I do not plan to change my stance on this. They destoryed my property with out any consent. If they want to settle then they will need to pay the additional $for the tree clean up for the mess they left or I will take them to court for the clean up as well as the cost for the replacement of the tree. I do not plan on going back and forth on this any longer. The reason for the complaint is to make the public aware of how unprofessional this contractor is and avoid doing business with this company with hopes this does not happen to someone else

Customer information:
[redacted] Excavation and Construction Company
Details of the matter:
Customer and his wife communicated with the Vice President of [redacted] Excavation and Construction several times about work to be completed at their...

property. The wife communicated with the Vice President several times on the phone and through e-mail about taking a tree down. The wife indicated verbally on the telephone with the Vice President that she would like to have the tree cut down. After the tree came down the husband called to say he did not want the tree cut down and would not pay the invoice for the tree removal. He also proceeded to say that he wanted [redacted] Excavation and Construction to pay for the removal of the stump and debris. The wife indicated verbally that she wanted the tree to come down. [redacted] Excavation and Construction contacted an attorney to discuss the matter and was told the verbal agreement between the wife and the Vice President of [redacted] Excavation and Construction was binding. The wife and the husband own the property together and each have equal right to request work to be completed at their property. [redacted] Excavation and Construction did not pursue receiving payment for the tree removal from the customer. The misunderstanding or disagreement or difference of opinion between the husband and the wife is the cause of this complaint and is not a valid complaint against [redacted] Excavation and Construction.

[redacted], Vice President of [redacted] Excavation and Construction received a verbal authorization from Mrs. [redacted] to have the tree cut down. There was also another witness in the administrative office for [redacted] Excavation who overheard this phone conversation. Mr. [redacted] later called to say he did not want the tree cut down. [redacted] Excavation sub-contracted the tree work to a local arborist. After several non-productive conversations with Mr. [redacted] Excavation agreed not to charge the [redacted] for the tree services. [redacted] Excavation paid the arborist and was forced to absorb this cost. Mr. [redacted] request for [redacted] Excavation to incur more unnecessary costs is completely wrong and inappropriate. The miscommunication about having the tree cut down is not the fault of [redacted] Excavation, rather a miscommunication between the consumers. [redacted] Excavation will not pay for the additional costs the consumer is claiming he paid to have the debris hauled away.

Review: Contractor gave quote for excavation and removal of a tree. Contractor started the work without permission from me and dropped the tree. He left a mess because I stopped him had no intention of doing the work. I had to pay another tree removal company to finish the work which costed $400.00 and contractor refused to clean up mess and finish the tree removal. I came up with a comprise but they had no intention of cleaning up the mess only if they got the excavating job. They destroyed my propriety dropping a 35 plus foot tree that I had no intention of dropping. Said they got a verbal but we never gave them permission. No written contact, and sent an email before they did work and did it without a response nor permission. I have decided not to take to court but want resolve on this if I do not get then I will take to court.Desired Settlement: 400.00 to remove mess they left tree trucks and 12' of tree still left stump was not taken care of that is another 400.00 in cost.
