I am rejecting this response because: I purchased this Item over the phone and was not in the store to see this sign they mention, and was not told this information over the phone. They did tell me that I could return the Item, per Ashley their customer service representative whom I placed the order with over the phone, that I could return the item if it was not comfortable to any store that sold Simmons Beauty Rest and I specifically asked and informed them that I live in California and he told me that I could return it anywhere that sold Simmons Beauty Rest. They did not tell me anything about only being able to return to their store in Montana. My parents used to live in Montana and were moving back here and offered to bring it to us so we took them up on it. This is why I specifically asked multiple times are you sure I can return it here in California and was told yes again and again!!!

I am rejecting this response because: I specifically asked on the date of purchase on the phone with Ashley from Conlin's furniture at least five times" we have had this happen in the past and we're not comfortable on a mattress and we're not able to return it I asked Ashley over and over if the mattress is not comfortable can we return it in California?" His response over and over was yes anywhere that sells Simmons Beautyrest mattresses it can be returned to My parents *** and *** *** we're also in the store and heard the same information repeated back to me over and over To me it sounds like Conlins furnitures customerservice representative, Ashley gave the wrong information and guarantee to me as their customer and Conlins should be held responsible and is not holding themselves accountable for what their customer service representative stated to me.

We did rewrite the contract as the consumer asked for 0% for months

We did offer this customer a refund and/or comfort exchange but we did tell them that returning the original mattress was their responsibilityThe comfort exchange policy is clearly documented on a large poster right behind the sales deskThe last line clearly states that re-delivery charges are
the customers responsibility

From the outset and despite numerous explanation, the customer has misunderstood the difference between warranty service and a comfort exchangeThe manufacturers warranty is fully enforce wherever the product is in the USA comfort exchange is only valid at the point of sale
