I am in receipt of your letter dated 7/28//In response to Mr***’s complaint, I will respond to his points as made in the document
Payment Options: I would argue that my office manager (***) did not tell any patient that they can only pay with cash or via financingAt the bottom of
the quote they received at their first visit it states clearly that “Payment can be made with cash, personal check, Visa, MasterCard Discover, or AMEX”A copy of that quote is included (Per HIPPA policy the patient’s name has been redacted)So, it would be contradictory for her to tell someone they can only pay cashAdditionally, with financing I lose 2.9% of my fee or moreI believe the assertion to be an embellishment on Mr***’s part
Cash Discout: A cash discount was offered to Mr***, as it is to all patientsHowever, his fiance presented to make payment with a personal check yet still demanded a cash discountShe was made aware that cash meant cash and was dissatisfiedAt this point she called Mr*** who then phoned my officeMr*** used profanities and was verbally abusive to *** in expressing his displeasureShaken in response to Mr***'s abusive and profanity laden rant, my office manager contacted me and I instructed her to just give them the cash discount for the check and be done with it
I do not make it a habit of discussing bank/credit card charges in detail with my patientsI expect my office manager, and all employees to follow this policyThus ***'s reluctance to explain the charges we incur when accepting a checkHowever, given the circumstances I will explain our situationIn my office, due to losses from bad checks, we process all checks in excess of $or any check from a new patient using TeleCheckTeleCheck charges me 1.69% of the check amount, a per check processing fee, and then floats the money from anywhere between to days before it hits my accountThat is not the same as a cash paymentCredit card fees run about 2.20% to 2.70%In addition, I incur monthly rental fees on the equipment to accept credit cards and scan the checksThus, we do not treat a personal check or a credit card as cash

Deposit: The 10% deposit paid for surgery is non refundableThis is stated on the quote that was given to the patient and Mr***This is the price quote that she accepted and agreed and ultimately paid fromThis couldn’t be much clearer and I am uncertain why there is any dispute on this issueIt’s right there in black and white
Transfer of Deposit: In regards to the deposit being transferred to our spa side, when a deposit for surgery is made, it is for surgery and is nonrefundableAgain, this is clearly indicated on the bottom of the quoteThe patient knew this as did Mr***, as he states in his letterOur policy is and always has been that the deposit can be applied to surgery at any point in the future
Dysport: When the patient presented for her consultation, she indicated to my office manager that a competing office offered free Botox as part of her surgeryMy manager told her we would match that offer with a similar product, Dysport, if she had her surgery through our officeThe patient scheduled, and then as detailed by Mr***, cancelled the surgeryShe then presented after her cancellation for free DysportMy RN was made aware of the patient’s misunderstanding and asked *** to speak to herThe patient was unhappy with our explanation and voiced her displeasure*** called me and we agreed to offer the patient the Dysport for no cost but that she would forfeit her depositOr, she could pay for the Dysport and her deposit would still be intactShe rejected both offers and left
In conclusion, I am sorry that Mr*** is unhappy with the outcome of the cancellationHowever, my office policies were made known at both their first visit and Second visit, agreed upon, understood by his own admission, and upon cancellation, enforcedWhy the complainant does not understand that cash means cash, and nonrefundable means non-refundable is unclearBut cash means cash and non-refundable really does mean non-refundableI am also unsure of the rationale whereby she should receive a free product conditional upon having surgery when she didn’t have the surgery
In my opinion the patient was treated fairly and according to all stated and agreed upon policies, I feel as though Mr*** is owed nothingHer 10% deposit is still applicable to surgery if she elects to proceed

I am in receipt of your mailing dated 2-26-2015. I understand your desire to protect the consumer, but I do not understand this ongoing complaint.
This patients assertions are simply false. We dont file claims after the fact. Thats not how it works. She chose to file this claim on her own, My office didnt file any claim nor did we agree to assist her in filing a claim. In fact, she misled my staff member into giving her our tax ID number and the other necessary information to file it under the guise of needing it for FMLA paperwork. She is trying to manipulate the system, she knows exactly what she is doing, and I am having no part of it.
Let me reiterate that your claimant presented in consultation, was given her options, then she, let me repeat, she voluntarily chose to have her surgery as a cosmetic / self pay operation. That is indisputable and has all been previously documented. Whether or not she then files a claim on her own behalf has no bearing on me other than the fact that I dont appreciate her manipulating my staff.
She paid me $3000. I performed her surgery as she requested. She then got around $1,250 back from her insurance company. So, she got her surgery at a bit more than a 40% discount. You would think she would be happy with that. Obviously not, but that is not
my issue.
In my opinion, her complaint has no merit and she has no legitimate financial claim against my business.

I am writing in regards to the complaint filed by the above referenced patient.
This patient presented to my office June , 2013 seeking a breast reduction. She was presented with the option of using her insurance for coverage vs self pay or cosmetic. Insurance coverage can be difficult and...

time consuming to obtain and so this patient elected to proceed with surgery as a cosmetic case as she wanted it done asap. In other words, she told us she did not want to use her insurance. We proceeded accordingly. Her surgery was performed on June 14, 2013.
Thereafter, the patient apparently, unilaterally, filed an insurance claim for herself despite contracting with my office to do the surgery as a cosmetic case.
Because of her claim, [redacted] mailed my office a check for the surgery totaling $1292.66. I deposited this check and then immediately refunded her the same amount on February 19, 2014 as I had already been paid. She cashed that check.
Now, the patient apparently wants an additional refund. From my perspective, the patient made a clear, informed choice of one of two options, both of which were clearly spelled out to her at her consultation. She contracted with my office to proceed along as a self pay because she wanted her elective procedure done right away. We accommodated her request. After the fact, she reversed her decision.
My opinion is this patient has been treated fairly and has been refunded all monies to which she is entitled, almost a year ago.
If your determination is that she is due an additional refund please let me know and I will carry that out.
