Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below ASAP RESPONSE TO COMPLAINT: The customer purchased a Vehicle Service Contract on 8/1/it became active on 8/31/The customer filed claimsThe first claim was filed on 9/16/for replacement of the engine turbo chargerASAP does not cover pre-existing conditionsThe next claim was filed 10/21/for replacement of the high pressure fuel pumpThis failure was caused by the lack of proper operation of the turboBecause of continued operation of the vehicle, the turbo caused the fuel system to stress thereby causing the fuel pump to failASAP does not cover failures due to neglectI apologize for the delay, unfortunately the Revdex.com email made its way into my spam inbox and I did not see the message in time This response in entirely inaccurateAfter consulting with multiple mechanics, it has been determined that the turbo charger did NOT fail due to pre-existing conditionsIt is mechanically improbable that the vehicle would operate with the a faulty compressor bearing for an extended period of time before causing the turbo to failWhen that part fails, it is a sudden mechanical breakdownFurthermore, all maintenance has been completed and documented, and the vehicle certainly has not been neglectedRegarding the high pressure fuel pump, it did not have anything to do with the turbo failureASAP even told me this on the phone when they denied the claim (mind you, after I had been without a car for two weeks)The fuel pump failed due to a punctured internal diaphragmThe system operates entirely seperately from that of the turboI have contacted a lawyer and am currently pursuing a lawsuit for retroactive coverage of the denied claim Warm regards [redacted]

On 12/31/the consumer purchased a Vehicle Service Contract from ASAPThe consumer signed the contract terms and conditions on 1/3/On 2/23/a claim was filed by [redacted] Auto Repair on behalf of the consumer for outer tie rods and an ignition coilBecause the failures were covered by the VSC, the claim was, reviewed, authorized and paidOn 5/23/ [redacted] Auto Repair submitted a new claimThe repair was for an electronic brake control module, which is not listed as a covered component in the contractThe air conditioning condenser was leaking as wellA leak is generally not a covered issueThe reason being is this a mechanical failure contractA leak in the condenser aluminum is simply the result of freon gas corroding the aluminum causing it to become porous and leakThe part was not defective, it was leakingEven though ASAP did not have a obligation to cover the claim under the guidelines of the contract, ASAP performed a goodwill courtesy and covered both repairs.On 8/ [redacted] Auto Repair submitted a new claimThe consumer stated to the shop there is a noise coming from the front of the vehicle when drivingThe shop stated the front wheel hub assembly is noisyNoises are not considered a defect by the contractPlease see the attached signed contract, section Definitions, number 11, which discusses the contract covers defective partsPlease also see section titled Total Performance, which has a complete listing of all of the VSC covered componentsThe electronic brake control module is not listed.After a thorough review of all details of claims and diagnostics the claims have been:Covered in accordance with the terms and conditionsCovered although the terms do not allow coverageDeclined according to the terms of the VSC

Thank you for bringing this matter to our attentionThe consumer purchased a Vehicle Service Contract from ASAP on 4/7/2016, with mileage of 98,All contracts require a day and 1,mile wait period in order activate coverageThe contract became active on 5/7/2016, and 99,miles (Note: the consumer stated the purchase price of $2,The consumer has a arranged a monthly payment plan with ASAPTo date, the consumer has paid $788.00.)On 7/18/Mercedes Benz of Stockton contacted ASAP to initiate a claimThe mileage at the time of the claim was 101,The shop provided the following diagnosis to ASAP:Customer Came in For:CHECK ENGINE LIGHT IS ON, NO SYMPTOMSShop Diagnosis:SHOP FOUND THE INTAKE CAM SHAFT HAS AN INCORRECT POSITION ON BANK 2, STATING THIS IS A MECHANICAL FAILURE OF THE GUIDE WHEEL INSIDE THE ENGINE WHICH IS CAUSING THE CONCERNSHOP STATES THIS FAILURE IS BASED ON THE CODE ITSELF AND EXPERIENCESHOP STATES THE ONLY WAY TO TRULY VERIFY AND DEMONSTRATE THE ROOT CAUSE OF THE CONCERN WOULD BE THROUGH A TEAR DOWNSHOP RECOMMENDS REPLACING THE GUIDE WHEEL TO RESOLVE THE ISSUESHOP STATES THE TEETH ON THE SPROCKET CAN GET NUBBED OFF WHICH CAN CAUSE INCORRECT ROTATION OF THE TIMING CHAIN AND CAM IF THE FAILED GUIDE WHEEL IS NOT REPLACEDError Code:Error Description:BANK INTAKE CAM SHAFT INCORRECT POSITIONBased on the diagnosis provided by the repairing facility, a Mercedes Benz Certified Dealership, a major point is their opinion of this being a MECHANICAL FAILUREThe Vehicle Service Contract has been active for only 1,milesA mechanical failure of this magnitude would many thousands of miles to developThe attached signed VSC states: (Exclusions, 12) "ANY REPAIR OF A SYSTEM, ANY EQUIPMENT OR PART IF IT IS DETERMINED THAT THERE IS A REASONABLE MECHANICAL PROBABILITY THAT THE CONDITION CAUSING THE FAILURE EXISTED PRIOR TO OR AT THE TIME OF PURCHASE OF YOUR CONTRACT, WHETHER KNOWN OR UNKNOWN AT THE TIME OF PURCHASE OF YOUR CONTRACT." Neither ASAP nor any of its competitors cover pre-existing conditions.After a thorough review of the details of this repair and the VSC terms and conditions it is determined ASAP has declined the repair in accordance with the VSC

Thank you bringing this matter to our attentionThe customer purchased a Vehicle Service Contract on October 12, The customer signed the contract on October 19, (please see attached)The contract states under Section "Your Obligations" the customer is required to maintain the vehicle according to the manufacturer's specificationsASAP called with and emailed this information to the customer and is only acting accordance with the terms of the contract

Thank you for bringing this matter to our attentionThe customer filed a claim on 8/31/with vehicle mileage of 64,The repair facility stated that the MASS AIR FLOW SENSOR has failed and needed to be replacedASAP authorized and paid for the repair (please see the attached payment receipt and invoice.) On 10/6/the customer filed a second claim with the vehicle at the same repair shopThe shop now stated the engine was misfiring and needed to be repairedASAP sent an independent, third party inspector to view the vehicleThe inspector discovered that the mass air flow sensor, which was paid for on the prior claim, was never actually replacedThe inspection report states: "There was no failure of the mass air flow sensor and it has not been replacedThe tech had it unplugged when he was doing the compression test so when the tech was cranking the engine over on the compression test it set the mass air flow sensor code." This constitutes obvious fraud which ASAP has not reason to tolerateAs a result, due to misrepresentation, the Vehicle Service Contract has been administratively cancelled and the customer was provided a pro-rata refund in accordance with the contract guidelines

Thank you for bringing this matter to our attention The customer filed a mechanical breakdown claim on 2/2/ASAP informed the customer an independent inspection would be sent to the repair facility to view the vehicle and confirm the failures reported by the repair facilityWhen ASAP advised the customer of the pending inspection, the customer elected to relocate the vehicle and have it diagnosed again by a different repair facilityASAP again informed the customer an inspector would sent to the new shop to view the vehicleAccording the third party inspection report, the failures to majority of the components were deemed to be existing prior to the purchase date of the vehicle service contractWithin the vehicle service contract ASAP is not obligated to cover pre-existing conditionsAdditionally, the inspection report determined that some of the failed components were not pre-existing, and therefore were covered by ASAP warranty Based on the claim outcome, the customer elected to cancel their service contract and signed and returned a cancellation refund agreementThe refund receipts are attached as well

I am a very unhappy with this company They covered less than half of my check engine repair If they don't want to cover The dealer cost then don't send us go them

Thank you for bringing this matter to our attentionASAP has reviewed the customer's claim history in its entiretyThe following information will show that ASAP doers its best to evaluate claims/repair needs in fairness and according to the contract guidelines signed by the customer On Mr [redacted] entered into Vehicle Service Contract with American Standard Auto Protection acknowledging and accepting the Terms & Conditions with an electronic signatureThe contract had an effective start date of and start mileage of 61,A copy of the signed contract is attached On 12.14.2015, just three days in contract, JL Motorworks initiated a claim stating the drivers seat frame and passenger rear window regulator were brokenboth required replacement The seat from is a non covered itemThe window regulator was authorized by ASAP for the amount of $based on the contract guidelines On JL Motorworks initiated a claim stating the coolant transfer pipe located under the intake manifold was leaking requiring replacementThe consumer was informed pipes were not covered by the contract and were listed as excluded, EXCLUSIONS, paragraph The consumer responded to ASAP stating the shop was reporting a failure to the engine valley pan and intake gaskets, and the pipe requested by the shop was needed in conjunction with the failed pan and gasketsASAP contacted JL Motorworks for clarification, who confirmed the failure is to the pipe itself and the valley pan and gaskets are needed in conjunction with the pipeThe vehicle mileage was 63, On The vehicle mileage was 63,R&V Auto Repair initiated a claim, voluntarily stating the vehicle was improperly diagnosed by JL MotorworksIn addition to the coolant transfer pipe leaking, the water pump was also leakingDue to the inconsistent vehicle diagnosis, an inspector was dispatched through Executive Auto Inspections, a national inspection and consulting company utilized by the insurance and automotive sectors, to view the vehicleThis third party professional inspection yielded a report which stated: The engine is in the vehicle with parts removed to see the water pumpThe water pump o'ring (which is a seal) is leaking coolant where the water pump mounts to the engine blockThere is no gasket, just an o'ring sealThere are no signs of a leaking coolant pipeWhen the technician pressure tested the cooling system the coolant was spraying back on the coolant pipeThe water pump is not leaking, just the mounting o'ring sealA copy of the report is also attached The consumer was informed stand alone leaking seals and gaskets are not covered by the contract and were listed as excluded, EXCLUSIONS, paragraph The contract is quite clear, leaking seals and gaskets as stand alone repairs are not coveredSeals and gaskets ARE covered only in conjunction with the authorized repair or replacement of a covered part After re-review of the third party inspection report, the claim was evaluated according to the contract Terms & Conditions

So I've been waiting for my refund for almost a month nowThey say you have a month decide before they charge you a cancelation feeThey also withdraw the money from you instantly and eagerlyThe cancelation paper says it should take to business days to get your refundIt's been business days and counting$is a lot of money to be without for a monthIf you can withdraw it instantly it should be able to be returned instantly

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below In response to American Standard Auto Protection's message, most of the information they gave was of previous claims that have nothing to do with the current claim that brought up the issueThe current claim in discussion is the issue of the transfer case failingAlthough there was a technicality error in paperwork leaving a discrepancy in mileage it is not due to an odometer issue, failure, alteration, etcAs stated in the contract ASAP attached in their message as a PDF file, "Exclusions" number states that "If the odometer is altered, disconnected or inoperable so that the miles traveled cannot be accurately determined" (the part cannot be covered)After ASAP found the discrepancy on a single piece of paperwork and told me I could not be covered I assured them it was only a small mistake made in error and my odometer was not in failureI also offered to take my vehicle to a BMW certified mechanic to have them make sure my odometer was operating properlyThey refused my offerI pleaded with them, assuring them that odometers are never known to work in reverse, making mileage less than what it truly isAfter giving them this information they told me that it says in my contract that they may cancel due to a mistake in paperworkI replied by saying that is a ridiculous thing to have on a contract because everyone makes mistakes on paperwork and everyone is humanI waited on hold for 10-minutes for them to find were it states in my contract involving paperwork mistakes and they could not find anythingFinally, they would not talk to me any further and assured me that they would not repair my vehicle and my contract was cancelled immediatelyI believe it is ASAP's obligation to cover the expenses to fix my transfer case due to what the contract entitlesThey had no problem taking $dollars from me when purchasing this contractAs soon as something bad happens they fight to do anything to have you stuck with a car that needs work Regards, [redacted]

On [redacted] entered into Vehicle Service Contract with American Standard Auto Protection acknowledging and accepting the Terms & Conditions with an electronic signatureA copy of the signed contract is attached On Mr [redacted] initiated a claim stating his vehicle was difficult to start and the charging system failure light was onHe would have the repairing facility call in with a completed diagnosisLater that same day Southfield Imports called stating they believed the vehicle needed a starterThey would call back when more diagnostic information was availableOn Southfield Imports again called stating they never replaced the starterThey charged the battery and gave the vehicle back to Mr [redacted] The vehicle was brought back in and the technician verified the alternator was failing requiring replacementThere was no request for a batteryThe claim was authorized based on the contract Terms & Conditions Mr [redacted] acknowledged and acceptedA Claim Authorization Form was faxed to Southfield ImportsThe form states: 1) I acknowledge that the repair authorized has been completed to my satisfaction and restored the vehicle to proper working order 2) I hereby agree that I am satisfied with the authorized amount for my covered repair3) I agree that I am aware of all non-covered feesThe Claim Authorization Form was signed by Mr [redacted] and Southfield ImportsA copy of the signed form is attachedA copy of the ASAP terminal receipt documenting Southfield Imports has already been paid is also attached
