Complaint: ***
I am rejecting this response because: I had a board certified construction attorney who was involved in 100% of the case from November 2015-Feb 2016, up to the point where the arbitrator failed to render the award in the contracted day time frame (also mandated by state law)It was at that point I launched my first complaint with the Revdex.com and realized I had paid $in attorney fees all due to challenges and inconsistencies by CDRS, in addition to continuances by the arbitratorI notified my attorney in Feb to be on "hold" so I wouldn't incur any more legal fees unless I reached out to him for additional helpIt is a pure assumption by MrM*** that my attorney and I had anything other than a positive working relationship. My attorney had in fact mentioned on many occasions how inconsistent Peter M*** was and how his stories changed frequently, even through emails between partiesMy attorney wasn't fond of dealing with Peter M*** and had to step in a couple of times to challenge M***'s decisionsTherefore from mid Feb-March I chose to represent myself in the interest of saving money. In regards to the Colorado Uniform Arbitration Act vsthe CDRS rulesCDRS Rule Ait states: "Rule of Procedure in Conflict with Law: If any rule or procedure, part of a rule or procedure or modification or change of a rule or procedure shall be found to be in conflict with any provisions or sections of applicable law, that applicable provision or section of law shall govern and shall supersede these rules and procedures." Therefore by definition the rules Peter M*** favors actually mandate that the law of the state in which the arbitration takes places takes precedence over his rules of arbitrationI had explicitly explained this and pointed out Rule Ato him, however he refused to acknowledge and in doing so refused to follow the arbitration law in the state of Colorado which would have provided a positive solution for both parties in the arbitration. If he had done so, then I would not be here today making a complaint as the law would have guided the proper process, and the obviously inexperienced arbitrator who was seemingly unaware of the variances of the law as compared to the CDRS rules and contract How Peter M*** has managed to provide arbitration services to so many home warranty companies and boast of his success isn't a mysteryThere is a direct referral in the home warranty contract (ours was 2-HBW) for CDRS, thus the customer only has one of two choices for arbitration companies"I'll scratch your back and you scratch mine." And mind you, Peter M*** trains the arbitration administrators of the home warranty companies directly as he did the administrator of 2-

Mrs*** trued to act as her own attorney in this legal arbitration case. She had not idea of how the process really works. She did have an attorney at one time and eventually fired him I believe because he would not follow her instructions as opposed to taking his advice. Mrs*** kept insisting that CDRS follow the Colorado State Arbitration Act. She had agreed to follow the CDRS Arbitration Rules and Procedures but didn't want to follow them when she liked the Colorado Rules better. CDRS is the largest exclusive provider of construction dispute services in the USA with Arbitrators located in all states, Washington DC and in several foreign countries. We didn't get to be #by not providing our professional services properly. However, Mrs*** seemed to think that she knew best how to conduct the arbitration process. I will not continue to point out all of the misconceptions and mistakes on Mrs***'s part. She insisted on having things her way. I must also point out that The Arbitrator and Arbitration Provider (CDRS) must remain neutral and can't have any bias towards one of the Parties. CDRS purposely did not share some of Mrs***'s emails with the Arbitrator as we wanted the Arbitrator to render his decision based on the merits of the case and not on the pre-arbitration communications with parties who were uncooperative. When Mrs*** filed her first complaint with the Revdex.com, it was in the middle of the arbitration process. At that point, I shared the complaint with the Arbitrator and we both made the decision that we no longer could remain neutral and had developed a negative feeling against Mrs***. At that time, we disqualified ourselves from being able to continue on as the Arbitrator and Arbitration Provider. This will be my last reply to this complaint. If you wish this case to continue, it will be without CDRS further participating in this case

When this complaint was first filed with Revdex.com, I talked to someone at Revdex.com who said to forget about the complaint as we are Arbitrators and this is not the type of complaint that you handle.  In almost every arbitration case, one of the Parties is not happy with the Arbitration Award.  This...

case was a whole different set of problems as I discussed with the Revdex.com representative. I don't understand why I am receiving this email.  What do I need to do to end this endless process?
