Cooley Construction was hired by us back in May of 2019 to complete a new home construction due to a complete fire loss. We have had MANY issues with them including but not limited to many windows installed crooked, windows with deep scratches on them, wavy and uneven floors, walls, and beams. The house still looks like a child did the dry wall and painting. They are refusing to take care of the problem and have now told us to just keep the remaining $7,000 that was to be paid to them upon completion and deal with the issues ourselves. We have gotten estimates in order to fix our home and it is going to cost around $12,000. Cooley Construction refuses to pay the difference or correct the hundreds of issues with our ceilings and walls in our brand new home.

We have completed the house with some drywall issues that need to be repaired. I sent the final bill and explained that the drywall work falls under warranty work. *** told me she wasn't going to pay anymore money until the drywall was repaired and she expected to not be satisfied with the drywall work after it was repaired and that she would have to use the money we were owed to pay someone of her choosing to redo it again. I suggested we skip the part where I send someone else in and she just keep the money to pay someone of her choosing now. The total owed to Cooley Construction Co, LLC at this point is $7,688. *** allegedly called a few contractors and sent me a message stating the prices she got were between $10,000 and $11,000. What she didn't realize was that one of the contractors she called is a contractor we usually use, ***. When I asked him to give me a rough estimate, his price was between $6,000 and $7,000, which is what I had gotten from another contractor, and what is the industry standard price of $0.45 per square foot for drywall mud repair and painting that I expected. When I talked to *** and heard the way *** talked about our company, I knew there was nothing we could do to make her happy, so I told her we were going to move on and she could keep the rest of the money. She then informed me she was going to look into legal options. I contacted a lawyer who advised me to stop all communications and contact at that point. Within hours I was notified of Mrs. Mish posting things on Facebook to discredit my company. She pointed out that there were some issued with our work, some of which had never been brought up, but most of which we had fixed as soon as we found the issues. On top of all this, we have bent over backwards to help the Misch family. We allowed them to move into the home months early so they wouldn't have to continue to pay rent, which cost us a lot of time and money. They went over budget on several categories totaling well over $8,500. Part of that was a typo on the estimate which I pointed out when I sent but was apparently quickly forgotten, some was going over budget on plumbing fixtures, lighting fixtures, and concrete/excavation, and a tub that we got authorization to buy from *** that *** didn't approve of. We bought another tub with the understanding that Mr. and *** would be charged. Since then they have made it clear that won't happen. We stand with our position to sever ties and let them keep the money to make the necessary repairs but will not be giving them any more money. If they feel like $12,000 is reasonable, that would bring the total they owe us to $4,188.

I am rejecting this response because:

Cooley Construction NEVER sent us a final bill. *** sent a text message informing me that he "had some debt that came up from another job and would like to have $5,000 of what is left to cover it". I told him that I did not feel comfortable paying him that since that money was due upon completion and there was still several things that were no completed. The amount left is $7,688 (which is the final amount of the general contractor fee) and is suppose to be paid upon completion. Cooley Construction had several sub contractors in our home as well as one of the owners of the company off and on for months "fixing" the drywall and paint issues. We had to deal with drywall dust inches thick covering everything in our home several days a week, for months. They didn't even put drop clothes down or anything to protect our floors or furniture. There is paint splatters on everything. Our floors looked speckled! All they were doing was trying to "patch" work and "spot" paint. We have now had 3 different professional drywallers and painters come to our home to look at the issues and give a bid to fix it all. The *** gentleman that Cooley is referring to was one of them. I was aware that he had done work for Cooley before and he gave us a quote of "around $400 per room plus $800 for the garage" which totals $8,000 just in drywall repairs. He said that it was a very large job and there was way too many repairs to make so he wouldn't be able to get us on his schedule. The cheapest paint bid we have gotten is $4,500. So $8,000 plus $4,500 is $12,500 to address the issues. Two of the drywallers we have had in our home have said that a lot of the walls and ceilings are so badly messed up that they won't be able to fix them properly, they will only be able to make them look a little better. I am happy to provide pictures as well as written estimates from the professionals that I have had in my home. The so called overages that he is referring to was $6,000 in insulation that he under bid. I have all of those text messages as well. He admitted that it was his error and that he would "eat it". The tub was never approved by my husband and Cooley never supplied an invoice for the tub. There were no plumbing overages reported to us. We were told there was an overage on concrete in the amount of approximately $1,500. *** admitted that they were losing money on our job because of all of the sub contractors poor work. That is not our fault nor our problem. We also have a picture window that remains damaged that they were suppose to replace. As far as us moving in early goes, we had a house fire and were living in a rental house when Cooley was building our new home. We signed a contract in May. They told us then that it would be competed by February at the latest. In November our insurance company let us know that we were out of additional living expense coverage as of Jan 1st. We spoke with Cooley Construction at length about this and they assured us it would not be a problem and that they would focus on getting the upstairs completed for us to move in to in January. Come January the upstairs was not finished. We had no counter tops in any room, no sinks, only 1 working shower, etc. We made do with it for almost 2 months before they finally got those essentials installed. The whole experience has been one nightmare after another.

They need to pay the additional money that it is going to cost us to "cover up" their ridiculous work and also replace our picture window, having it installed by a professional window installer that won't install it crooked like Cooley did almost every window in my house. They can even pay the drywaller and painter directly if they would like, but the bills need to be theirs to take care of, not ours. This is over a year later and our brand new almost $400,000 house looks like a kid built it. This should be corrected in a TIMELY fashion!!!

Side note: Yes we have been talking badly about their "company" because they did very poor work and haven't taken care of their customer. The work speaks for itself. VERY sub-par. I will supply pictures on Facebook as well so that everyone can see it for themselves. Fix the issues.

We are finished.

I am extremely satisfied with the quality of work that *** demonstrated. We had a new roof put on as well as siding, gutters, soffit/fascia and a French door. They were able to begin work earlier than expected and completed the work sooner than expected. Excellent workmanship and professionalism. I would highly recommend them.
