The property manager exact words were, " to give it back" when I ask what was my optionsI said for free, she said yesMy realtor and attorney are compiling statements from past , present and potential members to show others that others had similar interactions with them as wellI will happily forward to all parties upon request

Prior to or at closing each member is provided with a copy of the Association's governing documents including the bylaws. It is the members responsibility to understand their rights and obligations to the corporation in which they are becoming a member of. Attached hereto are the bylaws for review, please referred to Section 8. C. In this particular case the Association did not exercise their right to purchase the unit. This section also reads that "IF" the corporation agrees to assist the member in finding a purchaser...Well the corporation never agreed to assist the member. The MLS shows that the unit was listed in 2014 with a price change and removed from the MLS In December 2014. It also shows that the unit was listed again at a higher price of April 2015 and removed from the MLS again in August 2015 but not listed again. The corporation nor the management company has no obligation to assist the member in selling their unit. The seller should engage the services of a licensed professional real estate agent who will appropriately market the unit for sale. Please also note that our staff does not have the legal authority to accept or reject applicants, this can only be done through the corporation.

First and foremost our office never told this
member to give her unit back to the co-op. We are not a licensed real estate
company and do not participate in selling the co-ops. We are a licensed
community association managers company and will provide the resale certificates
and applicable documents once a unit has sold and is ready to close. Secondly,
our office has no role or authority in approving or rejecting applications for
membership. All applications are approved or rejected by the Board of
Directors. It is important to note that our only role is to process the
completed applications for credit and background checks; once this is done it's
forwarded to the Board of Directors within 3 days.
For this particular unit, three applications were
rejected by the Board of Directors because the applicants did not meet the
membership criteria; the first was rejected for financial reasons, the second
for employment and/or credit history and the third for insufficient income. A
fourth applicant recently failed to continue through the application
process for reasons unknown to us. Many factors need to be taken into consideration here such as, but not limited to, the condition of the unit, the as[redacted] price, location, current market conditions for co-ops, limited buyer pool for co-ops and the membership selection criterias that must be met, all which have nothing to do with the management company.
Lastly, our company does not purchase co-ops, the Association/Board
of Directors may elect to purchase the co-op because they have the Right of First
Refusal but not the management company. And again, we are not a licensed real
estate agency and therefore do not provide services for purchasing or selling
homes.

Review: I been trying to sell my co-op for a year now. This management company has offer no help, when ask for options to help sell my place they simply told me to give it back for free. Now every potential buyer has been rejected and the rejection process has taken a 2 to 3 months, as a wait I have notice the cooperatives they owned has sold within a month. They are clearly abusi g the power and when asked they tell my agent and myself its up to the board, I have been to meetings and seen the influence the property manager has on the board. She clearly waiting to take my co-op by rejecting all buyers.Desired Settlement: Buy it from me or help me sell it.
