of a person I wanted to say that I appreciate the time you took to review this matter very muchIn this response I am respectfully declining Concrete By Design offer I am also attaching the photographic evidence of actual damage that were documented by the insurance adjustor as wellThe evidence of poor workmanship is very hard to dispute, regardless of how much the story gets twistedPlease revisit this matter one more time, as the responses from *** ***, owner of Concrete by Design (further as “CBD”), are very clever but deceptive interpretation of anybody’s words or just mere reflections of his opinion
Reading CBD pages long response, I can see very detailed attempt to twist the words, justify his actions or cover the lack of workmanshipI’m willing to elaborate on any subject in detail, but will respond in bullet points, sticking to the facts:
- The circumstances leading to the CBD hiring are incorrectBasic flow of events were as follows: *** *** were engaged in May to give the ideas for refinishing the patio, CBD then received the info from them, contacted me, came during initial preparation process (completed by my resources) and offered to finish the project and apply textured surface (somewhat proprietary product)I was asked to leave the pool cover on and CBD will take it from thereSince I had a very busy schedule and wanted the project completed soon, I agreed to hire CBD- The conditions were negotiated and the contract was signedI was assured that pool, house and surrounding areas will not be affected and taped up properly- Upon CBD initial arrival, I provided access to the electrical power outlets and breakers (although not required in the contract), offered any other help (including to remove pool cover) and left
- Upon coming home, I found grinding was taking place, creating extreme amount of dust, my garage door open, pool cover in the poolAlthough expecting the dust, I did not expect it in my garage or further trashing my pool. When I expressed my dissatisfaction with neglect towards pools and the garaged cars, I was given set of excuses and explanationsAt that point I asked to be treated as they treat other customers, and entered the house*** came back few more times trying to explain and justifyI agreed to put this behind us and continue the work- When the project was finished (or so I thought), there were no apparent issues and the stain color was light brown colorI agreed to release the payment- Patio was not used due to my travelsAfter about a week, when letting the pool contractor in for an estimate, I noticed white discoloration marks in isolated area about 10-feet away from the poolI only asked CBD to look at it and let me know what they think is happeningNo explanation was given, just said that it will be worked on shortly, depending on weather- On the repair day, my fiancée was home (I was in out of town business meetings)During the repair process, the pool contractors arrived to drain/refill the pool and were sent away by CBDAfter I found out about this I called back CBD and asked who gave them liberty to order other contractors (that I’m paying for) around without consulting with me or my fiancéeOnce again I was interrupted, given denials, excuses and explanationsI did not see a point in arguing (nor did I have time) and ended the conversation- Upon arrival home that night, I found the list of issues previously already listed in the complaint(pictures are numbered according to the issues):
1. Overspray on the pool trim, house, doors, stainless steel pool handle and ladder, skimmer covers, etc2. Overspray on the fire pit and house stone
3. Overspray on the plastered pool steps
4. Drip marks and accumulated stain all over the patio
5. Changed patio color (2-shades darker brown) and damaged evergreen6. Improper initial application of texture (extremely sharp edges preventing from ability to walk barefoot) creating potential injury hazard, especially for small children- Most pictures were forwarded to CBDI made a decision to communicate only in writing due to the argumentative tone and demeanor from CBD- After a month, CBD arrived and asked me to be on the propertyUpon their arrival, I was asked to show the damage in personI took them around the property, stopped at every spot, showed the damageCBD started arguing, telling me about the challenges and costs to fix some of the damagesStarted placing blame on pool contractor, etcI, once again, asked to address my concern and leftAt that point *** called me a “***” when I was leaving the patio (seen/heard by my fiancée through open bedroom window)At that point I came back and asked him whether he wants to tell me something in person rather than behind my backHe justified it due to the fact I supposedly called him a liarWhen asked to specify the time or circumstance, he said that I have been questioning his statements before, which in essence is calling somebody a liarHis behavior became increasingly argumentative and loudAt that point, I felt disrespected enough and told him finish the job and to get the “*** out of my property- When I came back, no substantial improvements have been madeThere were multiple extended emails by CBD justifying their actions and challenging my photographic evidenceThen text messages followed offering $100, $150, $for doing the work myself I declined, since the scope of work is many times more than thatEach time I responded in a professional manner demonstrating my willingness to resolve the issue- After failed attempts to resolve this I submitted a dispute with the credit card companyAt that point CBD charged my card without authorizationThen used deception to justify the unauthorized charge of $until it was submitted for repeated review and was turned in as fraudAs a result I had to get a credit card numbers reissued
In the past moths I had multiple contractors completing more than $100,worth of work at my propertyThere were never any issues with the payments or the final work qualityAny work related issues or questions were resolved in a very quick, civil and acceptable to both sides mannerThe contractors I have hired previously, provided expertise, labor, resources, tools, skill and accountability needed to complete the taskIn this particular case- it did not happen
In my opinion ( I have background in commercial concrete refinishing and stain application), CBD tried to repair the isolated spot, but chose the wrong shade of stain and then scrambled to apply stain to the rest of the patio in order to blend inDue to possible weather conditions, limited experience (company opened in 2013) and possibly feeling resentful they neglected to tape the property creating a huge messRealizing the magnitude of the mistake they took self-defense stance and tried to deny, justify their actions and blame the othersThey even resorted to blaming me for hostile environment, alleged threats, insults, etcEven though I was almost never home and after the first sign of argumentative nature of CBD, I refused to communicate verbally, rather did it in writing (as evident in email communications)This complaint would not have been pursued, if the reasonable adjustments would have been madeAt this point, in addition to experiencing personal insults on my own property, fraudulent credit card charges, I have incurred many thousands of dollars worth of extra labor to get my property back the way it was
Indiana Code 24-5-11-Contract Requirements were also violated with the initial agreement
Please review this matter again in order to help reach a reasonable resolution Sincerely,
