Complaint: [redacted] I am rejecting this response because: Sellers response, Is extremely deceivingWhat we had to go by was the email that we sent youThe email clearly states all brand-new product scratch and dent/overstockWe had multiple conversations with Mike, over the condition of this loadWe were assured verbally, that there would be a few returns on the load but this load would not be full of returnsSeller states that there would be some new items on this loadSeller claims to know what is on the loadHowever, by her own admission, they have never seen a loadWe expect a seller have enough integrity to stand by their own claimThey claimed the load was all brand-newThat is what was sent to us Sellers email, is unacceptableBusiness practice is at worst deceitful, at best ignorant This is a clear case of bait and switch We were promised something we never receivedFurthermore, on the manifest was a great deal of printer ink, we contacted the seller, and let her know that this it was all usedIt's nothing but trash Experience has nothing to do with processing this loadOur vendors who purchased this load from us, can do nothing with this load We have contacted the New Jersey consumer protection agency, and we will be pursuing legal action against this company In the years of doing this, this is the worst load I've ever seenIn fact, this is the worst company I've ever dealt withThis is a company who will not stand behind their items, nor treat the customer with any respect Regards, [redacted] ***

We do not create the values on any loads and we do not create the manifests, we don't have a warehouse to do such a thingWe buy directly from the department stores and their facilities and We are sent manifests from the stores and people are told to never trust a manifest 100%, it states this in our purchase termsA Manifest can be off some, this particular load had extra in it and all is not broken The values are MSRPFor Someone to get a load valued at $500,and pay ONLY $28,and to expect all items working is a bit muchWe also sell the new product version of theses loads and they buyer declined because they are un-manifested and he insisted he could not buy without manifest and needed a manifest even though Mike told him to expect returns as shows in the email sent We offered to work it out going forward and the vendor offered a load at a 15,discount and client refusedThere really isn't anything further we can doScratch and dent definition from our website as posted on our website as posted directly on the product in questionFull Definition: http://www.247wholesale.com/Truckloads/Best_Buy_Electronics_Wholesale_Truckload >>>>>Awesome New Electronics Load...These loads are a great mix of product from a variety of stores like [redacted] ***A percentage of items will be brand NEWThe remaining units are similar to our usual lots (scratch dent, missing accessory, parts only)Electronics, Automotive Supplies/parts/ Computers, Cameras, General, Etc Lot consists of new, returns closeouts, open box, shelf pulls, etcThese loads are considered scratch dent with a lot of great value.The best way to describe these loads would be 1/working, 1/fixable / needing TLC and 1/good for fixable partsThese are imperfect, low end to high end productScratch dent that cant be put on the shelf as newAlso in this load are items that were on shelf for days and did not sellGreat MixYou name it, you can see it in these loadsThese are awesome loads for the "Experienced Buyer." I am rejecting this response because: "Scratch and dent" is different from smashed, broken, unusable products. I viewed this load personally the day it arrived and have been assisting with processing the load ever sinceThere is not a need to test a tablet or cell phone that is missing the battery and has a broken screen....these have NO valueThis company has inflated the value of their load by putting in items that have absolutely no value and then listing them on a manifest, such as full gaylords full of USED/RETURNED printer ink(What re we suppose to do with this?) The email in question states "so there will be returns on there.." Every load that we have purchased from other vendors has some returns, this is expectedWith EVERY communication we had with this company, we made it very clear that we did not want a load that was full of returnsI have attached the original email from this companyYou will notice that the way this load was presented, and consequently what we believe we purchased was, "All brand-new product majority of items are scratch and dent/overstock"We spoke with Mike on the phone to ensure this was the caseWe were very clear we didn't want a load of returnsThey knew this and pulled a "bait and switch"What they presented and what we received(we have many pictures to back it up) are two different thingsWe have also included the Manifest of what was claimed to be on the loadThis isn't even close to the factWe have processed the entire loadFinally, the owner Christine shared that she put an additional 80-90K worth of items on the load once she viewed it in the warehouseShe admitted that she noticed damage and was trying to make up for it by putting additional items on the loadIf the load was what they claimed it to be, why did they feel it necessary to add anything?We have found minimal value in the loadHowever, this is clearly a case of misrepresentationWe have contacted the consumer protection agency for the state of NJRegards,

customer was clearly told it was returns and has not tested any products, they are under total assumption that items do not work when their is more than 150k of brand new product. The load was a scratch dent return load and was sold as such and email to client says exactly that. In the matter of two...

hours they claim to have tested 40 gaylords holding nearly 500K in product in which they paid $28,500.00  I'm sorry they are disappointed however they have been ill informed by their buyer and not by us.  Client was given the option to buy all new without manifest and declined, he wanted scratch dent load even after being informed it was returns.  What he told his customer has nothing to do with us, we represented correctly. Please see attached email.

We expect a seller have enough integrity to stand by their own claim. They claimed the load was all brand-new. That is what was sent to us.  Sellers email, is unacceptable. Business practice is at worst deceitful, at best ignorant.  This is a clear case of bait and switch.  We were promised something we never received. Furthermore, on the manifest was a great deal of printer ink, we contacted the seller, and let her know that this it was all used. It's nothing but trash.   Experience has nothing to do with processing this load.
