Response to complaint by *** *** ***,aka: *** ***, aka: *** * *** ***On 10/23/2015I *** *** was contacted by *** *** in regards to an estimate for all the suspension parts | manufacture to go under a stock body Volkswagen BeetleI sent an estimate the same dayI then
received a number of emails and phone calls in regards to further details that he had for his buildIn one such email he stated on 11/23/2015,"Hey ***Remember that I will be running 17Xwheels all the way aroundI wanted to run the narrowed version of the front end and not sure what we need for the rear as far as width goes.***"(Original email asking for this with our "Narrowed" suspension kits included in envelope for your veiwing)In response (durring a phone call) to this I explained since he was planning to run on wheels known as "Wide 5"wheels, not the on 130mm Porsche pattern he now has, that he would need narrowed for the rear suspension to make room for the additional width of his brakes for the on wheels.On 12/02/15*** contacted me via email to talk via phone about building complete chassis for him.We talked later about taking on the entire buildHe expressed feeling of not getting what he paid for from the current builder and wanted to ship his pan to me to complete and tun into a complete chassis that he could simply install his bug body on when shipped back.Durring this phone call we talked about the NEW wheels he wanted to orderI explained I could either change the estimate to reflect the use of our standard width arms to work with the NEW wheels with out the use of billit aluminum spacers like the ones in the attached picture or if he wanted the option of changing wheels to different offsets in the future he could simply use 1/spacers like the ones Porsche usesHe agreed and there fore we kept the estimate reflecting the Narrow rear arms.12/08/2015I was asked to provide wheel sizes that we normally work with for a VW Beetle to *** @ fifteenwhich I did via emailYou'll notice in the email I gave a range of offset so that the wheel could be made and a spacer could be used to propperly locate wheel.03/16/2016Around this date I received call from ***, telling me he wanted to look into changing the bulld from a beetle chassis to a Porsche coupe kit car build as he was having p***lems having this much money invested in a beetle buildI then spent endless hours and time checking into Porsche coupe kits that were availableAfter finding the best I could I re quoted the estimate on 05/27/Including a list of everything we had of hisHe emailed back later that day with an opening statement of"OkayLet's do itWe're going to have to finish the pan and not get the body for a couple of months, I need to save somemoney after buying that Noval"(orignial email also included)10/04/2016I recieved a phone call from *** telling me he wanted to stop the build due to financial reasons and the loss of interest in the buildHe asked if we could not performan some of the detalls in a way to cut costI email him a way wecould help cut cost for him(See attached email from this date)10/08/2016*** emailed me back a proposal and took full responsibility for all the changes and asked if we could agree to his proposal(see attached email)10/10/2016*** emailed me thanking me for everything and sald he intended to build this chassis with his son and place a 1959W beetle convertible body on itHe also praised me on being a good friend and helping him so much(email available on request.)He had also agreed to pay the unpaid balance of over $13,dollars by the end of October 2016.11/02/2016I sent a reminder email for full paymentIt was nut until I sent a registered letter of demand for payment on 03/38/that I was finally eble to get paid in full for work performanedFinal payment was paid 04/and parts were finally picked up in 08/2017.08/22/2017I recieved an email from *** with a list of missing parts, which I promply replied and sent out missing parts and parts that were not paid for as a way of saying sorry for the missing parts.At this time there was NO mention of the dust caps (he calls center capscenter caps are part of the wheels) for the brakes or fan belt.08/24/2017*** sent another email saying he was also missing the center capsI called him later and discussed with him that the billet center caps would not fit under his wheels as the caps were made for cars not running the center caps of their wheels, and that he would need to use a set of stock steel OEM caps that I do not provide as part of his kit.After a few weeks he decided he now wanted these caps and an extra fan beltI explained to him he would need to pay for these in advance including shipping during another phone conversationTo date he has not paid for these and continues to ask for themIf I send out parts for free I will not stay in business.Possible solutions to "center caps and bet":1) He purchases a set of OEM Volkswagen caps, part number B2) He purchases a set of the billet aluminum ones from me with a written letter he understands that he will not be able to use his center caps that came with his wheelsCost of caps is $for the pair.3) He can send back the entire CoolStop brake kit for a full refund minus shipping charges.When the Brake kit is received complete and in new condition I will refund the original amount charge $1395As far as the fan bett:1) I will provide him with the part number so he can buy a replacement at a parts store like ***, ***, *** ***2) He can send back the entire Porsche cooling system kit for a full refund minus shipping charges.When the Porsche cooling system kit is received complete and in new condition I will refund the original amount charge $1595As far as the wheels:I was asked back in to supply information for the proper size wheels to fit a Beetle, not a Porsche body, or later a bug convertible, all of which take slightly different wheel sizesThe customer changed what vehicle the chassis I was building for him multiple times and was told that he would have to use spacers or have the wheels rebuilt in He agreed multiple times to using spacers so that he would not have to pay to send them back to be rebuilt with different offsetsThere for I do not believe I am responsible to pay anything toward the rebuilding or replacement of his wheels.The spacers look just like the brake hubs and are a safe correction when used in this adjustmentThey are DOT (Department of Transportation approved)Here is a link to a set currently for sale*** ***They cost $and you will not see them once installedWe use these type of spacers all the time to help customers supplied wheels fit propperly.Total cost of the above items would set Mr*** back:1) OEM dust caps.....$6.002) Cooling fan belt....$19.003) Spacers for wheels...$27.00Total of $plus shipping.If he has troubles finding these I will purchase them on his behalf and ship them to him free of charge, However I demand a leter of intent to Cease & Desist, no longer prosue any additional actions like this to cost me time and money in any relation to his purchase from CoolRydes So-Cal CustomsThis includes current or future legal action.Sincerly, *** ***
