December 11, 2014 Good Afternoon, I am in receipt of the customer complaint letter for property: [redacted]  (ID#[redacted]). CPI was contacted by [redacted] (buyers agent) on June 4, 2014 and a full home inspection was ordered at that time.  NOTE: A warranty...

service contract and duct scope were notordered.  The inspection was performed on June 14, 2014 at 1:30pm.  Upon completion of the inspection, it was delivered via email to the listing agent, buyers agent and title company. Upon visually inspecting the furnace, it was determined that the heater did cycle properly, the blower was balanced and carbon monoxide was negative at 113ppm.  Also noted and clearly stated in the inspection report was the fact that the system utilizes in floor ducts, most of which is not visible. Therefore, on the inspection report itself it states: "In floor duct work is not part of CPI'S mechanical inspection.  If you would like an in depth look at the condition of the ductwork call CPI at 505-345-7878."  CPI always puts this language on inspection reports of houses that use in floor ducts as duct scopes are typically the only way to thoroughly inspect the duct system without dismantling etc.The agents received the report on June 14-a full two months prior to closing and had ample time to review the inspection report, including all language, notes and disclaimers.  In doing such review and recognizing that ducting cannot be inspected completely without the use of a camera, one may be inclined to order or at least consider ordering a duct scope.  Contrary to the complaint, CPI DID disclose its disclaimers, (not prior to the inspection which is not commonplace) but certainly 2 months prior to closing!!  All parties who received the report had 2 full months to review the entire report, including disclaimers and comments pertaining to ordering a duct scope.  Also, I respectfully disagree with the complainants idea of the intent of the inspection-As stated very clearly on the top of the inspection report-"This inspection does not reflect the condition of the property and is done solely for the [redacted]efit of the Company to determine weather it will issue is Service Contract and is not to be relied upon by any persons, whether an owner/seller of the property, a buyer of the property or a real estate agent, whether listing or selling agent."In summary, the purchaser and/or their agent(s) had the knowledge as of June 14, 2014,  that the duct work was not inspected and was not part of a CPI's mechanical inspection.  Still, the transaction closed two months later on August 15, 2014, without a duct scope ordered. Finally, CPI takes exception to being referred to as a fraud. CPI has been in business for 37 years and have a good reputation in the community.  I would strongly suggest that the complainant get their facts straight before accusing CPI of being fraudulent.  Also, being each house is different and unique, it would be virtually impossible to "disclose disclaimers" without having inspected the house first.  Sincerely, [redacted]Consumer Protection, Inc.
