Review: On 4/4/12, I mailed check #[redacted] in the amount of $3753.70 to [redacted] Racing and Restoration, Inc., [redacted], PA; this amount included $976 for a transmission rebuild which was required to rectify a transmission lube leak. Soon after I got the car back, I noticed that the transmission continued to leak and it was difficult to shift into 2nd gear. A local transmission shop inspected the transmission while I was present and found that other than a possibly new midplate, it had not been rebuilt and confirmed that the transmission had a lube leak. I proceeded to have all the worn or defective gears, cluster gear and input shaft replaced. The transmission now functions perfectly and no longer leaks.Desired Settlement: Between 6/26/12 and 2/25/13, I have forwarded three written requests for a refund of the $976 I paid for the transmission rebuild and have not received the refund as of this date. My last two letter dated 12/22/12 and 2/25/13 have not been answered.

I am rejecting this response because:

**. [redacted]'s response contains two incorrect assertions: #1 He stated I refused to contact the sub-contractor. I attempted to contact the sub-contractor several times, both via telephone and in writing, and he has not responded, and #2, he states that I refused to allow his business to inspect the transmission or give them the opportunity to rectify my concerns. As I have stated in my complaint, I took the car to a local reputable transmission shop where their inspection, in my presence, disclosed worn and damaged transmission components and verified that the transmission was leaking. The presence of these problems plainly illustrates that the transmission was not rebuilt as per **. [redacted]'s invoice. I forwarded a written statement by the general manager of the shop and have offered to provide photos or such other documentation that **. [redacted] may require. Also, the general manager has agreed to discuss this matter in detail with **. [redacted], however, **. [redacted] has never contacted him. I have retained all defective transmission components. **. [redacted] at no time requested that I send my car/transmission back to his shop, therefore, his assertion that "He refused to allow my business the chance to see if there was a problem with the transmission or the opportunity to rectify his concerns". **. [redacted] has refused to take any steps to resolve this issue and his only response has been to require me to work it out with the sub-contractor with whom I have had no dealings. **. [redacted], in fact, is listed as the customer on the sub-contractor's invoice and my payments were made to him, not his sub-contractor.

Also, **. [redacted] asserts that my vehicle was test driven prior to shipping it back to me and "no problems of any type" were noted. If the transmission had not resumed leaking or demonstrated any shifting difficulties during a brief test drive, that is one thing, but how could their inspection fail to notice that the back up lights remained on in first and second gears? Their inspection also did not find that the rear interior vanity lights were not operating and that the rear glass that was replaced was not properly sealed and leaked rainwater into the trunk.

In summation, it is obvious that **. [redacted] and his sub-contractor have provided sub-standard services and that **. [redacted] is refusing to stand behind the quality of this work and provide an appropriate refund for services/products paid for and not received.
