Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
[To assist us in bringing this matter to a close, we would like to know your view on the matter.] April 5, 2017To:  Revdex.comFrom:  John S. [redacted]Regarding:  complaint ID [redacted]  Dear Revdex.com, I disputed the two $79 charges with my credit card company.  I did not dispute the $28 charge, which was for the paper I ordered.  Constitutional Health has record of this.  Constitutional Health eventually refunded the second $79 charge, but only after I filed the dispute with my credit card company.    The did not refund it as they described to you. Constitutional Health is required to send an email to the consumer notifying them that a charge took place when money is withdrawn from their credit card.  For the first charge this was never done.  Constitutional Health has not provided any proof of any kind that an email regarding the first charge was ever sent to me.  I was emailed when the second charge was withdrawn, but not the first.   I didn’t use the membership (i.e., never logged in) and did not know I was being charged until the time of the second charge. When you order a paper from Constitutional Health there are check boxes that come up during the check-out process that must be checked by the consumer or they will be automatically signed up for a self renewing membership that is $79 per month.  This type of scheme is called “negative option billing.”  Granted, they do require that the buyer check the “I agree to the terms and conditions” in order to get the paper, but not everybody is going to read all the terms and conditions nor is everybody going to bother to read what is beside all the check boxes.  Such was the case with me. This excerpt is from the Constitutional Health web site: Terms & Conditions: Your credit card statement will read Constitutional Health or a similar descriptor together with our customer service phone number. Free 1 month subscription for the Constitutional Health Platinum Reports is provided for the first 30 days. If you accept the membership offer, unless you cancel before the end of your 30 day free period, the card you provided when you ordered will be automatically charged $79 (plus tax if applicable) when each 30 day period ends. To cancel future payments for the newsletter, you must email us at [email protected] at least 1 day prior to the date that your next monthly subscription payment is due.  I UNDERSTAND THIS CONSUMER TRANSACTION INVOLVES A NEGATIVE OPTION AND THAT I MAY BE LIABLE FOR PAYMENT OF FUTURE GOODS AND SERVICES, UNDER THE TERMS OF THIS AGREEMENT, IF I FAIL TO NOTIFY THE SUPPLIER NOT TO SUPPLY THE GOODS OR SERVICES DESCRIBED. BY PLACING MY ORDER, I PROVIDE MY ELECTRONIC AUTHORIZATION FOR FUTURE CHARGES AGAINST MY CREDIT OR DEBIT ACCOUNT UNLESS I CALL OR EMAIL TO CANCEL.  *"Done With Diabetes" is the name of our book and a registred trademark of Constitutional Health, and not a claim. There's no guarantee of specific results. Results can vary. [redacted] This company deceptively lures people into buying a $79 membership, then doesn’t let them know they are being charged until it is too late to do anything about the charges.   In the interest of the public, this company should eliminate their negative option billing, and refund those of us who fell victim to it.
Regards,
John B[redacted]
