Complaint: ***: I am rejecting this response because, from beginning to end, it is a collection of falsehoods and, in several instances, out-right lies: - "I apologize for the length of time that it took to complete the job.": an apology was never offered to us and, after five (5) weeks and as noted in the original complaint, the job is still SEVERAL WEEKS FROM BEING COMPLETED!; - "...due to circumstances beyond my (*** Const.) control it could not be helped.": our homes' only bath/shower was completely torn out without an endgame in hand; all of the materials needed to complete the job should have been ready and available for installation prior to tearing out our shower! We were given assurances that the shower would be completed and ready for use within two (2) weeks and that the entire job would be done in three (3) weeks. Work began on Monday, August 15, 2016, with an expected completion date of September 3: this constituted the three week period prior to the Labor Day holiday;- "I Went above and beyond to make this project look better*. The homeowner did not give me the information that I needed at the correct time, when I requested it.": this is an outright lie! Case in point: there are several, but we can start with the shower hardware, as detailed below;- "Dust barriers were installed per contract, ": A) the contract called for "1/4" Masonite on (the) front porch"; this was never done, the result being that dust, grit and bits/chunks of plaster made their way beyond the tarp and on to the porch floor; B) merely a single layer of plastic film was put in place over the doorway into the bathroom/work area: in mid-August, with the A-C on, no affected vents were covered or closed (until Day Two, when I covered those affected); at the end of the third day of work, Wednesday, Aug17, Mr*** told us that he was going to "give us a little break" on Thursday & Friday, stating that his employee (Mr*** was not on site on this day) told him that, to paraphrase him, "we seemed to not be taking all of the noise, etc., very well"; the truth was that I was visibly not feeling very well by Tuesday, but that was a result of the grossly diminished air quality in my home! (By the end of the week, even *** had had enough of the dust and purchased an air purifier, at least for our bedroom.) - "Dust is part of the construction business ...": from the contract, "-Prep area (with) drop cloths..." and "-Plastic for dust barriers as needed": clearly, Mr*** does not fully understand what "as needed" means! In hindsight, this shouldn't come as a surprise: Mr*** may not be discomforted by a heavy layer of dust permeating throughout the house, given his daily work environment and the fact that he is a heavy smoker. He is clearly acclimated to such heavy particulates in the air that he breathes. However, his clients should not be expected to have to deal with "dust (being) just part of the construction business..." to the extent that he exposed us on this job. 'Should also point out that during the entire time that his two employees were at work in an enclosed area that was thick with dust and debris, they did not have so much as a face mask or eye protection, never mind full-face respirators, to protect their eyes/nose/throat/lungs from everything that they were each inhaling throughout their work; - "The heated floor was discussed and not installed, per the homeowner. Instead a wall heater was installed as requested by homeowner...": again, an outright lie! After more than a week into the job, WE WERE INFORMED that the heated floor, which was a cornerstone of the project, could not be installed as contracted! Mr*** and I did a complete walk-through before he began work: it took him over a week, after he had already torn out the entire bathroom, to conclude that he could not (or would not) be able to install the heated floor? It was Mr. ***, then, who insisted, OVER OUR CONSISTENT OBJECTIONS, that he would install "a wall heater" as compensation. After he installed the wall heater, OVER OUR OBJECTIONS, it was made clear to him that it needed to be removed and not just for cosmetic reasons: the heater was placed in the south wall, A) immediately adjacent to the toilet in such close proximity to the commode (within inches) that one could be singed from the heat that it produced, or even burned by direct contact, and B) the heaters' location was such that it interfered with the installation of the toilet paper dispenser and to leave it installed as such, would have presented a fire hazard!; - "The Shower Hardware was strictly temporary ": AFTER FIVE (5) WEEKS?!; and when were we going to be informed of this "temporary" situation?!; - "due to the fact that their choices were on-line and back ordered at the supplier.": again, an outright lie! During the first week of work, we provided Mr*** with two items from ***'s web page. They are: *** Chrome eco-performance handheld shower, Model #***, MSRP $311.25; and *** Chrome two-function 8" diameter spray head eco-performance rain-shower showerhead, Model #***, MSRP $247.50. As I am writing this, as was the case prior to August 20, BOTH of these items are IN STOCK and ready for purchase at either *** *** or *** (as well as two/three other vendors); the posted price for each model is the same at both vendors: *** = $(

I apologize for the length of time that it took to complete the job.  Unfortunately, due to circumstances beyond my control it could not be helped.  I even, personally, work more than 1 Saturday to try and keep this project on time.  I went above and beyond to make this project look...

better.  The homeowner did not give me the information that I needed at the correct time, when I requested it. Not receiving the information when needed, partially delayed this job.  Dust barriers were installed per contract, tarps for covering the floor from front porch, sidewalk to the entry of the bathroom.  Cleanup was done every night to avoid as much dust as possible.  Dust is just part of the construction business when you're dealing with plaster and concrete on a re-model.  The heated floor was discussed and not installed, per the homeowner.  Instead a wall heater was installed as requested by homeowner and then the next day removed again at the homeowner's request.  The Shower Hardware was strictly temporary due to the fact that their choices were on-line and back ordered at the supplier.  All of the tile was chosen or approved by the homeowner prior to installation.  I was told to get a ‘gray Granite’ by the homeowner which I did and it was approved by the homeowner prior to installation.  The vanity was started and cancelled by homeowner.  The remaining 2 showerhead fixtures can be installed by anyone else, as well as the vanity.  There is more than enough money left on this project.  The toilet was purchased by the homeowner and was only installed, correctly, by my company.   We were unaware of the make and model of toilet the homeowner had ordered ahead of time, prior to our installation of the toilet.  Regarding the water leaking into basement, this was due to their first floor vanity drain, which was not part of the contract.  The first floor vanity drain was clogged, we were completely unaware of this situation as it was not part of the work or brought to my attention by the homeowner. The homeowner did not mention it to me ahead of time.  If the clogged drain was mention prior to, this problem could have been avoided entirely.  However, the homeowner screamed, yelled and hollered at one of my employees and told us to leave.  At this point I assumed he was going to get someone else to install the vanity and install the 2 showerheads.  The homeowner stated to my employee that ‘you’re fired’.   I do not tolerate the verbal abuse of my employees or myself.  This was a very hostile work environment.   I do apologize for any inconvenience this may have caused, whether it was my fault or the client’s fault.  l us why here...
