Concrete Contractors

Review: On 5/22/15 I entered into a contract with [redacted] (hereinafter “[redacted]”) of Concrete Contractors to write up a proposal to remove and replace the approach of my 2-1/2 car garage and car port, plus new concrete along the north side of the garage – 3-ft. X 24-ft. [redacted] sketched a drawing and wrote the proposal which I accepted on 5/22/15, for the total amount of $2,086.00. At that time, he asked for payment in full and the check made out in his name, not the company name.

Facing a long hospitalization due to my on-going health problems, I agreed and a check from my Home Equity account was given to [redacted] in his name for the full amount. (I confirmed with my bank that [redacted] cashed my check the same day it was issued, 5/22/15.) I told [redacted] I needed a few days so Milwaukee Fence could set their posts before [redacted] began the work. [redacted] agreed to wait until Milwaukee Fence could install the posts. After approximately ten days the posts were installed and the concrete project was ready to start. I called [redacted] the following day and he came with a laborer concrete saw and electric jack hammer and sawed a 10-inch X 37-ft. control joint. Used the jack hammer to wreck out that span. After that, he called a subconstractor named [redacted] at [redacted] to clean up the debris. A few days later this same subcontractor arrived at my house to threaten me that he was going to take me to Small Claims Court for nonpayment of his service. I told [redacted] that I paid [redacted] in full and to talk to him. [redacted] stated he tried to talk to [redacted] and got nowhere, then added I “should watch my back because [redacted] has shady business practices.”

The proposal created by [redacted] had a start date of 5/26/15 and a completion date of 6/12/15. [redacted] showed up on 7/9/15 and formed up the north side of the garage and never returned after that date. His lack of completion of my project held up the roof contractor and fence contractor.

I learned about [redacted] Concrete (hereinafter “[redacted]”) from [redacted] (hereinafter “[redacted]”) ([redacted]) who was having work done at his place. I told [redacted] that I hired [redacted] of Concrete Contractors but [redacted] was unable to reach [redacted] and learned [redacted] was working in his neighborhood and hired them. [redacted] had [redacted]’s steps and sidewalk completed in two days. Having no contact with [redacted] whom I had hired and paid, I decided on 6/29/15 to sign on with [redacted] and try to recover the money I paid [redacted] since he abandoned my project and didn’t honor the contract. [redacted] had a few small jobs to finish and would start on my project as soon as possible. [redacted] kept their word and arrived to my house about a week later to start the work, only to find Concrete Contractor people working there, so [redacted] just drove past so there wouldn’t be a conflict. [redacted] called my cell phone while I was in the hospital and I asked them to wait until I was discharged 7/16/15. Once home, I tried to contact [redacted] at Concrete Contractors numerous times but he never returned any of my calls.

Concrete Contractors worked only one day digging out the north side of garage and forming.

I told [redacted] to finish the job. In addition they took out all of the car port, doubling the size of the job, completing the project in three days.

In addition to the monies I paid [redacted] for not doing the work he proposed he would do, I paid $3,248.00 to [redacted] to do the entire job complete.Desired Settlement: [redacted] needs to reimburse me the entire amount I paid him: $2,086.00
