On Thursday, March 3, 2016, the complainant applied for and was approved for a rental apartment at Coral Club Apartments. He was advised that like all other approved applicants for any apartment, that he needed to leave a deposit in order to...

secure a rental and that it was offered on a "first come, first serve" basis. That if he really wanted the apartment we required a deposit from him. The complainant advised that he would bring in a deposit on either Friday March 4, 2016 or Saturday March 5, 2016 to hold the apartment. Another applicant put a deposit on Saturday March 5, 2016. The complainant never made contact until Monday, March 7, 2016, when the complainant's girlfriend called the Property Manager. She was advised that the apartment was assigned to another approved applicant who gave a deposit on Saturday, March 5, 2016. The woman then hung up. Immediately following the telephone conversation, the complainant called. Not happy with what he was told, within 2 minutes arrived at the rental office angry. He was argumentative, spoke loudly and was disruptive. Unfortunately it had gotten to a point where he was asked to leave the premises. Upon refusing to do so, the Property Manager called the Police. The complainant left the property before the Police arrived.
The complainant acknowledged the requirement to place a deposit in order to secure the rental apartment at the time of approval, failed to do so and was offered to be placed on a waiting list for the next available apartment, providing he places a deposit.
Initial Consumer Rebuttal /* (3000, 7, 2016/03/10) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I do not accept this response because it is greatly inaccurate and full of falsehoods. At no point was I argumentative, loud, or disruptive. I also never refused to leave. When I did arrive at the office I was met by [redacted] where I simply asked for the owners name and number in order to speak with him about my options moving forward. [redacted] immediately stated "why" as I had previously mentioned in my original complaint. Once I asked for the information a second time I was asked to leave where I said I gladly would . At no point in time was I loud or disruptive towards the office manager as they do have cameras where this can be verified and proven. Also, I was never offered the option of being placed on a waiting list for an upcoming apartment due to the fact [redacted] was very rude and called the police before any such offer could of even been made. Also, my only reason for arriving at the property was due to the fact I was rudely hung up on via telephone by [redacted] when I was trying to speak with him about the matter and trying to gather options moving forward which failed because I was hung up on by [redacted]. So, I arrived at the office in hopes of speaking with the owner of the property like I had did that previous Thursday with no problems at all. For some reason, Feank took it upon himself to deny me the opportunity to speak with the owner about my options moving forward and also to inform him of how I was treated while trying to conduct business on his premises by his office manager [redacted]. At no time was I loud, disrespectful, rude, or angry as stated in Coral Clubs reply. That is simply and utterly a falsehood at which I am appalled that such an inaccurate painting of event would be portrayed when that is just not the case. It was also told to me that the apartments in question( a 2 and a 3 bedroom) would not be available until Tuesday March 8th 2016 for the 2 bedroom and early April to mid April for the 2 bedroom. When I was speaking with the owner via speakerphone with [redacted] present it was decided that I would come in on Tuesday March 8th, 2016 to look at the available 3 bedroom that would be ready that day( being Match 8) and a model two bedroom to make a decision on which apartment I would like to rent since the owner stated if I would have chose the three bedroom he would take [redacted] off the rent each month to entice me to rent the larger of the two options. However, when I called I was informed that both apartments had be rented out and currently being lived in which I was confused as to how when I was informed that one would not be available until this week and the two bedroom not until early to mid April. When [redacted] mentioned my bringing the deposit during our brief conversation on the phone on Monday March 7th I tried to ask him if I would have brought a [redacted] dollar deposit for an apartment that I had yet to see, and it was established that I was looking between two different styles of apartments at two different prices, which apartment would have been held for me the two bedroom which I was told would be available sometime in April or the three bedroom available the week of March 8th? However , this question was met with hostility and combativeness from [redacted] where I was promptly hung up on by him. Therefore, I went to the rental office as I was already in the area and asked for the owners information where I was met with more unprofessionalism and rudeness and unwarranted threats of having the police called on me. I honestly felt that Frabk may have only felt threatened by me or a need to call the police simply because I am a young black male. I was hoping this was not the case and simply a case of a rude employee who does not have good customer service skills. However, after reading the lies and falsehoods presented in the response by Coral Club that I was loud, argumentative, and refused to leave when I asked I can draw no other conclusion than that. I was never rude, loud, disruptive, or angry when I spoke with [redacted] on the phone nor when I arrived at the office as the property cameras can show. The only thing I did when I walked into that office was be a young black male and calmly and politely ask for the owners name and telephone number where I was met with rudeness and combativeness by [redacted] followed by threats of having the police called on me for no apparent reason other than my asking for the owners ' information. At no time was there any talks or information given to me about still submitting a deposit or being put on any kind of waiting list for an upcoming available apartment.
