Each time he said that is correct, I will not rent to you and I will not send back your depositI explained to MrC, you cannot take my deposit and refuse to rent to me and not send my deposit back, he then asked me what I thought a fair amount of money he should return to me, I said If you will not rent to me then I want all my deposit back, he suggested 1/the deposit, this negotiation went on for several minutes, I said send all my deposit back or I will seek action against him, he said it would cost me to much to do that and he didn't think I wouldI still need to find a place for those date's, this is not something I can cancel Your chances are running out, send back my full deposit now, At request of the rental company, I have sent you a mail through there site, and called and left message on your answer machine, they are now going to deal with this matter with you and I will follow closely to completionAnd continue with steps to recover deposit and damages

Cooper's Cottage has attempted to reach an amicable resolution to the matter with MrB., however, due to his insistence on a full refund, we have been unable to do so. MrBdid request to add days to his stay but could not say when his job would start, or when it would end. We cannot make or hold a reservation without a starting and ending date. Based on his cancellation of the rental agreement, his unwillingness to pay the balance and deposit in the time frame outlined by the agreement, and his inability to commit to the dates and duration of his stay, we are indeed, unable to rent to MrB

The Facts
As we stated in our last response, Mr*** cancelled his rental contract on October 6th. As a result of that cancellation, Cooper's Cottage re-opened his reserved dates on the calendar, and rented a portion of the dates he had previously reserved. Therefore, because of his cancellation and the fact that Cooper's Cottage re-booked those dates with another guest, Cooper's Cottage could no longer rent to him for the dates in question.
In addition, MrBdid not pay the balance and indicated that he would not pay by the terms outlined in the rental agreement (days prior to arrival). Because of these actions MrB's contract would have been voided even without the cancellation on October 6th, the day he called to cancel and the day the final payment was due.
These actions (the cancellation and non-payment of the balance due) resulted in the forfeit of his deposit and cancellation of the original rental contract, as clearly outlined in the rental contract
Cooper's Cottage was NOT contacted on October 3rd by MrB.
MrBdid not deny cancelling his rental agreement while on the phone with Cooper's Cottage on October 7th. He indicated in the conversations on September 30th, October 6th and again on October 7th that he did not know the starting and ending points of his job, that something had changed in relation to the job.
The message from Cooper's Cottage concerning the deposit was left on October 7th in response to the previous phone call where MrBcancelled the reservation on October 6th
From our vantage point, it seems that MrBwas trying to cancel and re-book the rental to maximize his savings on a construction project that was moving dates on him. In every conversation - Sept 30, Oct 6th and Oct 7th - it was evident that something regarding the job had changed and he did not know when it would start. This was in stark contrast to initial conversations in which he requested a start date earlier than October 21st (which Cooper's Cottage could not do because of other reservations).
Cooper's Cottage could not continue to block out our calendar for MrBwithout starting and ending dates to the rental.
If the dates of MrB.'s construction project were subject to change, he willingly signed the agreement with that knowledge and understanding. Again the terms of the rental including the dates, the cancellation policy, and the payment terms were clearly outlined in the rental agreement which MrBsigned. Cooper's Cottage has followed those terms exactly as outlined. MrBcancelled on October 6th, days prior to his arrival. See excerpt #below.

Issue Resolved with Advertising Agency
Our advertising company suggests that owners use a day cancellation window and then penalize guests if they cancel within days of arrival. Cooper's Cottage has a generous policy at days, and attempted to reach an amicable resolution to the matter with MrB., however due to his insistence on a full refund after his cancellation well beyond the day window, Cooper's Cottage was indeed unable to do so
Our advertising company considers the issue resolved, and Cooper's Cottage has received correspondence indicating such after Cooper's Cottage sent them the same information as we have sent the Revdex.com. Here is their response:

Refusal to Rent
In the conversation on October 7th, MrBdid ask to re-rent Cooper's Cottage, after Cooper's Cottage indicated that his cancellation had voided the original contract. However, Cooper's Cottage is not willing or able to enter into another contract with MrBbecause of the following reasons:
1. MrBdoes not have a starting and ending date of his construction job and as a result cannot give succinct dates for which he needs the rental. We cannot write up a contract without starting and ending dates. Without a contract and deposit, Cooper's Cottage will not block off dates on our calendar or turn down other potential renters. This reason alone would be enough for us to "refuse" to rent to anyone
2. A portion of the dates MrBoriginally contracted for have been booked, after he cancelled the original agreement
3. MrBdid not pay the balance of his rental contract by the time frame in which it was due.
4. MrBhas cancelled a 70+ day rental agreement. This represents 20% of the potential booking days for a year, and thus our potential income. Cooper's Cottage cannot risk a potential annual revenue loss of 20% with a renter who cannot commit to dates, does not pay the balance on time and who insists on a complete refund when he is in obvious violation of a contract
MrB.'s complaint and his account of the situation makes little sense because he leaves out a very important detail - he cancelled because he does not know the dates that he needs to reserve. There is no motivation on our part to spontaneously cancel a reservation for 70+ days in order to garner one for nights. Cooper's Cottage cannot expect to rebook the whole 70+ day time frame MrBhad reserved this close to the rental period. Cooper's Cottage does not feel it would be a good business decision to risk losing more potential revenue with MrBsince he has communicated multiple times that he is no longer sure of the time frame of his job. Cooper's Cottage has followed the terms of the contract MrBhas signed and feels that MrBsigned the rental agreement with full knowledge of those terms, which is why he called to cancel on the day the payment was due (October 6th)
Cooper's Cottage had already reserved the 70+ dates of his rental for over days (from the initial email reservation on Aug 31st to the day of cancellation). days is a substantial portion (20%) of our potential income for the year, since this is the ONLY rental unit we have.
Cooper's Cottage turned down rental inquiries for MrB.'s intended stay in addition to blocking out the dates on our calendar where we no longer show up as available for the time frame. These inquiries alone total rental revenue above and beyond the amount of MrB.'s deposit that we have forfeited to hold his reservation

The details and facts are not as you describe, I did not want to cancel, I wanted to move dates and when that couldn't happen I asked how much to cancel
After you said all my deposit " over $1100.00"
I said I wanted to keep it, you agreed
Later that day your husband called back, said I couldn't keep it, said he rented to someone else that first weekend, I told him that was fine cause I wouldn't be there that first week anyway but still wanted to rent with agreed time even though he double rented itI needed it for months after that, that's why my deposit was so high, he said no to ever renting it and he would not rent to me or give my deposit
You and your husband set me up, took my deposit of $-25% for months rent then refused to rent to me at all just because I requested time changes or cancellation costs
I still wanted to rent it and he said no-never, and no return on my deposit
We can go back and forth forever but the bottom line is you took my money for service then refused service
I was not going to send you more money after thatwho would?
I tried to work with *** on this and he said he would not rent to me at all and would not return my depositThat's a scamThat's what you did, I know it and you know it
