We picked up approximately 20 pieces of furniture from Mr. [redacted] house on June 15.  He had contacted us and asked to consign some furniture to the auction house as he was moving to a different address.  At the time of pickup Mr. [redacted] was advised that the items would be sold at...

auction and the price would be dependent on what people were willing to bid for the items on that day.   He was also advised that there would be a pick up fee of $100 per hour for us to send a truck with two men to come to his house and pick up the items.   All of Mr. [redacted] items were sold between July and November for a total of $1,072.50. Retail value of an item is not relevant in an auction setting as value is determined by the buyers and what they are willing to pay for the items on that particular day.   Mr. [redacted] has been mailed checks for his proceeds minus the auction commission of 30% and the moving fees for the pick up at his residence.   When meeting with Mr. [redacted] at his residence, he was provided a contract which he signed.  The contract states that “All said goods shall be sold to the highest bidder with no minimum bid….”, “Items not sold after a good-faith attempt at Sale, shall/will be donated to charity or disposed of in another manner.”,  “Seller understands it may take 6-8 weeks to auction all items”, and “I have been clearly informed and advised, both verbally and by this instrument, that Corbett’s Auction House is an absolute auction and does not set or guarantee reserve prices, minimum bids, minimum opening bids or selling prices on any item consigned or offered for auction."Corbett’s Auction House provided the items for auction as presented, the items were advertised prior to auction on our website and three other websites.  While we understand Mr and Mrs. [redacted] were disappointed by the results of the auctions, we fulfilled our responsibility and sold their items to the highest bidder in the auctions.

I am rejecting this response because: They misrepresented their service and feel they were allowed to give away our good, new and quality made furniture for next to nothing. They said no inventory sheet was given to them, which it was on day of pickup and to indicate the cost of all the items which we did.  They were not only late in auctioning items they were late in payment. The service they offered does not reflect at all the results they say they got from our things. They rely on their contract to give away your items rather than showing any duty of care to you as a client who have entrusted them with your items. They outright lied that we did not provide an inventory because they then itemized the things they sold for pennies on the dollar and any of the other items they forgot about they just said they gave them to chharity. When we started seeing through this dishonesty of the service they sold us on we indicated we would pick up all items that were not sold. They did not get back to us at all and sent us tiny checks saying they sold the items  and the couches in particular for a 5-year old [redacted] furniture 3 piece set for $5 when it cost us $1200 and originally listed for $3900. As I told the owner Sunny, if she couldn't sell the stuff for its tax deduction value of circa $3000 we would donate it to a charity who was willing to pick it up.  Lastly, it behooves me how they can stay in business if they get $1.5 for furniture and items they sell. We feel we have been scammed at the very basic level and request either our furniture back or a payment of $2,500 - we will give them back their paltry checks for $12, $19 and $49 which we have kept as evidence and non acceptance of their service.

Corbetts is currently being sold and transitioning from old owners to new. In a matter of a few weeks the new owners will be in place and paying any outstanding consignments.
